Marsh Wolfe noted the existence of a quorum and called the meeting to order at
1:30 P.M. Board members introduced themselves.
Theresa Westerfield made a motion, seconded by Raiette Avael, to approve the
minutes of the May 3, 2002 meeting. Motion passed unanimously.
Dave Owens summarized the proposal, application, and acceptance process and
timetable for the Local Law Enforcement Block Grant. He noted that one proposal
had been received for the LLEBG funds.
Theresa Westerfield discussed the proposal submitted on behalf of Juvenile Drug
Court. She and Marsh Wolfe discussed the fact that the LLEBG funds support only a
portion of Juvenile Drug Court, and the remainder is considered as part of the
County budget. Dave Owens, Marsh Wolfe, Theresa Westerfield, and Patricia Almeda
discussed the ten percent match requirement. Dave Owens noted that the County
matches with cash.
Patricia Almeda made a motion, seconded by Debbie Barsell, to recommend funding
of the Juvenile Drug Court Program with the LLEBG funds in the amount of
$88,050.00 grant funds and $9,783.00 in match for a total of $97,833.00. Motion
passed unanimously, with Theresa Westerfield abstaining.
The combining of the LLEBG and Byrne Grants into the Justice Assistance Grant in
the next year or two was briefly discussed by Dave Owens.
At approximately 1:45 P. M., Catherine Vogel made a motion to adjourn, and it
passed unanimously.

Proposal for Funding
The LLEBG purpose area to which our program applies is "[E]stablishing or supporting
drug courts."
The problem the Juvenile Drug Court program seeks to address is that of juvenile crime
and substance abuse. In 2001, there were a little over 700 delinquency complaints filed
with about 250 of those resulting in a delinquency petition being filed and the
remainder diverted in some way out of regular delinquency case processing. Twenty-
six percent (26%) of all complaints filed in 2001 were directly related to drug
possession (not including alcohol). One can conservatively estimate that of these
children, over half of them have one or both parents with ongoing substance abuse
issues as well. The problem is exacerbated by the fact that the cost of living in Monroe
County is the highest in the state with a median housing cost of $241,200 causing
many parents to work several jobs often leaving their children unsupervised. Another
problem the program seeks to address is the limited availability of substance abuse
treatment and other core adolescent services in the county. Finally, there are few
mechanisms in the juvenile justice system available to promote accountability. Juvenile
law violators need to be held accountable for their offenses to improve their own level
of functioning as well as for improved quality of life in the community.
The Juvenile Drug Court program combines intensive judicial supervision, mandatory
drug testing, escalating sanctions for non-compliance, specialized services, and
treatment to meet the goal of helping substance -abusing juvenile offenders in
preventing and reducing further law violations. In 1995, the Circuit applied for and
received an enhancement grant from the Drug Court Program Office (DCPO) to expand
various drug court services to the Middle and Upper Keys and to expand the program to
include a Juvenile Drug Court in all three locations. The first juvenile drug courts in the
county were held in January 1996 and have operated continuously since then. At the
end of the DCPO grant the program was first supported by a Byrne grant and since
then by LLEBG with matching County funds.
There is one full-time drug court counselor assigned to provide services to juveniles in
Key West. The counselors in Marathon and Plantation Key split their time on an
average of 50-50 between adult and juvenile drug court clients, although at one time
there was only one counselor splitting his time between all the adults and juveniles in
both Marathon and Plantation Key drug courts. The counselors report to the Drug
Court Coordinator who is funded by the state courts system. The Court Administrator,
with the Chief Judge having ultimate authority and responsibility over the program,
directly supervises the Coordinator.
The expected results of the program are a decrease in the use of illegal substances by
the drug court clients and a decrease in recidivism by these clients. The program has
been able to calculate the first measure but studying recidivism is problematic. The
average number of positive drug tests of participants in the Juvenile Drug Court
Program is 5.46% -- well below the national average of 24%. The retention rate for
the period July 1, 2001 through June 30, 2002 was 76% as compared to the national
average of 68%. Throughout the past year, both the Drug Court Coordinator and the
Court Administrator have been searching for funds for a process, outcome and impact
evaluation of the Juvenile Drug Court Program. Recent contact with the Drug Court
Program Office (Bureau of Justice Assistance, Office of Justice Programs, U.S.
Department of Justice) reveals that there may be funding for such evaluations in the fall
of this year. The 16"' Judicial Circuit will most assuredly apply for such funds.
