ITEM BACKGROUND: On July 23d, 2002, sealed bids were opened in the Purchasing Department for the relocation, addition, modification and reconfiguration of the 911 equipment located at the Key West Police Department. Two bids were received, one from BellSouth and one from Positron Public Safety Systems Corporation (attached). PREVIOUS RELEVANT BOCC ACTION: On May 15d', 2002, the Board granted approval to advertise for sealed bids for relocation, addition, modification and reconfiguration of the 911 equipment located at the Key West Police Department to 1600 N. Roosevelt Boulevard during the latter part of 2002. CONTRACT/AGREEMENT CHANGES: This is not a contract. STAFF RECOMMENDATION: Approval. Force Maieure Clause POSITRON will not be responsible or liable for any loss or damage occasioned by its inability to perform any of its obligations herein where such inability was caused by a force majeure, which shall include but is not limited to, fire, strike, flood, explosions, civil or military authority, terrorist ads, insurrection or civil disorder, embargoes, Government action, delay in or refusal of equipment by any third party, or other cause which is unavoidable or not in control of POSITRON. LIMITATION OF LIABILiTYCLAUSE POSITRON SHALL IN NO EVENT BE LIABLE TO KEY WEST FOR LOSS OF PROFITS, OR SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES. INCLUDING COSTS OF LEGAL EXPENSES, IN CONNECTION WITH THIS AGREEMENT AND/OR THE PERFORMANCE HEREOF. Cost Proposal The proposal submitted should specify a fixed cash purchase price for additional equipment required and specified. Awarded Bidder and Monroe County will mutually agree upon a payment schedule. Proposal must show as separate items the cost of 1. Proposed new Equipment and cost. 2. Monroe County equipment utilized and associated cost. 3. Installation 4. Training 5. Project Management 6. All other costs incidental to the successful installation of the specified system. BellSouth Response: Read and agreed with exception 1. New Equipment costs for Option 1, re -using the current equipment, adding four power light positions, and taking into consideration the down -time for moving the equipment purchase price for new equipment is $114,196 and continuing maintenance expense for new equipment is $1,383 per month for a 60 month term. Option 2, should the County require no down time, BellSouth will have to supply all new equipment including a new controller. Should the County be willing to forward the E911 calls to Monroe Sheriffs Office, BellSouth will be able to re -use the existing equipment such as the Lifeline controller. 2.For Option 1, to move the existing Lifeline 100 controller, backroom equipment, and three LAP Work Stations currently utilized will cost $36,558. BellSouth will disconnect the equipment, package it, and it is the County's responsibility to move the existing equipment to the new location. Any additional costs not stated in the proposal shall not be incurred by the City of Key West, FL. or Monroe County, unless specifically agreed to in writing by Monroe County.
