1. Monroe County v. Atlantic Trash / Magnolia 101, LLC, CA-P 13-945. This case
began as the County's complaint for an injunction and foreclosure of a code
compliance lien. The Court entered a judgment in favor of the County on 5/2/17,
which the Third District Court of Appeal affirmed. The BOCC met in closed session �-
on 5/25/21 in response to settlement offer. Counter offer has been conveyed
but has not bee accepted yet. If this agreement cannot be finalized by 6/16/21
meeting, the Trial Court will hold hearing to determine final fines on 6/17/21.
2. Disaster Solutions, LLC v. Monroe County, CAK19-32. An action for breach of
contract and other claims arising from a firm that had a purchase order to provide
services which were capped at $49,999, but who submitted invoices in excess of
$700,000. The Court granted the County's motion to dismiss on 4/4/19. Disaster
Solutions filed a third amended complaint on 8/15/19. The parties are engaging in
discovery.
3. Scott Lewis and Disaster Solutions, LLC v. Monroe County, 21-CA-258-K (new
case). On 4/16/21, Disaster Solutions and its President (Scott Lewis) also filed a
complaint against Monroe County, alleging that the County violated Florida's Public
Records law. Plaintiffs seek injunctive relief and a writ of mandamus as well as
attorneys' fees and costs. A hearing is scheduled for 6/14/21 at 1:30 pm.

4. Monroe County v. Estate of Jerome Pfahning, 15CA214K. This is an action to
declare the property to be a nuisance, and for an injunction to require abatement of
the nuisance through demolition of structures, cleanup of the property and
connection to the central wastewater system. On 12/21/20, the County filed a
second amended complaint seeking foreclosure, money judgment and writ of
execution. The defendant filed its Answer on 1/21/21. No trial date is currently set.
5. Sunset Gardens Estate Land Trust v. Monroe County, CAP 19-460. Property owner
filed a two-count complaint alleging that various state laws including the Right to
Farm Act, F.S. 823.14, preempt the County's land development regulations from
applying to its parcel and seeking judicial declarations that its alleged agricultural
activities are immune from the County's land development regulations. On 2/27/20,
the Plaintiffs filed a second amended Complaint. The Court denied the County's .�
motion to dismiss on 4/5/21. The County's answer is due 6/10/21.

6. Roy's Trailer Park v. Noel & Monroe County, 19-CA-175-K (lower tribunal: CC-K-18-
112). Declaratory Judgment action filed by trailer park against County as part of its
eviction suit against its tenant. On 10/4/18, the County countersued the trailer park
and the park residents, seeking an injunction prohibiting occupancy at the park until
serious fire and life safety issues have been addressed, and for appointment of a
receiver. The trailer park amended their claim again on 7/31/20, arguing that park
residents are at fault and that the County is preempted by state law from enforcing
against it. On 11/11/20, the County filed its motion to amend the counterclaim to add
declaratory relief counts to determine whether the owner or tenants are responsible
for the code violations. On 1/19/21, the Court denied the park tenants' motions to U
dismiss the park owner's Third Amended Complaint and granted the County's
motion to file its Second Amended Counterclaim. On 2/26/21, the park tenants filed
their Answer to the County's Second Amended Counterclaim. On 3/1/21, the Park
owner filed its answer. On 3/15/21, Monroe County filed a motion to strike the
affirmative defenses of the tenants. A hearing on that motion is scheduled for
6/7/21. On 5/21/21, the park owner presented a settlement offer that will be
discussed with the Board at a closed session at the 7/21/21 BOCC meeting.
7. KITK, LLC v. Monroe County, CAP 19-351. Property owner filed a Complaint
seeking a judicial declaration that F.S. 419.001(12) preempts Monroe County's land
development regulations from prohibiting, on its allegedly residentially zoned
property, its alleged community residential home of six or fewer residents. On
10/6/20, the County filed its answer. The plaintiff and the County have engaged in
settlement discussions and anticipate reaching a settlement.
8. Maschal et al. v. Monroe County and FKAA, CA K 19-186 — Suit against Monroe
County and FKAA by Banks Prevatt and 11 other individuals seeking similar relief to
the Delaney lawsuit, which the County won. The Court has dismissed Counts I and
II (declaratory relief and mandamus) with prejudice, but gave the Plaintiffs' leave to
amend as to Count III, equitable estoppel. On 1/4/21, Plaintiffs filed a Second
Amended Complaint. The County's motion to dismiss was filed on 3/25/21. The
County is working with other parties to select a hearing date.

9. Burke Construction Group. Inc. v. Monroe County, CA-M 19-80 - On 7/11/19, Burke
Construction Group sued to challenge the County's bid protest procedure and
decisions to award contracts for the Marathon Library and Cudjoe Fire Station
projects to other contractors. The County's motion to dismiss was scheduled for
3/16/21, but was canceled when Burke agreed to file an amended complaint. Burke
filed a Second Amended Complaint on 4/2/21. The County filed a motion to dismiss
on 4/28/21.
10.Monroe County v. Purdue Pharma L.P. et al., No. 4:19-cv-10049. This case was
filed by Monroe County against opioid manufacturers/marketers and distributors on
4/3/19. The complaint seeks damages including punitive damages, attorneys' fees,
costs, and injunctive relief. The case is part of multi-district litigation under a judge
in Cleveland, Ohio. On 7/15/19, the County filed its initial statement describing .�
damages. The case is at the early discovery stages. The parties are in settlement
discussions with the distributor defendants and Johnson & Johnson. Three of the
other manufacturer defendants (Purdue Pharma, Insys and Mallinckrodt) have filed
bankruptcy. The County has filed claims in the bankruptcy cases. Counsel
representing local governments and the Attorneys General for states in the national
litigation have come to a preliminary point of view regarding a potential formula for
distribution of settlement proceeds. Staff will be bringing forward an item on the
8/18 agenda to approve a resolution laying out the settlement formula. The
overall settlement amount and final settlement documents will be brought
back to the BOCC at a later date.
11.Keith & Cheri Cohen v. Monroe County, 15-10167-CIV /USCA 17-15552-G — On U
9/20/18, the Court ruled that the County's workforce housing requirement did not
discriminate against the Cohens due to their asserted disabilities. The Court ordered
the Cohens to sell their property to a qualified buyer and vacate the premises, and
ordered the Cohens to reimburse the County's taxable costs of $1,963.55 plus
interest. The County has given a deadline to the Cohens by which they must pay
the costs. The judgments were recorded on 2/11/20. The County issued a demand
letter on 3/1/21 and is awaiting payment of the debt.
12.Monroe County v. Sugarloaf VFD, Inc. & Sugarloaf Wi-Fi, Inc., CAK 17-631. The
County sued both SVFD and Wi-Fi to invalidate a lease between SVFD and Wi-Fi
on the grounds that SVFD had not approved the lease in an open meeting. The trial
court ruled in favor of the County and voided the lease. Wi-Fi appealed and lost.
The County will be filing a motion for attorneys' fees as the prevailing party.
Mediation between Wi-Fi, the SVFD, and the County is scheduled for 6/8/21.
13.Ernest G. Williams v. Monroe County, Florida, 21-CA-151-P. Plaintiff, a property
owner in Key Largo, was the subject of a Code Compliance Final Order in 2011, for
floodplain violations and unsafe structure of his homestead property. The Final
Order (which set a daily fine) was then recorded, at which point under F.S. 162.09 it
became a lien on the property. The property owner sued for declaratory relief and
to quiet title, seeking a declaration that the Final Order is not a lien, because the
property owner is under contract to sell the property and wishes to discharge the
lien. The County's Answer was due 5/17/21. The parties agreed to extend the
deadline to file a responsive pleading to 5/28/21 due to a closed session being held
on 5/25/21. The County filed a Motion to Dismiss on 5/28/21.

Appellate Cases of Interest
14.AshBritt. Inc. v. Monroe County & FDOT Third DCA Case 3D20-553 (lower tribunal:
16t" Jud. Cir. 17-CA-802-K). AshBritt sued the County for breach of contract and
for breach of implied covenant of good faith and fair dealing. The County answered
and moved for summary judgment (MSJ). On 2/24/20, Judge Koenig denied the
County's MSJ. On 3/23/20, the County filed an appeal from that order in the Third
DCA. The County filed its initial brief on 6/11/20. AshBritt filed a motion to dismiss
the appeal on 6/22/20, which the Third DCA denied on 7/7/20. Ashbritt's answer
brief was served on 9/25/20. The County filed a reply brief on 11/20/20. Oral
argument was held on 3/10/21. Awaiting a decision.
15.Monroe County & State of Florida v. Donald Davis (Collins) — Third District Case
Nos. 3D20-1762 and 3D21-1078. The County and State were found liable for the
inverse condemnation of Davis' property. A satisfaction of the $347,475 judgment
was issued on 11/22/19, leaving only the issue of attorneys' fees and costs to be
litigated. On 11/25/20, Tobin and Mattson filed a Petition for Writ of Certiorari
directed to an order regarding their charging lien against Davis. On 5/14/21, the
Third District dismissed the Petition due to Tobin and Mattson's failure to
show cause pursuant to an earlier order of the court. On 4/6/21, the trial court
entered an order approving a settlement agreement between Davis, the County, and
the State on the issue of fees and costs, denying Tobin and Mattson's motion to be
added as parties to pursue an additional award of fees against the County and State,
and closing the case. On 5/5/21, Tobin and Mattson filed an appeal of that order. U
16.KRZ, LLC v. Monroe County, 20-AP-41-K. On 12/18/20, the property owners filed a
notice of appeal of the 11/19/20 Final Order of the Special Magistrate that found it in
violation of land clearing and filling standards in the Land Development Code.
Appellant filed its initial brief on 2/16/21. The County filed its answer brief on
5/24/21. On 5/26/21, the County also filed a motion to strike Appellant's notice
of supplemental authority.
17.Galleon Bay Corp. v. Monroe County and State of Florida — CA K 02-595/ 3D19-
1783. This takings case resulted in a final judgment in the amount of $480,511. A
Satisfaction of Judgment was issued. Galleon Bay's motion to invalidate the final
judgment was denied by the Circuit Court on 8/16/19. On 9/13/19, Galleon Bay
appealed that order to the Third DCA. On 10/18/19, Monroe County and the State
moved to dismiss the appeal, which the Court agreed to carry with the case. On
12/2/20, the Third DCA issued an Opinion affirming the order of the trial court. The
court also denied Galleon Bay's motion for attorneys' fees. Galleon Bay filed an
appeal of the Third DCA's decision to the Florida Supreme Court on 3/17/21. On
3/29/21, Galleon Bay filed a motion for a 60-day extension of time to file its
jurisdictional brief; the motion was granted on 4/14/21. Galleon Bay's brief was
filed on 5/28/21. Later that day the Supreme Court issued an order striking the
brief for failure to comply with Florida Rules of Appellate Procedure. Galleon
Bay has until 6/7/21 to re-file its brief.

18.Haim v. Monroe County et al.. 4:20-cv-10058-KMM (S.D. Florida) (11t" Circuit Appeal
20-13271-AA). Two residents and a non-resident sued the County, Mayor
Carruthers, EM Director Shannon Weiner, and the Sheriff over the emergency
directives establishing the US1 checkpoint. The County removed the case to
Federal Court on 6/5/20, filed its response to the Plaintiff's Motion for Temporary
Injunction on 6/8/20, and moved to dismiss the entire case on 6/8/20. Sheriff
Ramsay filed a similar motion. On 8/17/20, the Court dismissed the case. Plaintiffs
appealed to the 11t" Circuit on 8/28/20 and filed their brief on 12/1/20. The County
filed its answer brief on 1/28/21; the Sheriff filed his brief on 2/5/21. On 5/27/21,
County filed Governor's E.O.'s 21-101/21-102 as supplemental authority,
notifying the Court that the COVID checkpoint was not capable of repetition.
Awaiting a decision of the Court.
19.Atlantic Circle. LLC v. Monroe County Planning Commission, 2020-CA-48-P. On
3/11/20, Petitionerfiled itsAmended Petition seeking to quash Planning Commission
Resolution No. P58-19 that approved with conditions the request by Randolph Wall
for a variance of 5 feet from the required 25-foot primary front yard setback and a
variance of 10 feet from the required 20-foot rear yard setback. On 3/20/2020, the
Court entered its Order Directing Respondents to File Response. A response to the W
Petition was filed on 6/16/20. Petitioner's reply brief was filed on 8/7/20. Awaiting a
decision.
20.Victorio Martinetti, et. al. v. Monroe County, 20-AP-1-M. On 9/25/20, property
owners found in violation of the land clearing standards in the Land Development
Code by the Special Magistrate filed this appeal to the Circuit Court. Appellants filed U
their initial brief on 2/17/21. The County filed its answer brief on 4/22/21. On 5/4/21,
Appellants filed a motion for referral to appellate mediation. Appellants are also
seeking additional time to file their reply brief.

21.William Guy v. Monroe County, 19-AP-3-P. On 1/31/19, property owners found in
violation of the land clearing standards in the Land Development Code by the
Special Magistrate filed this appeal to the Circuit Court. Appellant filed his initial brief
on 3/15/21. County's answer brief due 6/14/21.
22.Jill Patterson et al. v. Monroe County, 21-CA-139-P. On 4/2/21, a group of adjacent <
or nearby property owners filed a Petition for Writ of Certiorari to the Circuit Court,
seeking to quash or reverse the decision of Monroe County Planning Commission
approving Resolution PO4-21, which granted a Major Conditional Use permit to
applicant Southcliff Estate Employee Housing, filed by Frank Pla on behalf of the
property owners. The County will defend on various grounds.
23.Edwin and Janice Handte v. Monroe County, 20-AP-6-K. On 9/25/19 Planning
Director denied property owners' application to be considered exempt from the
Land Development Code's vacation rental special permit and manager license
requirements. On 7/31/19 the Planning Commission denied property owners'
appeal of the Planning Director's decision. On 7/6/20, a DOAH hearing officer
denied the owners' appeal. Property owners appealed to the Circuit Court on
7/23/20. Oral argument was held on 4/14/21. Awaiting a decision.

24.Ricky Hill & Jayne Hill v. Monroe County, 20-AP-0004-P. On 9/22/20, property
owners found in violation of the land clearing standards in the Land Development
Code by the Special Magistrate filed this appeal to the Circuit Court. Appellants
initial brief due 6/15/21.
Administrative Cases of Interest
25.FKAA v. FDEP & Florida Power & Light, — DOAH Case Nos. 20-2967 (consolidated
with 20-2968, Florida Fishing Guides Ass'n v. FPL). The FKAA filed an
administrative petition challenging DEP's intent to issue a National Pollution
Discharge Elimination System (NPDES) permit to FPL to operate treatment and
disposal facilities at Turkey Point Power Plant. The County intervened in support of
the FKAA. The final hearing was held in January 2021. Both sides filed proposed N
recommended orders on 5/17/21.
26.Lower Density for Lower Sugarloaf, LLC, et al. v. Monroe County Planning
Commission, DOAH 21-494. On 2/5/21 a group of property owners neighboring the
proposed affordable-employee housing development filed an appeal to DOAH,
seeking to quash or reverse the Planning Commission's granting of a Major F
Conditional Use permit to applicant Lower Keys Community Center Corp., and also
on 2/5/21 filed a parallel appeal of Resolution No. P36-20 to the BOCC sitting as an
appellate body under Chapter 139 of the Land Development Code. On 3/22/21, the
DOAH ALJ granted the developer's motion to intervene. The appellants on 4/6/21 U
filed a motion for the DOAH ALJ to stay the DOAH proceeding, which the DOAH ALJ
denied on 4/26/21. The appellants' initial brief was filed 5/13/21. The County's
answer brief is due 6/14/21.

27.Diane Beruldsen, Catherine Bosworth, Cecelia Mattino, and Naia Girard v. Monroe
County, DOAH 21-1657GM. Administrative petition challenging Ordinance 05-
2021, amending Comp Plan to authorize 300 early evacuation ROGOs that are
to be used as exchange for existing affordable ROGOs was filed on 5/21/21.
The reclaimed ROGOs would be used for administrative relief. AJL issued
scheduling order 5/26/21. Final hearing date needs to be set.
28.Sergio Velikopoliski v. Monroe County Planning Department. On 4/9/21, the property
owner filed an appeal to the Planning Commission of the Department's denial of its
building permit application (#17305163)for the completion of a single-family dwelling
unit at 180 Pompano Drive, Key Largo, FL(Parcel ID 00552670-000000). The denial
was based on setback and shoreline open space requirements under the current
land development code.Appellant is asserting that he only needs to comply with the
requirements that existed at the time construction was permitted (but never
completed) in the 1990's The appeal is tentatively being scheduled for hearing
at the Planning Commission's meeting in July.

Vacation Rental Cases
29.Thurmond Street Partners, LLC v. Monroe County, Florida, 18AP10-K & 18AP11K.
Third DCA Case 3D19-2367. Appeal of 2018 finding by Code Compliance Special
Magistrate that Thurmond Street Partners vacation wedding use violated Section
130-94 of the Code. The property owner appealed to the Circuit Court, which
reversed the Special Magistrate's decision on 11/6/19. On 12/6/19, the County filed
a Petition for Writ of Certiorari to the Third DCA. The parties filed a Joint Notice of
Filing Conditional Settlement Agreement and Request for Entry of Order Staying
Case on 6/1/20, giving the property owner 90 days to apply for zoning changes. The
County subsequently extended that deadline to 2/28/21. On 6/2/20, the Third DCA
entered an order temporarily staying the case. On 12/15/20, the property owner and
County staff held pre-application conferences. Letters of Understanding resulting
from the parties' pre-application conferences were issued on 2/18/21. The property

owner had until 3/15/21 to file its tier amendment application, and until 6/15/21 to file
its rezoning and future land use map change applications.
30.Buttonwood Key Largo v. Monroe County, 21-CA-0068-P. On 2/16/21, Buttonwood
filed a complaint seeking declaratory and injunctive relief, including a declaration of
whether the six-room former hotel is entitled to vacation rental permit exemptions
pursuant to LDC Section 134-1(b)(1) (despite the fact that Buttonwood's applications
for such exemptions were denied on 12/18/21, and the denials were not appealed),
and an injunction against code enforcement. The County filed its answer and
affirmative defenses on 4/23/21. On 4/26/21, the County served its first set of
interrogatories. On 5/25/21, Buttonwood filed a motion for a thirty-day �?
extension of time to respond to the interrogatories. Also pending in the Circuit
Court is a consolidated appeal of the Final Orders rendered by the Code
Enforcement Special Magistrate on 10/31/20, Buttonwood Key Largo v. Monroe CN
County, 20-AP-0009-P. In that case, on 3/24/21, the court entered an Agreed Order
Abating Appeal pending the outcome of the circuit court action on the complaint
seeking declaratory and injunctive relief.

31.Sirena Key, LLC v. Monroe County, CAP 18-704. On 9/21/18, Sirena Key sued
seeking to declare that the vacation rental ordinance is preempted by state law due �-
to alleged changes in the County's enforcement practices. On 6/26/20, the Court
granted the County's motion for summary judgment on Counts I and 11. The County
filed its motion for summary judgment on Count III on 9/24/20. On 11/5/20, Sirena E
Key filed an amended Count III. The County filed its answer to the amended
complaint on 11/24/20. The parties are proceeding with discovery on the amended
count. The County will amend the pending summary judgment motion and reset for
hearing in 2021. Also pending in the Circuit Court is an appeal from the Special
Magistrate's decision finding Sirena Key in violation of the vacation rental ordinance,
Sirena Key, LLC v. Monroe County, 18-AP-3-K. In this case, the Appellant Sirena
Key filed a motion to stay the appeal pending resolution of the 16t" Judicial Circuit
Case. Over objection from the County, the Court granted the motion and stayed the
appeal until further order of the Court. There will be no movement on the appeal
until the Circuit Court case is concluded.

32.Coral Hammock Rental, et al. v. Monroe County, 20-AP-11-K. On 10/29/20, the
Special Magistrate heard 47 vacation rental violation cases arising from Coral
Hammock, found 45 properties in violation, and assessed fines of$224,329 in fines
plus costs. Twenty-Six of the 45 property owners found in violation appealed the
final order to the Circuit Court. Following a 2/18/21 hearing on appellants' motion to
consolidate, the appeals were consolidated for purposes of briefing common issues
of law. Awaiting the filing of Appellants' initial brief. Appellant is seeking an
extension to file until 6/4/21.
Constitutional Officer Cases
33.Heather Carruthers v. Eddie Martinez, SOE Joyce Griffin, and MC Canvassing
Board, 20-CA-000749-K. On 11/23/20, former commissioner Carruthers filed an
election contest suit challenging the results of the District 3 BOCC seat race. The
County Attorney's Office filed an answer on behalf of the SOE and the Canvassing
Board on 12/07/20. On 1/5/21, the Court denied Martinez's motion to dismiss. On
2/24/21, the Court entered an Expedited Scheduling Discovery Order. Awaiting
scheduling of trial.
34.League of Women Voters of Florida, et al v. Laurel M. Lee, Joyce Griffin, et al, 4.21-
cv-00186, USDC/NDFL. Plaintiffs seek injunctive and declaratory relief against
Secretary of State, the FLAG, and the Supervisors of Election for all 67 counties,
challenging SB 90, the recently enacted elections legislation. Griffin and other SOEs
retained outside counsel. The County Attorney's Office will be assisting in the
defense. Griffin's answer is due on 7/12/21. Discovery is ongoing. There have
been two additional Federal Court cases filed also challenging the newly enacted
SB 90, but Supervisor Griffin has not been specifically named as a defendant in
those cases yet.

Other Matters of Interest
35.Code Collections. In May, staff collected a total of $146,781.32 in code fines and
costs. Thus, to date in FY21, staff collected a total of $1,474,759.11 in code fines
and costs including after-the-fact fees. See attached spreadsheet.
36.Vacation Rental Prosecutions. No vacation rental cases were heard by the Code
Compliance Special Magistrate on 5/27/21.
