ITEM BACKGROUND: The Monroe County Board of County Commissioners (BOCC) at its May 19, 2021 regular meeting discussed increasing the parking fines on county roads to deter illegal parking. The current noncriminal civil penalty for parking violations is $20.00 and has been at $20.00 since at least 1996 by adoption of Ordinance No. 32-1996. The BOCC at its May 19, 2021 meeting was shown various pictures and videos of areas where parking violations on"No Parking" posted county roads repeatedly occurs. In consideration of the information presented after discussion, the BOCC directed for staff to draft an ordinance and to hold this public hearing to consider adoption of an ordinance to increase the noncriminal parking penalty from $20.00 to $200.00 in an effort to deter parking violations from occurring on county "No Parking" areas. Staff currently post"No Parking" signs on county roads as approved by resolution by the BOCC and will include the noncriminal civil penalty amount moving forward and will update signs already erected to include the noncriminal civil penalty on signage. F.S. 316.1967 provides for the fine amount to be designated by county ordinance. Section 25-27 of the Monroe County Code, which sets the noncriminal civil penalty for parking violations, will be amended by this ordinance to designate the fine as $200.00. Motor Vehicles(Chapters 316-325) Chapter 316.State Uniform Traffic Control(Refs&Annos) West's F.S.A.§316.1967 316.1967.Liability for payment of parking ticket violations and other parking violations N Effective:July 1,2005 Currentness cv (1) The owner of a vehicle is responsible and liable for payment of any parking ticket violation unless the owner can furnish c evidence,when required by this subsection,that the vehicle was, at the time of the parking violation,in the care, custody, or control of another person. In such instances, the owner of the vehicle is required, within a reasonable time after notification of the parking violation,to furnish to the appropriate law enforcement authorities an affidavit setting forth the name, address, C le and driver license number of the person who leased, rented, or otherwise had the care, custody, or control of the vehicle. The affidavit submitted under this subsection is admissible in a proceeding charging a parking ticket violation and raises the rebuttable presumption that the person identified in the affidavit is responsible for payment of the parking ticket violation.The owner of a vehicle is not responsible for a parking ticket violation if the vehicle involved was,at the time,stolen or in the care, custody,or control of some person who did not have permission of the owner to use the vehicle. The owner of a leased vehicle .9 is not responsible for a parking ticket violation and is not required to submit an affidavit or the other evidence specified in this section,if the vehicle is registered in the name of the person who leased the vehicle. CL (2) Any person who is issued a county or municipal parking ticket by a parking enforcement specialist or officer is deemed mD to be charged with a noncriminal violation and shall comply with the directions on the ticket. If payment is not received or a S response to the ticket is not made within the time period specified thereon,the county court or its traffic violations bureau shall notify the registered owner of the vehicle that was cited,or the registered lessee when the cited vehicle is registered in the name of the person who leased the vehicle,by mail to the address given on the motor vehicle registration, of the ticket. Mailing the notice to this address constitutes notification. Upon notification, the registered owner or registered lessee shall comply with the court's directive. Ui (3)Any person who fails to satisfy the court's directive waives his or her right to pay the applicable civil penalty. E (4) Any person who elects to appear before a designated official to present evidence waives his or her right to pay the civil penalty provisions of the ticket. The official, after a hearing, shall make a determination as to whether a parking violation has been committed and may impose a civil penalty not to exceed$100 or the fine amount designated by county ordinance, plus court costs.Any person who fails to pay the civil penalty within the time allowed by the court is deemed to have been convicted of a parking ticket violation,and the court shall take appropriate measures to enforce collection of the fine. (c) The Board of County Commissioners may by resolution restrict or prohibit the parking, stopping or standing of vehicles on hazardous or congested portions of County roads, intersections or parking lots. The portion of the road(s), intersection(s) or parking lot(s) affected must be posted with signs that state the restriction or prohibition. After posting, no person may park, stop or stand a vehicle in violation of the posted restriction or prohibition. (d) The Board of County Commissioners may by resolution restrict or prohibit the parking, standing or stopping of vehicles along County roads during the nighttime hours. The road(s) affected must be posted with signs that state the restriction or prohibition. After posting, no person may park, stop or stand a vehicle in violation of the posted �+ restriction or prohibition. (e) The noncriminal civil penalty for a violation of subsection (a), (b), (c) or (d) and of the resolution designating the restricted or prohibited parking area is $20.00. Stat., the Monroe County Clerk of the Court is directed to supply the State Department of Highway Safety and Motor Vehicles with a magnetically encoded computer tape reel or cartridge, or to supply by other electronic means, data that is machine readable by the installed computer at the Department, listing persons who have three or more outstanding County parking violations or one or more violations of Sec. 11-2, Monroe County Code, concerning disabled parking space violations. Stat., the Monroe County Tax Collector may not issue a license plate or revalidation sticker to an applicant whose name appears on the list referred to in subsection (a) until that person presents a receipt from the Clerk of the Court showing that the County parking fines outstanding have been cV paid. 0 (c) The Tax Collector and the Clerk of the Court are each entitled to receive monthly, as costs for implementing and administering this section, 10% of the civil penalties and fines collected. This section applies even though a no parking ordinance requires that c all penalties collected be deposited in a certain account or accounts. Section 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section 5. If any section, subsection, sentence, clause, item, change or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 6. This ordinance shall take effect immediately upon receipt of official notice from L the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office. Section 7. (e) The noncriminal civil penalty for a violation of subsection (a), (b), (c) or (d) and of the resolution designating the restricted or prohibited parking area is $20.00. A law enforcement officer or parking enforcement specialist who discovers a vehicle parked in violation of subsection (a), (b), (c) or (d) and the resolution may issue a ticket in the form used by the County for parking violations to the driver or, if the .c vehicle is unattended, attach the ticket to the vehicle in a conspicuous place. The liability for the payment of the ticket is pursuant to Sec. 316.1967, Fla. Stat. Penalties collected under this section must be cv remitted to the County's general fund. c Section 3. Sec. 11-10, Monroe County Code, is created to read: Sec. 11-10. Collection of civil parking penalties. (a) As authorized by Sec. 316.1967(6), Fla. Stat., the Monroe County Clerk of the Court is directed to supply the State Department of c Highway Safety and Motor Vehicles with a magnetically encoded computer tape reel or cartridge, or to supply by other electronic means, data that is machine readable by the installed computer at the Department, listing persons who have three or more outstanding County parking violations or one or more violations of Sec. 11-2, Monroe.County Code, concerning disabled parking space violations. Stat., the Monroe County Tax Collector may not issue a license plate or revalidation sticker to an applicant whose name appears on the list referred to in subsection (a) until that person presents a receipt from the Clerk of the Court showing that the County parking fines outstanding have been paid. 0 (c) The Tax Collector and the Clerk"of the Court are each entitled to receive monthly, as costs for implementing and administering this section, 10% of the civil penalties and fines collected. cv This section applies even though a no parking ordinance requires that o all penalties collected be deposited in a certain account or accounts. Section 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section 5.
