Approval to advertise a public hearing for an ordinance changing 6-56 Monroe
County Code Specialty License definitions for cabinet and millwork specialty
contractor, masonry specialty contractor, and steel reinforcing and iron specialty
contractor.
ITEM BACKGROUND: There have been a number of instances where cabinet and
millwork specialty contractors, who were intended to be licensed for cabinetry and
interior trim carpentry work have interpreted the definition to encompass installation
of wood and vinyl siding below the first floor of elevated structures. The revision of
the definition for cabinet and millwork specialty contractor is intended to clarify that
such construction is not included in the contractor's license. There have been
several masonry specialty contractors, some of whom also carry steel reinforcing and
iron specialty licenses, who have appeared before the Contractors Examining Board,
either in disciplinary hearings or in petitions to the Board to expand the definition of
license to include placing forms for repairing concrete spalling. These contractors
have had the expertise and often do the work, even when a general, residential, or
building contractor signs on to a permit for the form placement segment of the
project only. The Contractors Examining Board has requested the foregoing
described changes to the County Code.

AN ORDINANCE AMENDING THE MONROE COUNTY CODE BY THE
AMENDMENT OF TEXT TO SEC. 6-56; DEFINITIONS OF SPECIALTY
CONTRACTORS FOR CABINET AND MILL WORK, MASONRY, AND STEEL
REINFORCING AND 'IRON; PROVIDING FOR THE SEVERABILITY;
PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT
HEREWITH; PROVIDING FOR THE INCORPORATION INTO THE MONROE
COUNTY CODE; AND DIRECTING THE CLERK OF THE BOARD TO FORWARD A
CERTIFIED COPY OF THIS ORDINANCE TO THE FLORIDA DEPARTMENT OF
COMMUNITY AFFAIRS AND PROVIDING AN EFFECTIVE DATE
WHEREAS, there have been interpretations by contractors and property owners of the
cabinet and millwork specialty contractor definition to allow said contractor to enclose with wood
or plastic siding the space below the lowest floor of an elevated structure; and
WHEREAS, contractors who repair concrete spalling have been determined by the
Contractors Examining Board for Monroe County to have appropriate expertise to place forming
for the spalling repairs only; now therefore;
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, THAT
Section 1. Section 6-56 Monroe County Code definition of specialty contractors shall be
amended as follows:
(5) Cabinet and millwork specialty contractor is qualified to fabricate and install
cabinets of all kinds, prefabricated or on-site fabricated cnclosufCs of weed or plastic of a non-
structural nature; to apply paneling to the interior of the structure, which paneling shall be of
wood or synthetic products or a combination of both; and to set door jams, hang doors, and apply
trim molding to the interior of a structure.
(21) Masonry specialty contractor is qualified to place and finish concrete, and to
fabricate or install block and bricks in a building. He cannot built or place forms or place steel in
anything other than non-structural concrete components. except that he can place forms for the
puroose of reoalrino soallino concrete only.
(32) Steel reinforcing and iron specialty contractor is qualified to place and tie
reinforcing steel In forms built by others and forms built bv said contractor to reoair spallln9
concrete only.
Section 2. If any section, subsection, sentence, clause or provision of this ordinance is
held invalid, the remainder of this ordinance shall not be affected by such invalidity.
Section 3. All ordinances or parts of ordinances in conflict with this ordinance are
hereby repealed to the extent of said conflict.
Section 4. The provisions of this ordinance shall be included and incorporated in the
Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and
shall be appropriately renumbered to conform to the uniform numbering system of the Code.
Section 5. This ordinance shall take effect immediately upon receipt of official notice
from the Office of the Secretary of State of the State of Florida that this ordinance has been filed
with said Office.

at a regular meeting of said Board held on the day of , 2002.
