AGENDA ITEM WORDING: Approval of Interlocal Agreement between the City of Marathon and Monroe
County for the transference of sixty-seven (67) affordable housing allocations.
ITEM BACKGROUND: In May 2001, the Florida Department of Community Affairs and Monroe County entered
into a Memorandum of Agreement for the distribution of 201 ROGO allocations for affordable housing that had been
"lost" in the first eight years of ROGO due to cutbacks in the County's allocation through rule making by the Florida
Administration Commission, lack of nutrient reduction credits, and limits placed by the Comprehensive Plan on the
number of annual allocations. These "lost" allocations are from all of unincorporated Monroe County, including the
City of Marathon and Village ofIslamorada which become incorporated during those first eight years.
The BOCC has previously authorized 63 of these affordable housing allocations to projects in the County. Therefore
138 allocations remain which can be used anywhere within Monroe County including incorporated areas.
The City of Marathon has requested that Monroe County provide it with 67 allocations from this pool of affordable
housing allocations. These allocations will be coupled with the 67 nutrient reduction credits from the Little Venice
project, which the City of Marathon will receive upon the effective date of the DCA Rule Change.
The City of Marathon has already approved the proposed agreement, which has certain conditions where the
allocations may be applied. The County staff finds that Marathon is an appropriate location for affordable housing
due to the fact it has the needed private and public infrastructure, is the employment and commercial center of the
Middle Keys, and contains more environmentally less sensitive lands for development of affordable housing projects
relative to other areas ofthe Middle Keys. The development of affordable housing from these allocations will benefit
all ofthe Middle Keys.

INTERLOCAL AGREEMENT BETWEEN
THE CITY OF MARATHON, FLORIDA, AND
MONROE COUNTY, FLORIDA, TRANSFERRING
AFFORDABLE HOUSING ALLOCATIONS
This Agreement ("Agreement") is being entered into by and between the City of
Marathon, Florida ("City") and Monroe County, Florida ("County") to allocate a portion of the
two hundred and one (201) affordable RaGa housing allocations (the "RaGa Allocations")
between the City and the County.
WITNESSETH
WHEREAS, the City and County haye been declared an Area of Critical State Concern
pursuant to Sections 380.05 and 380.0552, Florida Statutes; and
WHEREAS, pursuant to an agreement between the County and the State of Florida
Department of Community Affairs dated May 3,2001, the County received two hundred and one
(201) RaGa Allocations to replace RaGa allocations cumulatively lost over the years due to an
inadequate number of nutrient reduction credits, required reduction in total allocation by the
Florida Administration Commission, and annual limits on the total number of permits; and
WHEREAS, the City and County agree that sixty-seyen (67) Allocations would provide
opportunities for needed affordable housing within the corporate limits of Marathon; and,
WHEREAS, the City of Marathon is an appropriate location for affordable housing as it
has the needed private and public infrastructure to serve such development and is in close
proximity to employment and commercial centers; and
