ITEM BACKGROUND: The Cesspit Identification and Elimination Program and location of Coldspots provided the means to eliminate cesspits from areas that would not be provided sewer service in the foreseeable future. The program also provided grant funds to homeowners in coldspots who were required to replace their cesspit. Recent action by the BOCC confirmed that Duck Key was a coldspot and added Conch Key. However, this action in the face of the fact that both areas will receive sewer service, means that homeowners in these areas are being required to install engineered wastewater systems for new construction, expansion of existing buildings, or significant 'repairs requiring Department of Health permits. Engineered wastewater systems are very expensive. BC021070 09/20/02 10: 16 AM Marine Resources RESOLUTION NO. 2002 A RESOLUTION OF THE MONROE COUNTY BOARD OF COMMISSIONERS RESCINDING RESOLUTIONS 39-2002 AND 40-2002 WHICH DESIGNATED CONCH KEY AND DUCK KEY AS COLDSPOTS UNDER CHAPTER 15.5 MONROE COUNTY CODE. WHEREAS, the Board of County Commissioners designated Conch Key and Duck Key as Coldspots in Resolutions 39-2002 and 40-2002 respectively; and WHEREAS, Conch Key and Duck Key will both receive sewer service at a time in the near future; and WHEREAS, the unintended affect of the designation is that in the interim period, new construction, building expansions, or remodeling which require Department of Health approval are being required to install expensive, engineered on-site wastewater systems; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS, MONROE COUNTY, FLORIDA THAT: Section 1. Resolutions 39-2002 and 40-2002 are hereby rescinded. Section 2. Conch Ke~ and Duck Key are hereby declared as "hotspots," intended to receive sewer service as identified in the Monroe County Sanitary Wastewater Master Plan. PASSED AND ADOPTED by the Board of County Commissioners, Monroe County, Florida at a regular meeting of said Board held on the 16th day of October. A.D., 2002.
