AGENDA ITEM WORDING: Approval to acquire sites for a wastewater treatment plant and
vacuum/pump station to serve the Bay Point and Saddlebunch communities,
ITEM BACKGROUND: Bluewater RV Ownership Park Property Owners Association, Inc. is
unwilling to sell any portion of Tract 0 to the County for a wastewater treatment plant site.
Staff is currently exploring the possibility of a joint venture with Bluewater and will report on
the status of this scenario at the BOCC meeting, However, it appears if the BOCC wishes to
acquire this site, it must do so via condemnation and should confirm this direction to staff.
In the event the BOCC wishes to pursue acquisition of an alternative site or sites, staff will be
prepared to discuss the feasibility of acquiring the properties in the original FKAA siting report
as well as one additional site in Bay Point subdivision and two additional sites in Saddlebunch
Shores subdivision, All of the potential sites are identified on the attached maps.
PREVIOUS RELEVANT BOCC ACTION: On July 17, 2002 the BOCC selected Tract D of
the Bluewater RV park as the preferred wastewater treatment plant site. On July 19, 2002
the BOCC adopted Resolution 308-2002 authorizing negotiations for the purchase of the site
and condemnation proceedings if necessary,

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA SELECTING A PREFERRED WASTEWATER IMPROVEMENT
PROJECT TREATMENT PLANT SITE TO SERVE BAVPOINT COMMUNITY, AND
REQUESTING THAT FKAA BEGIN WORK IMMEDIATELY TO FULFILL MONROE
COUNTY'S OBLIGATION TO FEMA FOR RECEIPT OF FEMA UNMET NEEDS
GRANT FUNDS FOR BAYPOINT
WHEREAS, FEMA Unmet Needs funds were awarded and are available to complete
wastewater Improvements to serve the Baypolnt community; and
WHEREAS, FKAA recommended a primary and a secondary treatment plant site to serve
Baypolnt; and
WHEREAS, County staff has conferred with FKAA staff on the selection of treatment plant
sites and concurs generally with FJ<AA's findings; and
WHEREAS, the FKAA's secondary site at the Saddlebunch RV Park is the preferred site,
because
. Land acquisition cost, based on the Monroe County Property Appraiser's assessed
valuation of $112,605, is substantially less than the other evaluated sites,

negotiations to purchase the prioritized site. In the event that no acceptable purchase price is
negotiated, the County Attorney is directed to take necessary steps to initiate condemnatIon
proceedings,
Section 2. The BOCC requests that the FKAA continue efforts to complete mutual
obligations with FEMA for receipt of FEMA Unmet Needs money,

whether my client has an interest in selling all or a portion of Tract D. I am authorized by
my client to confirm to you that it has no interest is selling any of Tract D. As I informed
you in our recent telephone conversations, Tract D is an integral part of the RV park, and
is used for storage of equipment, trailers and other items owned by the property owners.
It also serves as an important entrance feature to the RV park,
