ITEM BACKGROUND: The County completed a Boater's Guide for the Upper Keys a little over a year ago. Staff, working with the Florida Marine Research Institute (FMRI), planned to complete two additional Boater's Guides for the middle and lower Keys. Funds were set aside in the Fund 148 stabilization budget for this project. With pressing commitments relating to wastewater staff feels that it is best to fund this project from the Boating Improvement Fund instead at this time. The total project cost to FMRI is $9,100. Section 1. The Institute and the County, for the consideration named agree as follows: 1. The Institute agrees to produce the graphic design and layout work to produce Boater's Guides for two areas of the Florida Keys, the middle Keys (from roughly Lower Matecumbe to the West end of the 7-mile bridge) and the lower Keys (from the west end of the 7 mile bridge to an area to be defined west of Key West) A. The format for the Boater's Guides will be 22" X 34" open and will allow folding to 4 %2" by 9." The Boaters Guides will contain 4 process color and provide information on two sides (2 maps) 2. The Institute will provide the Boater's Guide design and layout work in a fashion and style consistent with the previous upper Keys Boater's Guide BoatGuideContr=0209 09/13/02 7:45 AM produced by the Institute for the County. The work performed will utilize Arc -Info or Arc GIS based map files. Roads, labeling, test placement, redraws, graphics, icon symbols, and tables will be provided as necessary and consistent with the previous Boater's Guide for the upper Keys. 3. The Institute agrees to complete all mapping work for each Boater's Guide, including modifying and updating all the existing information, creating all new GIS data layers, and making all paper draft maps. A. Base map layers will include at a minimum seagrass, mangroves, artificial reefs, aids to navigation, public boat ramps, sewage pump -out facilities, depth contours, major roads and aquatic preserves. The Guides should also include such basic map layer information as the location of other park or protected area boundaries, the location of state waters, and the boundary of the Florida Keys National Marine Sanctuary. 4. The County agrees to collect all necessary data relevant to the physical content of information to be provided on the Boater's Guides. The County agrees to work with other agencies as appropriate to obtain and quality check both the physical data obtained and the content and appearance of the layout as work progresses. Section 2. In consideration of the services described above, the Institute agrees to provide all final Design and Layout work in a digital file format appropriate BoatGu i deContract02O9 09/13/02 7:45 AM for printing and publication. This information can either be transferred directly to the printer publisher by the Institute at the County's request or to the County for the County's dissemination. Section 3. Upon completion of all work described above and provision of final products to the County, the County agrees to reimburse the Institute in the amount of $4,550.00 per Boater's Guide product. At the Institute's discretion, the Institute may invoice the County separately for each Boater's Guide or as a lump sum of $9,100.00. Section 4. The Institute warrants that it has not employed, retained, or otherwise had act on its behalf an former County officer or employee subject to the prohibition of Section 2 of Ordinance No. 010-1990 or any County officer or employee in violation of Section 3 of Ordinance No. 020-1990. For breach or violation of this provision, the County, in its discretion, may terminate this Contract without liability and may also, in its discretion, deduct from the Contract or purchase price, or otherwise recover the full amount of any fee, commission, percentage gift, or consideration paid to the former County officer or employee. Section 5. A person or affiliate who has been placed on the convicted vendor list following a conviction for public entity crime may not submit a bid on a contract to provide any goods or services to a public entity, may not submit a BoatGuideContract0209 09/13/02 7:45 AM bid on a contract with a public entity for the construction or repair of a public building or public work, may not perform work as a contractor, supplier, subcontractor, or consultant under contract with any public entity, and may not transact business with any public entity in excess of the threshold amount provided in Section 287.017 of the Florida Statutes, for the Category two for a period of 36 months from the date of being placed on the convicted vendor list. Section 6.
