ITEM BACKGROUND: On November 7, 1996 the Planning Commission approved an allocation award for the
applicant listed below provided the applicant's Affordable Housing Deed Restriction is approved by the BOCC.
George & Kathie Rockett III submitted the Restrictive Covenant to Monroe County. The applicant is receiving a
dwelling unit allocation award for the year ending July 13, 2002, have filed the document in accordance with
Ordinance No. 47-1999.
PREVIOUS RELEVANT BOARD ACTION: On November 11, 1999, the BOCC adopted Ordinance No. 047-
1999. On June 19, 2002 the Board of County Commissioners approved Resolution No. 263-2002 for a Beneficial
Use Determination Promulgated by the Special Master.

II. That under the provisions set forth in Chapter 9.5 of the Monroe
County Land Development Regulations "Fair Share Impact Fees" shall
be paid by any person, including any governmental agency, prior to
receiving a building permit for any new land development activity.
III. That under the affordable housing provisions set forth in Chapter
9.5 of said Land Development Regulations, the owner or owners of
the above -described real property have been exempted from payment
of their "Fair Share Impact Fees" for a {(check one)
single family, multi -family, mobile home} dwelling
to be constructed on said real property.
IV. That the sale, transfer, inheritance, assignment or rental of any
Affordable Housing Unit shall only be to persons who qualify under
.the County's current Affordable Housing eligibility requirements
as established and amended from time to time. All of the
restrictions herein, shall be binding upon any transferees,
lessees, heirs or assignees.
V. That the covenants shall be effective for twenty (20) years but
shall not commence running until a certificate of occupancy has
been issued by the building official for the dwelling unit to
which the covenant or covenants apply.
VI. That the applicant(s) used the affordable housing program to gain
additional points in the permit allocation system pursuant to the
Dwelling Unit Allocation Text Amendment, Ordinance 016-1992.
