This letter is to advise that A TC will file a forma! protest if there is a recommendation of the award of this project to another bidder. In the event that a county commission meeting is scheduled to award this bid, we request that the meeting be canceled or deferred until this matter is resolved. The first problem with this bid is that it is confusing and ambiguous as to the differentiation between the security and fire porticns of the bid. There wasno prebid to address any questions. Notwithstanding, there appears to be a major concern over the qualifications fo the entity that is presumed to be the low bidder. The low bid was submitted Quality Communications fo Florida, d/b/a Quality Communications Fire & Security, Inc. There is no fictitious name on record in Tallahassee and these are two separate and distinct entities. Quality Communications was incorporated in 1990 however, but Quality Communications Fire & security was not incorporated until February of this year. This raises several issues. First, we do not believe that the project and reference list as submitted is accurate, nor is the company qualified for this project. Finally, unless the bid bond specifically covers both entities, the bid bond as submitted is improper. As a result, this bidder should be disqualified. We understand the time frame that is of concern to Monroe County for the Airport project. However, based upon the irregularities in this bid, there is no doubt that a rebid is necessary. ATC has no objection to an expedited rebid procedure. In the event that the County decides to proceed with an award to the low bidder, we intend to file formal protest. We believe that it is in the County's best interest to do so and will be the most efficient and expeditious manner in which to :'"azc:ve this situat:on. In reference to the first item conCerning the bid, URS Corp., does not see where the confusion is. The bids A and B have specific items which we had asked for their unit prices, in the event that Monroe County decided to add or delete a specific item. However the contract documents requested for: Total of Bid "A" Total of Bid "B" Total of Bid "A" & "B" We had written the word total as a reminder for the contractor to include everything in these totals, which was also clarified by the note under the attached, Attachment "AN. We did not feel that a "pre-bid" was necessary, however we urge the contractors to submit Questions. and we will respond to all of them. In reference to the 2~ item, the apparent explanation for the contractor submitting the low bid as "Quality Communications of Florida. Inc." D/B/A "Quality Communications Fire & Security, Inc. was revealed thru thEr website that "Quality Communications of Florida. Inc." had filed on May 11, 1990 with John Hood 'listed as a officer/director, and had refiled with John Hood listed as a officer/director, as "Quality Communications Fire & Security, Inc." on Februal}' 25, 2002 with a new. ' corporation title, with this transaction not taking place officially until January 1, 2003. (See atttached) In reference to the 3'" item, as to the low bidder not being qualified, UAS Corporation did a reference check on (2) two projects that OuaJity Communications of Florida,. After explaining the nature of the call they informed me thaf.: Quality Communications, Fire & Safety, Inc., was the primary installer of internal, Wiring at 210 schools, involving voice & data (module systems), participating in ai $250,000,000 contract as a sub-contractorwith BellSouth. Mr, Pierce said thattheir performance was outstanding. (2) Contacted the project coordinator, Mr. Don Pait of the School Boird of Palm Beach County, he then in turn informed us that Quality Communications of Aorida, Inc., had installed for the last 7 years, fire alarm, intercom and data fibers, in 10-12 new schools. Mr. Pait rated Quality Communications of Rorida, Inc., as one of the top two (2) contractors for their performance, associated with the School Board. In summary, URS Corporation will submit a copy of this clarification along with your letter to Monroe County for there final review and determination.
