ITEM BACKGROUND: The Monroe County Sheriff's Office seeks to expand their substation located on Lot One (1), Block 23, Cudjoe Gardens, 8 Tb Addition. Lot 1 was gifted to Monroe County in 1984. The substation was built in 1988 on Lot One (1). The Future Land Use Map (FLUM) designation is Residential Medium (RM). During the past year, Monroe County adopted an ordinance that establishes overlay districts to permit future land use categories that have no corresponding land use designations. These categories include Agriculture (A), Education (E), Institutional (INS), Public Facilities (PF), and Public Buildings (PB). This ordinance became effective on October 19,2001. The Monroe County Sheriffs Department is seeking a change in the FLUM from Residential Medium (RM) to Public Facilities (PF). The adoption of the overlay ordinance allows the Sheriffs substation to expand with the density as detailed in the Monroe County Year 2010 Comprehensive Plan while still protecting the residential character of the neighborhood. In accordance with the overlay ordinance, the public will have the opportunity to provide comment prior to development approval. The ordinance permits the application of the overlay district in the Improved Subdivision district to the standards and procedures of a major conditional use. At the public meeting of the Monroe County Development Review Committee held on February 1,2002, the Committee voted to approve the application as presented. At the public meeting of the Monroe County Planning Commission held on March 13, 2002, there was discussion of including Lots 2 and 3 which abut Lot 1, however, due to deed restrictions on Lots 2 and 3, it was determined that while all 3 lots were gifted to the County, the deed restrictions on Lots 2 and 3 would prohibit their use as potential expansion parcels for the Sheriffs Substation. As a result, Lots 2 and 3 were excluded from the original proposal that was reviewed by the Development Review Committee. The fIrst public hearing, or "transmittal" hearing of the BOCC was held on April 17, 2002. The Planning Department transmitted the draft ordinance to the Department of Community Affairs (DCA) for its consideration. The DCA has reviewed the proposed amendments and on October 28, 2002, advised the BOCC that they had no objections to the proposed amendments as transmitted. Section 9.5-511 (d)(5) b. of the Monroe County Land Use Regulations allows the Board of County Commissioners to consider adopting an ordinance to enact map changes under six listed conditions. 2. This amendment, initiated by the applicant, is intended to amend the Future Land Use Map from Residential Medium (RM) to Public Facilities (PF). 3. There is a recognized need for the expansion of the existing Sheriff's Substation at this location on Cudjoe Key. WHEREAS, the Board of County Commissioners made the following Conclusions of Law: 1. ANALYSIS AND RATIONALE FOR CHANGE (Pursuant to Section 9.5-511(d)(5)(b) and Chapter 163. Florida Statutes): The Monroe County Code identifies six (6) conditions, which must be met in order for the Board of County Commissioners to approve a change to the existing land use designations. Page 2 of6 W:\Planning\Working Folders\Gross-Fred\Sheriffs Substation\BOCC Staff Report .doc Changed Projections: Currently, the Monroe County Sheriffs Department operates a sheriffs substation including Emergency Management Services (EMS) on Lot One (1) in Cudjoe Gardens. The equipment housed at this facility includes emergency response vehicles such as an ambulance, a fire truck and sheriffs patrol cars. The building is also used as a polling station for federal, state, and local elections. The building was constructed in 1988. It contains a series of offices, a day room for police officers, a bathroom and a multi-purpose room. In 1988, the Monroe County Planning Commission had approved a Major Conditional Use for construction of the building. The Monroe County Planning Director had issued Development Order #20-88. The building was limited in size to 2,500 square feet due to the Monroe County Code Section 9.5-242. This regulation limits office and low intensity commercial and retail uses to less than 2,500 square feet in the Improved Subdivision land use district. At the time of construction, this was an acceptable limitation. The primary use has not changed since the original Certificate of Occupancy. However, since that time, the public safety needs have required the substation to provide space for the emergency medical services personnel including ambulances and fire trucks required for accident response. The functional population in this Planning District has grown significantly. According to the 2001 Monroe County Planning Department and approved by the Board of County Commissioners, there have been 1,320 permits issued for new residential dwelling units in the Lower Keys from 1990 to 2000. As a result, the demand in this area for Sheriff and EMS services has increased significantly. Changed Assumptions: On August 19, 1997 the Board of County Commissioners approved the conceptual plan for the consolidated Monroe County Emergency Services System (MCESS). This addressed the planning for the future provision of emergency services in Monroe County. It was prepared by the staff of the Monroe County Department of Public Safety in conjunction with the Emergency Medical Services (EMS) Department, the Rescue Department, and the Fire Marshal's Office. The goal of this effort was to design an effective emergency service system. The premise that this group agreed to was "that for an emergency service to be effective, it had to be capable, above all other things, of rapidly responding to an incident." At the time, the inability of the volunteer organizations to assure a consistent rapid response was based upon a number of issues including the County's population growth, its economy and industry, changing demographics and the evolution of the fire rescue services. The MCESS proposes a phased implementation process. The Department intends to add additional paid personnel to work in conjunction with the volunteers. These personnel will be distributed throughout unincorporated Monroe County with the need for three additional paid employees (as required for 24 hour service) to be stationed at the Cudjoe Substation. Additionally, the plan proposes to reassign equipment from the Sugarloaf Station to Cudjoe in order to improve the response time for emergency events on Cudjoe, Summerland and the western portions of Ramrod Keys. The intention is for the Cudjoe substation to function as a substation of the existing Sugarloaf Key Station, thereby increasing response times to an acceptable level. An expansion of the existing Cudjoe Substation is required to accommodate these additional needs. Page 3 of6 W:\Planning\Working Folders\Gross-Fred\Sheriffs Substation\BOCC Staff Report .doc Data Errors: When the 2010 Comprehensive Plan and Future Land Use Maps (FLUM) were adopted, The parcels with existing Uses in the categories Agriculture, Education, Institutional, Public Facilities, and Public Buildings were appropriately designated in the FLUM. Monroe County documented the public facilities existing in the late 1980's. Final adoption of the Future Land Use Maps occurred on January 1. 1997; however, these maps had not been updated for several years while they were in the review process with the State of Florida and the Department of Community Affairs. Although the Cudjoe Substation was in existence at that time and should have been included in the documentation, it was inadvertently omitted from the finally adopted maps. The omission of the Sheriffs Substation from the FLUM designation rendered the Substation a non-conforming use. New Issues: See Assumptions above Need for Additional Detail and Comprehensiveness: The Sheriffs Substation was constructed in 1988. The Monroe County Year 2010 Comprehensive Plan became effective on January 5, 1996. The Future Land Use designation of Residential Medium was appropriate and consistent with the existing land use category of Improved Subdivision. This proposed change to the FLUM, in conjunction with the Public Facility overlay ordinance protect the residential nature of the area while allowing the substation to become a conforming use and to expand and provide better services to the community. Data Updates: N/A IMPACT & POLICY ANALYSIS: Comparison of Development Potential for the Current and Proposed Land Uses: 1) Current FLUM and Land Use District Designations The current Future Land Use Map (FLUM) designation for the subject property is Residential Medium (RM). The current Land Use District is Improved Subdivision (IS). Public Facilities are not a permitted use. Maintaining the existing zoning would render the Sheriffs Substation (Lot 1) a pre-existing non-conforming use, which would be unable to expand. Additionally, maintaining the existing FLUM would violate the intent of the use for which the land was gifted to Monroe County. 2) Potential Land Uses With the Proposed Future Land Use Map (FLUM) The proposed Future Land Use designation is Public Facilities (PF). Given this proposed change, the existing Sheriffs Substation would become a permitted use. In accordance with Page 4 of6 W :\Planning\ Working Folders\Gross-Fred\Sherifl's Substation\BOCC Staff Report .doc Sec. 9.5-257.4 (Public Facilities Use Overlay) of the Monroe County Land Development Regulations, the Substation could utilize lots 2 and 3 and may be developed as a Public Facility with a maximum floor area ratio of .30. All other regulations of the underlying district (IS) would be applicable. Compatibility with Adjacent Land Uses and Effects on Community Character: The proposed amendment to the Future Land Use Map would have little or no effect on the community character. To the north of the lot is U.S. 1. On the South oflot 1, separated by a canal are the homes of the Cudjoe Gardens subdivision. Effects on Natural Resources: There should be no effect on natural resources. Effects on Public Facilities: The proposed amendment will improve the delivery of public services to the community. Solid Waste Facilities: The proposed amendment will have little or no effect on solid waste facilities. Potable Water Facilities: The proposed amendment will have little or no effect on potable water facilities. Storm Water: Sealed engineering drawings for stormwater management must be submitted and approved by the County Engineer before receipt of a building permit. Wastewater: A new wastewater treatment system approved by the Department of Health may be required prior to receiving a building permit. WHEREAS, Section 9.5-511 (d)(5) b. of the Monroe County Land Use Regulations allows the Board of County Commissioners to consider adopting an ordinance to enact map changes under six listed conditions; and WHEREAS, This amendment, initiated by the applicant, is intended to amend the Future Land Use Map from Residential Medium (RM) to Public Facilities (PF); and WHEREAS, There is a recognized need for the expansion of the existing Sheriffs Substation at this location on Cudjoe Key; and WHEREAS, The amendment meets the criteria outlined in Section 9.5- 511 (d)(4) b. of the Monroe County Land Development Regulations; and WHEREAS, The amendment permits the use of Section 9.5-257.4 (Public Facilities Overlay) and is appropriate for this location on Cudjoe Key; and WHEREAS, The amendment will facilitate the needed expansion of the existing Sheriffs Substation at this location; NOW THEREFORE, BE IT RESOLVED BY THE DEVELOPMENT REVIEW COMMITTEE OF MONROE COUNTY, FLORIDA, that the preceding findings of fact support their decision to recommend APPROVAL to the Monroe County Planning Commission of the proposed amendment to the Future Land Use Map of the Monroe County Year 2010 Comprehensive Plan: Page 1 of 2 W:\Planning\Working Folders\Gross-Fred\Sheriffs Substation\DRC Reso.doc Initial_ PASSED AND ADOPTED By the Development Review Committee of Monroe County, Florida at a regular meeting held on the 19th day of February 2002.
