HEND ICK DOCUMENTAnON: Included 0 To Follow 0 Not Required 0 AGENDA ITEM # c.f7' / Board of County Commissioners ORDINANCE NO. - 2002 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, DECLARING THAT AN EMERGENCY EXISTS AND WAIVING NOTICE BY A FOUR-FIFTHS VOTE; AMENDING SECTION 2 OF ORDINANCE NO. 022-2002 IN ORDER TO PROVIDE THAT A SURCHARGE OF $9 SHALL BE IMPOSED ON PARKING TICKETS TO FUND SCHOOL CROSSING GUARDS; PROVIDING THAT THE SURCHARGE IS EFFECTIVE IN THE UNINCORPORATED AREAS OF MONROE COUNTY; PROVIDING FOR SEVERABIUTY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE OF ORDINANCES: AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the current funding system for school crossing guards expires on December 31, 2002; WHEREAS, the new system contemplates the use of a $9 parking ticket surcharge for funding school crossing guards; and WHEREAS, time is of the essence in establishing the $9 parking ticket surcharge; now, therefore BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. An emergency is hereby declared and notice waived by a four-fIfth's vote. Section 2. Section 2 of Ordinance No. 022-2002 is hereby amended to read as follows: Section 2. A surcharge of 12 is hereby imposed on each parking fine collected in the county. This surcharge is effective in the unincorporated areas of Monroe County. Section 3. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 4. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. Section 5. The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 6. This ordinance shall take effect when a certified copy of this ordinance has been accepted by the postal authorities of the United States for special delivery by registered mail to the Secretary of State of the State of Florida in accordance with the provisions of Florida Statute 125.66(3).
