TOTAL COST: BUDGETED: Yes 0 No 0 APPROVED BY: County Attorney _ OMB/Purchasing 0 Risk Management 0 DIVISION DIRECTORAPPROVAL~ ~~ ES"t H ND ICK DOCUMENTATION: Included 0 To Follow 0 Not Required 0 AGENDA ITEM # ~ 0/ --" ~ - A RESOLUnON DISCLAIMING ANY INTEREST OF MONROE COUNTY IN A TRACT OF LAND EAST OF BLOCK 51, SANDS SUBDIVISION, BIG PINE KEY, MONROE COUNTY, FLORIDA WHEREAS, Stephen Spellman and Lynda Schwartz Spellman ("Spellmans",herein) are the record owners of a parcel of land located Easterly of Block 51, Sands Subdivision, Big Pine Key, the dimensions of which are 100' by 100', depicted as "Upland Parcel" on a boundary survey certified to Monroe County by R. E. Reece, P.A., dated 11/18/02, a copy of which is attached hereto; and WHEREAS, access to the Upland Parcel is provided via an unimproved road approximately 22' wide, the Easterly terminus of which abuts the Upland Parcel; and WHEREAS, the unimproved road extends apprOXimately 525' Easterly from the terminus of Avenue J as platted on November 25, 1925 at Plat Book 1, Page 65, Public Records of Monroe County; and WHEREAS, Monroe County asserts no claim to nor dominion over the portion of the unimproved road adjacent to the Upland Parcel, because Monroe County has acquired no interest therein by reason of dedication or maintenance; and WHEREAS, Spell mans obtained from the State of Florida, on July 20, 2000, a Certificate Documenting Waterward Boundary Line as of July 1, 1975, which Certificate was recorded in Official Records Book 1646 at page 1098, Official Records of Monroe County, Florida ("Certificate"); and WHEREAS, Florida Statute 253.12(9) provides that filled land upland of the boundary described in the Certificate "shall be considered private property, and the state, its political subdivisions, agencies, and all person claiming by, through, or under any of them, shall be barred from asserting that any such lands are publicly owned sovereignty lands."; and WHEREAS, Spell mans have requested that Monroe County confirm by this disclaimer any interest in the portion of the unimproved road adjacent to the Upland Parcel, for title insurance purposes; now, therefore, BE IT RESOLVED THAT THE BOARD OF COUNTY COMMISSIONERS of Monroe County hereby disclaims any interest in or claim to the portion of the unimproved road adjacent to the above- referenced Upland Parcel owned by Spell mans. The parcel hereby disclaimed is described as a strip - of filled land approximately 22 feet in width and 104.60 feet in length, the waterward boundary of which is as stated on the Certificate, said parcel being more particularly described as: COMMENCE as the Southwest corner of Block 51, SANDS SUBDIVISION according to the Plat thereof as recorded in Plat Book 1, Page 65 of the Public Records of Monroe County, Florida; thence North 200 feet; thence East 525 feet; thence North 22 feet to the Point of Beginning; thence East 104.6 feet; thence South 22.0 feet; thence West 104.60 feet; thence North 22 feet back to the Point of Beginning. PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida, at a regular meeting of said Board held on the 18th day of December, 2002.
