Spehar AGENDA ITEM WORDING: Presentation and possible action regarding ability to trade ROGO lots dedicated to the county for environmental preservation in a specific location for other environmentally sensitive lots ITEM BACKGROUND: In our attempts to work with the property owners that wish to improve their homes and have ROGO lots next to their property, the conservation and financial benefits to the County are substantial. One lot will continue to be undeveloped pursuant to a conservation easement, and another lot that the County would not otherwise bave an opportunity to obtain will be dedicated to the County for conservation, so that it will remain undeveloped in perpetuity. Request to Trade Dedicated ROGO Lots Mr. Frank Greenman, on behalf of his client Jo1m Moyant, will address the Board under Item PA of the Commission's February 19, 2003, meetmg agenda. He is requesting that the County favorably consider the proposal of his client to trade a lot dedicated to the County under ROGO with another lot of at least equal environmental value. This memo is to provide the Board of County Commissioners with background information on the policy issues related to this request. Land may be dedicated to the County to obtain positive points in ROGO. Policy 101.5.4.5 and Policy 101.5.5.4 in the 2010 Comprehensive Plan states: Land Dedication - Points shall be assigned to Allocation Applications for proposed dwelling units which include a voluntary dedication to Monroe County of vacant, buildable land within areas proposed for acquisition by governmental agencies for purposes of conservation or resource protection. Every lot that the County accepts by walTanty deed for dedication is reviewed and must be found to meet the criteria detailed in both the Comprehensive Plan and the Land Development Regulations. Each lot is important as part of the whole conservation and acquisition strategy for an area and it is accepted by the County tor dedication to achieve that purpose. To permit a trade, purchase or exchange of a lot that has been dedicated to achieve points for a ROGO allocation would undermine the integrity of the governmental acquisition programs and the public trust in the intention of the County to protect the resource. This is especially important on Big Pine Key where the habitat needs of the Key Deer and the amount and location of potcntial future development and preservation lands have been carefully explored and considered in the Habitat Conservation Plan. Feb 14 03 03:51p Growth Mgt (305)289-2854 p.3 The Board of County Conunissioners does have the authority under Section 125.37, Florida Statutes, following proper notice, to exchange propelties without going through the bid process, provided the first property is no longe1' needed. ROGO dedicated lots have been identified as needed for conservation and resource protection, acquisition of the second lot through a trade does not negate the County's need for the first lot. Therefore, the Growth Management Division staff, with the concurrence of the Land Authority'~ Executive Director, recommends against allowing ROGO lots dedicated to the County for environmental preservation in a specific location to be traded for other environmentally sensitive lots in another location. The staff can find no tangible benefit to the public in this concept that would only serve to establish a bad precedent for approving other such land swaps, which may have even less merit. cc: Danny Kolhage, County Clerk James L.
