ITEM BACKGROUND: While expenses have risen over the past 12 years, permitting fees have
remained the same since the adoption of the present fee schedule in 1990. The permitting software
system has been converted and is still being upgraded and will be soon connect to the Internet for
greater customer satisfaction. Resolution 165-2000 is no longer needed as state statutes (553.791)have
addressed that procedure.
PREVIOUS REVELANT BOCC ACTION: Resolution 214-2002 To establish an inspection fee
concerning participation by Monroe County and the Federal Emergency Management Agency in an
inspection procedure.

Background on Permit and Application Fee Increases
Proposal
The Growth Management Division is proposing to increase building permit fees across-the-board
from 20 to 50 percent with the minimum permit fee increasing from $35 to $50 and the
establishment of plan review fees for compliance with the County's Land Development
Regulations. The proposed fee schedule is presented in the attached draft resolution for
consideration by the Board of County Commissioners.
Permitting Fee Philosophy
The Growth Management Division's philosophy toward the setting of permit fees is that users (i.e.,
permit applicants) should pay a majority share of the costs for processing and administering the
permit as they directly benefit from receiving such permits. It is not the philosophy of the Division
that these users should bear the full share of the cost of services, as under "cost recovery" fee
systems. The rationale being that State and local codes require permits for building improvements
and the public and other property owners do accrue direct and indirect benefits from a building
permitting system.
Basis for the Proposed Fee Increases
The current permit fee schedule was approved by resolution of the Board of County
Commissioners in 1990. The fee schedule was based on the estimated costs to administer, process,
review, approve, and conduct inspections for the average permit in each building permit category.
Since the initial fee schedule was approved, the Consumer Price Index has increased by over 40
percent and the "loaded" average hourly rate of the permitting staff has increased by 65 percent.
In addition, the initial fee schedule failed to account for reviews conducted by planners, biologists,
flood plain administrators and county engineers to ensure compliance with Land Development
Regulations (LDR) or review by fire marshal to ensure compliance with life and safety codes.
Although the costs for such LDR compliance review is typically covered by the application fees
for conditional use approvals, it is not adequately covered by the fees for "as of right" permits.
Significant New Elements of Proposed Permit Fee Schedule
Significant new elements of the proposed fee schedule are the inclusion of new permit and permit
application fees for the following:
o LDR and Non-building code site and plans review fees: These eight new
complianQe review fees are itemized in paragraph (I) of the proposed resolution.
o ROGO/NROGO and privatized plans compliance review application fees: An up-
front application fees as itemized in paragraph (J) will be assessed for any
ROGOINROGO projects, except those authorized under a conditional use approval
or plans submitted under Chapter 553, F.S. (privatized plan review), will be
required to file an application for compliance review with non-building technical
codes and LDRs prior to processing of the building permit application. If the
application is approved, this fee will be deducted from other permit fees that may be
due.
o Renewal of expired permits: An renewal fee will be assessed for reinstating an
expired permit for a new dwelling as provided for in sub-paragraph (K.8). The
Building Code (Chapter 6.0) still needs to be revised to set policy standards for
renewal of such permits.
Comparison with Other Jurisdictions
For comparison purposes, the proposed permit fee schedule is shown in the attached exhibit with
those for the City of Marathon and Village of Islamorada. As can be seen, the County's proposed
fee schedule 'compares favorably with these two communities.
Coordination with Contractors and Development Community
The Growth Management Division presented the proposed fee schedule at a specially scheduled
public workshop on November 12, 2002. In addition, Growth Management Division staff
presented the proposed fee schedule at the December 2002 and January 2003 monthly meetings of
the Florida Keys Contractors Association.
In general, participants at these meetings were very supportive of these fee changes recognizing
that the County has held permitting fees constant for over a decade. Furthermore, many
contractors in attendance voiced the opinion that the proposed fees were very reasonable compared
to fees charged by other communities.
Recommendation
The Growth Management Division recommends approval of the resolution which revises the
County's permitting fee schedule.

WHEREAS, the Monroe County Board of County Commissioners wish to provide the citizens of the
County with the best possible service in the most cost effective and reasonable manner; and
WHEREAS, we find that it would be in the best interests ofthe general public to charge the true cost for
such services, thereby placing the burden of such costs directly upon those persons deriving the benefit;
and
WHEREAS, the Director of Growth Management has demonstrated that the existing fee schedule does
not reflect the true cost of providing the services to the persons requesting the Building Department
services; and
WHEREAS, after hearing testimony and evidence presented as to the appropriate fee schedule; and
WHEREAS, the provisions of the engineer conducted inspection program are no longer applicable; and
WHEREAS, we concur with the conclusions and findings of the Growth Management Director and adopt
them as our own; NOW THEREFORE,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
