L S DOCUMENTATION: Included 0 To Follow 0 Not Required 0 AGENDA ITEM # ~u RESOLUTION NO. 03-105 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF KEY WEST, FLORIDA, APPROVING AN INTERLOCAL AGREEMENT BETWEEN THE CITY AND MONROE COUNTY PERTAINING TO THE JOINT EMPLOYMENT OF THE CODE ENFORCEMENT SPECIAL MASTER; PROVIDING FOR AN EFFECTIVE DATE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF KEY WEST, FLORIDA, AS FOLLOWS: Section 1: That the attached Interlocal Agreement between the City and Monroe County is hereby approved. Section 2: That this Resolution shall go into effect immediately upon its passage and adoption and authentication by the signature of the presiding officer and the Clerk of the Commission. INTERLOCALAGREEMENT This Interlocal Agreement is entered into by and between the City of Key West (hereinafter the "City"), and the Monroe County Board of County Commissioners (hereinafter "County") on this day of / 2003. WHEREAS, the parties may enter into an Interlocal Agreement pursuant to section 163.01/ Florida Statutes; and WHEREAS, the City employs a special master pursuant to section 162.03/ Florida Statutes, whom the County desires to engage for code enforcement hearings; and WHEREAS, the use of one special master by both City and County will promote the efficiency and economy of services to both parties; and WHEREAS, Attorney General Opinion 2000-34 authorizes an Interlocal Agreement for joint use of a code enforcement special master; and WHEREAS, the parties desire to enter into an Interlocal Agreement in order to establish the terms and conditions of the provision of services by the City to the County of the joint special master. NOW, THEREFORE, the parties to this Interlocal Agreement agree as follows: 1. The City has engaged the services of a special master for code enforcement. The City agrees to provide to the County the services of the special master according to a schedule to be agreed upon by the City Manager and County Administrator, 2, Monroe County shall provide a suitable public place for the hearing of code enforcement matters by the special master, 3. The parties agree that all fines imposed by the special master for infractions of the Monroe County Code shall belong to the County, 4. The parties agree that the County may negotiate a fee to be paid to the special master for County code enforcement hearings. The County shall enter into a fee agreement with the special master for such services. 5. The County shall remit the special master fee directly to the special master as provided for in the fee agreement between the County and the special master. 6. Either party may cancel this agreement upon thirty (30) days written notice to the other. 7. This agreement shall terminate on September 3D, 2004, unless renewed by the parties. 8. This Interlocal Agreement shall become effective upon its recording with the Clerk of the Circuit Court in the Sixteenth Judicial Circuit.
