ITEM BACKGROUND: MCFR is requesting BOCC approval for advertisement of a Public Hearing to amend Section 11-175 of the Monroe County Code to clarify inconsistent language; specifically exempting the requirement for a Public Hearing or notice to current certificate holders in the event of a renewal application for a Class A or Class B COPCN certificate. Further, the proposed amendment to Section 11-175 seeks to increase the application fee for Class A and Class B COPCN renewals from $25.00 to $475.00. MCFR researched various COPCN application fee structures and conducted an informal Tri-County survey which included Miami Dade, Broward and Palm Beach County. The increased fee being proposed for new and renewal COPCN applications was based upon an average of the COPCN application fees charged by these counties. P r- 0 (c) The board upon the recommendation of the administrator without public LO hearings or notice to certificate holders may approve renewal certificates. However, any actions to change zones, modify, suspend,revoke or otherwise change a certificate shall be handled as a new certificate of public convenience and necessity. 0 (d) Recommendations from municipalities within the certificate holder's assigned zone will be considered. E (e) Each application for renewal of certificate shall be accompanied by a$25.00 $475.00 renewal fee. SECTION 2: SEVERABIL,ITY. If any portion of this ordinance is for any reason held invalid or declared to be unconstitutional, inoperative or void, such holding shall not affect the remaining portions of this ordinance. If this ordinance or any provision thereof shall be held to be inapplicable to any person,property or circumstances, such holding shall not affect its applicability to any other person, property or circumstances. The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code.
