Approval of an interlocal agreement with Key Colony Beach for repairs to the Sadowski
Causeway Bridge and the subsequent transfer of the Causeway and Bridge to Key
Colony Beach for all future maintenance.
ITEM BACKGROUND
The agreement represents a final resolution of the issue of which local government
Monroe County or Key Colony Beach has responsibility for the Bridge and Causeway
maintenance.

INTERLOCAL AGREEMENT
THIS AGREEMENT entered into this
day of
, 2003, by and
between the City of Key Colony Beach (City), a Florida Municipality and Monroe County, Florida
(County ).
WHEREAS, the County has received from the State of Florida, an easement for the bridge
and causeway, which connect US Highway One and the City (Sadowski Causeway and Bridge);
WHEREAS, the bridge is in poor condition and in need of repair;
WHEREAS, there is ambiguity and disagreements between the City and the County
concerning ownership of the bridge and responsibility for repairs; and
WHEREAS, the parties have negotiated an amicable resolution of all matters pertaining to
the bridge; now, therefore
1. County shall provide in-house engineering services to the City in regard to repairing
the Sadowski Causeway Bridge. The City and the County shall divide equally any outside
engineering costs for services that cannot be provided by the County's staff.
2. Once the expense for the necessary repairs has been determined and the project
has been engineered, the parties shall share the costs of repair 50% to be paid by the City and
50% to be paid by the County.
3. Upon the completion of repairs, the County shall assign to the City, the easement
from the State of Florida for the bridge and causeway. Alternatively the County may obtain a quit
claim deed to the bridge and causeway from the State and then in turn, quit claim the bridge and
causeway to the City. The City agrees to accept either the easement assignment or quit claim deed
from the County.
4. The County agrees that the present interlocal agreement between the County and
the City shall be amended to provide that future road impact fees shall be paid 100% to the City.
5. The City shall take all future responsibility for maintenance and repairs of the
bridge.
