AGENDA ITEM WORDING: Approval to waive purchasing policies and procedures and issue a
purchase order in the amount of $30,000 to perform environmental services associated with the closure
of the wastewater treatment plant at the Monroe County Detention Center on Stock Island.
ITEM BACKGROUND: After hooking up to K.W. Resort Utility's Wastewater System, Monroe
County is required to close and clean the old wastewater plant at the Stock Island Detention Facility.
The tanks need to be pumped and cleaned to meet FDEP requirements. The FDEP has advised us that
we need to have this work completed or be fined.
PREVIOUS RELEVANT BOCC ACTION: The BOCC approved the connecting to the K.W. Resort
Utility System which necessitated this action.
CONTRACT/AGREEMENT CHANGES: None.
STAFF RECOMMENDATIONS: Approval as stated above.

Dear Mr. Coppel:
Sweetwater TInvironmental, Inc. will furnish all labor and equipment to pump and
dispose of, at a DEP approved site, approximately 150,000 gallons of water from
tanks at Monroe County Detention Center on Stock Island for a price of $.18 per
gallon.
Sweetwater Environmental, Inc. will remove all rags, grit and debri from tanks for a
price of S 90.00 per hour plus the tipping fee.
Sweetwater Environmental, Inc. will furnish material and labor to clean and
disinfect walls and floors of tanks and plug discharge pipe from relL~ tank for a price
of $ 1200.00.

I reviewed the proposal from Sweetwater Environmental, Inc. to pump and dispose of 150,000 gallons of water,
clean and disinfect tanks, etc, The unit cost seems to be appropriate for the service though I think the volume /
quantity should be field verified.
I briefly discussed this with Dent and recommend a budget of $30,000.00 to accommodate this activity for the
Agenda Item.
What are the plans to keep rain water out of the cleaned tanks? We might be able to fabricate some type of
covers, at least until the system is dismantled and removed from the site, Let me know if you need some
additional assistance with this issue.

We were hoping to have the work complete long before now, however, we are having a terrible time getting
Contractors to supply us with prices. Ed Castle from Weiler Engineering has been assisting us and will be
pursuing some other avenues to help us get contractor quotes. Also, I was out for about one month due to an
unexpected ailment. Thank you for being so patient. We will do our best to get this work complete and the site
brought into compliance, hopefully within two months. Please call me anytime at 292-4426 if you have any

Dear Mr. Pierce:
The purpose of this letter is to advise you of possible violations of law for which you may be
responsible, and to seek your cooperation in resolving the matter. A field inspection of the above
referenced facility on May 14, 2002, and a review of Department files indicate that violations of Florida
Statutes and Rules may exist. During the referenced inspection and file review, Department of
Environmental Protection personnel noted the following:
The facility was inactivated March 7, 2002; however, abandonment procedures as outlined inthe
November 29, 2001, December 17,2001, and January 23, 2002 letters from Weiler Engineering
Corporation had not been completed as described below:
1. The aeration tanks contained mixed liquor suspended solids (MLSS). A blower was in service,
providing aeration to the MLSS.
2. The surge, clarifier, chlorine contact, filter.dosing well and filter tanks had been pumped down
but not cleaned and disinfected.
3. It appeared that the effluent pipe connection to the reclaimed water storage tank had been
removed. However, the abandonment plan indicated that a plug would be installed at the end of
the chlorine contact chambers upstream of the Hayward valve. This plug was not observed.
4. The Class V injection wells had not been plugged and abandoned. The facility file revealed well
abandonment permits, numbers 63212-005-UA and 63223-006-UA, issued on February 19,2002.

5. A Department letter dated June 5, 2002 notified you of the above findings and requested a
written explanation as to why abandonment of the facility and the Class V injection wells had not
been completed. To date a response to the letter has not been received by the Department.
Pursuant to Florida Administrative Code (F.A.C.) Rule 62-620.610(15) and General Condition 15
of the facility permit, the permittee shall give the Department written notice at least 60 days before
inactivation or abandonment of a wastewater facility or activity and shall specify what steps will be
taken to safeguard public health and safety during and following inactivation or abandonment.
Pursuant to F.A.C. Rule 62-600.400(2)(a) and Section Vill.3. of the facility permit, the permittee
shall take corrective action in the event the treatment facilities or equipment no longer function as
intended, or are no longer safe in terms of public health and safety. Pursuant to F.A.C. Rule 62-
528.625 (1), a Class V injection shall be plugged and abandoned when it no longer performs the
intended purpose.
The activities observed during the Department's field inspection and any other activities at your
facility that may be contributing to violations of the above-described statutes or rules should be ceased.
Continued activities at the facility in violation of state statutes or rules may result in liability for
damages and restoration, and the judicial imposition of civil penalties up to $10,000 per violation per
day, pursuant to Sections 403.141 and 403.161, F.S.
You are requested to contact Nancy Brooking or Barbara Feakes at (305) 289-2310 within
fifteen (15) days of receipt of this Warning Letter to arrange a meeting to discuss this matter. The
Department is interested in reviewing any facts you may have that will assist in determining whether any
violations have occurred. You may bring anyone with you to the meeting that you feel could help resolve
this matter.
Please be advised that this Warning Letter is part of an agency investigation, preliminary to agency
action in accordance with Section 120.57(5), Florida Statutes. We look forward to your cooperation in
completing the investigation and resolution of this matter.
