ITEM BACKGROUND: The County had a code enforcement lien arising from an illegal sign that was running against Richard Osborne's property on Stock Island. On the date the illegal sign was removed, the total accrued fine was $25,900.00. Osborne has offered $5,240.00 to settle the lien. He contends that the lien should have been eliminated when he settled his taking's litigation against the County. However, he has offered to pay the daily fine that accrued during the approximate 9 months that transpired between the taking's settlement and the date the sign was removed. The taking litigation was a ROGO dispute which did not involve the sign. PREVIOUS RELEVANT BOCC ACTION: The Board agreed to amend the settlement agreement with the property owner so he could sell the lot to the Keys Federal Credit Union for the purpose of building a branch on it. At the time of the agreement, the Board agreed with the property owner to escrow $25,900.00 so that the sale could go forward and resolve the amount owed at a later date. CONTRACT/AGREEMENT CHANGES: STAFF RECOMMENDATIONS: Reject settlement offer. The County Attorney is obligated to present formal settlement offers to the Board however staff recommends rejection of the offer and authority to seek the entire $25,900.00.
