AGENDA ITEM WORDING:
A "quick" presentation by Dr. Duncan Mathewson on a technical issue, put in place
through a now outdated MOU (memorandum of understanding) between DCA, USFa.W
and Monroe County.
ITEM BACKGROUND:
Mr. Mathewson has met with USF8lW and DCA to request the rescinding of this in place
MOU- they have agreed - we, too, should consider the request.

Dear superintendent Lannon:
In 1994 the Department of Community Affairs and the Monroe County School Board
entered into the attached agreement related to the Big pine Key Scbool. We recently were made
aware of. request from the scbool to amend the agreement. Before we would consider any
changes to the agreement we asked the school to request tccbnicalassistance coordination from the
U.S. Fisb and Wildlife Service related to potential impacts as the endangered Key Deer. We have
recently received corresponden<:e from the Service (please see the attached letter from the U.S.
Fisb and Wildlife Service) staling that the requested changes will nol increase the risk to any
threatened or endangered species or habitat.
We are noW asking for your assistance to expeditiously review and potentially amend our
1994 agreement. I would like to schedule a telephone conference with you as soon as possible to
discuss this issue. Please let me know if and when we can set up such a conference with you and
other appropriate staff of the School Board.

Subj: DCA Waiver of 1994 MOU with MCSB Concerning the Big Pine
School

Phil Frank of US Fish and Wildlife fully supports a DCA waiver of the
1994 MOU with MCSB concerning the Big Pine School. Ths waiver is
necessary to allow for Big Pine Neighborhood Charter School (BPNCS) to
add third grade and expand its 2003-04 enrollment as a school-of-choice
without geographical restrictions prohibiting working families living off
Big Pine from sending their kids to the school.
George Neugent has had confirmation from Marlene Conaway and Tim
McGarry that the maximum enrollment level contracted with the school
district for 70 kids for the 2003-04 and 90 kids for the 2004-05 would not
have any adverse impact on the HCP model. BPNCS is willing to lower
the maximum student school enrollment from 200 to 130 as part of the
waiver that will allow the school to naturally grow without having to wait
for the formal passing of the HCP and the FOOT final budget agreements.
BPNCS has only 7 Pre K - 3 classrooms and intends to limit class size to
18 in support of Amplldment 9 concerning class size caps. As we have
only a limited number of classrooms and no plans to build more, BPNCS
will always be a small neighborhood school having no more than 126
students including a Pre-K class. This is well under the 134 enrolled in K-
2 at the school in 1994-95 and the 110 in 1998 just prior to Hurricane
~~o~~~d to get this DCA waiver issue passe~ ASAP. to ~low Lower Keys
parents this expanded opportunity for enrolhng thelr klds for the next
school year starting August 11.

neighborhood school.
