Item C25 BOARD OF COUNTY COMMISSIONERS AGENDA ITEM SUMMARY Meeting Date: July 15. 2003 Division: Public Works Bulk Item: Yes -X-No Department: Engineering/Construction Management AGENDA ITEM WORDING: Approval to rescind contract with Reery International, Inc., and authorization to reject all Requests for Proposals (RFP's) received for the Plantation Key Courthouse Renovation/Addition and re-advertise, ITEM BACKGROUND: Reery International, Inc,has indicated that they will not sign the contract unless significant changes are made to the document. We, in conjunction with the County Attorney, have reviewed the requested changes and do not feel that it is in Monroe County's best interest to modify the contract. PREVIOUS REVELANT BOCC ACTION: On May 21, 2003, BOCC awarded contract to Reery International, Inc. for the planning design, contract documents, project administration and coordination for the Plantation Key Courthouse Renovation/Addition project. In February, 2003 a request for Professional Services for Plantation Key Courthouse Renovation was advertised. On March 18, 2003, seven (7) responses were received in Purchasing. The tabulations of the scoring committee resulted in the following rankings, 1 sl Reery International, Inc.; 2nd Bender & Associates; 3rd The Russell Partnership, Inc,; 4th Corzzo, Castella, Carballo, Thompson, Salman; 5th R.J, Reisenbottle Architects, P,A.; 6th Reliable Group, LLC; 7th Nancy Perez Miller, Architect. On 4/29/03, a Public Meeting for the selection committee to discuss ranking of the RFP's was held. Recommendation was made by the committee to award to Reery International. On 12/18/02 BOCC approved infrastructure monies for the Capital Improvements with bond monies. CONTRACT/AGREEMENT CHANGES: None STAFF RECOMMENDATIONS: Approval as stated above. As I said, Heery Intemational does want to work with Monroe County on the above referenced projects. We believe we can offer Monroe County a level of service and team approach that will make this project a success. However after award we were presented with a non-industry standard contract that imposes an unusually high level of responsibility upon the designer. In our previous letter Heery outlined several minimal changes we thought should be incorporated into the contract to make it more consistent with the accepted AlA format. Additionally, as an option we suggested a modified delivery method wherein Heery could augment our role in the project, thus having mote control and be able to assume more risk. It is my understanding that the county is unwilling to make any changes in your contract form, or consider any other means whereby we could enhance our role and thus assume more risk for total project delivery. If this is the case, then I must inform you that. without the ability to make any changes in the current contract, Heery International will not be able to execute it. Please understand, that unlike many other design firms, we are a large and financially secure corporation. Therefore the liability we would incur in executing your contract would make us a target for any litigation that could arise. J will be available Friday afternoon in Key West to discuss this further with the county and hope again that the Monroe County has some ability to negotiate on this matter. Unfortunately) the low bid is $ 785)000.00 over budget. Some of the overage is contained in the two "grant" projects) but the majority was contained in the Flagler Avenue milling and resurfacing project. Accordingly) all bids are being rejected) and David J. Mendez) P.E.) FDOT Consultant Project Manager) will be coordinating with County staff in the very near future to discuss alternatives for future letting of the project.
