Agenda Item Wording: Approval to purchase property - Breezeswept Beach Estates subdivision.
Item Background: This item is proposed at the request of the property owner to protect property rights
and natural resources. Breezeswept Beach Estates is a filled subdivision on Ramrod Key that is over
50% built out with houses. Although it consists of disturbed land, the subject lot was initially designated
a "red flag" wetland pursuant to section 9.5-348(d)(6)(a)(2) of Monroe County's land development
regulations and, as such, was deemed unsuitable for filling. This being the case, the owner signed a
Land Authority purchase agreement for a price of $24,000. Following the owner's execution of the
purchase agreement, the staff determined that the lot may not qualify as a red flag wetland after all.
Staff is in the process of consulting the other agencies involved (DCA, DEP, EPA, and ACOE) to
confirm the lot's wetland status. There are 20 or more lots with similar wetland conditions in this
subdivision alone.
If the Board wishes to proceed with this acquisition, the Land Authority's standard purchase contract will
be used. The agenda packet spreadsheet lists the legal description, purchase price, and estimated
closing costs. Due to the developed state of the surrounding land and the accessibility of this lot, land
stewardship needs are anticipated to be moderate.
Advisory Committee Action: On February 26, 2003 the Advisory Committee voted 4/0 to approve
purchasing the property (based on the representation that the lot qualifies as a red flag wetland).
Previous Governing Board Action: To date the Board has not approved the purchase of red flag
wetlands in this subdivision.

We recently received a request for a letter of current site conditions for the parcel with RE#
00202320.000000. An inspection was conducted on 01i 03i 2003, at wiiich time it was determined that the
property qualifies as a Red Flag wetland and under Monroe County Code qualifies as unbuildable. The
parcel was observed to contain standing water and feeding wading birds. Photographs were taken and are
attached.
Per my conversation with Diane Annechino-Dolan represented as the property owner, it is my
understanding that she wouid like to seli the property to the Monroe County Land Authority, as it was
recently declared unbuiidabie. She can be reached at (704)824-8663.
In July of 1999, the Monroe County Board of Commissioners voted to adopt regulations which allow for
deveiopmem (with appropriate mitigation) in jow and moderate functionai capacity disturbed wetiands while
prohibiting development within high functionai capacity or red-flag wetlands. Section 9.5-347(d)(5)(b)(2) of
the Wetland Development Regulations (see attached) states that:
Wetiands determined by KEYvVEP to have a high functional capacity (those wetlands that score at
or above 7.0 and those wetlands that are assigned a "red flag") are not suitable for filling. The open
space ratio for such wetiands wiii be i .0. An open space ratio of i .0 means that no portion of a
red-flag wetland may be fWed in any way and must remain In its natural condition.
