Ordinance 020-2021 ORDINANCE 020 -2021 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, AMENDING SECTION 11-173 OF THE MONROE COUNTY CODE; REQUIRING BOTH CLASS A AND CLASS B APPLICANTS PROVIDE AN E-MAIL ADDRESS, PROVIDING FOR NOTICE FROM THE COUNTY TO BE DELIVERED BY E-MAIL AND REQUIRING THAT THE E- MAIL ADDRESS BE KEPT CURRENT BY THE APPLICANT FOR BOTH CLASS A AND CLASS B APPLICATIONS; INCREASING THE NON-REFUNDABLE APPLICATION FEE FOR BOTH CLASS A AND CLASS B APPLICANTS;REQUIRING BOTH CLASS A AND CLASS B APPLICANTS PROVIDE AN AUDIT OF THE APPLICANTS ANNUAL OPERATING STATISTICS; PROVIDING FOR A LIFE SAFETY INSPECTION OF THE BUSINESS LOCATION OF BOTH CLASS A AND CLASS B APPLICANTS PRIOR TO BEGINNING OPERATIONS; REQUIRING NOTIFICATION TO THE COUNTY OF ANY CHANGE TO THE BUSINESS LOCATION AND PROVIDNG FOR CANCELLATION OF THE COPCN FOR FAILURE THEROF;REQUIRING MONROE COUNTY TO OBTAIN E- MAIL ADDRESSES FOR ALL EXISTING CERTIFICATE HOLDERS HOLDING CLASS A OR CLASS B CERTIFICATES IN MONROE COUNTY AS OF JULY I, 2021 TO REQUEST E-MAIL ADDRESSES FOR NOTICE PURPOSES AND SETTING FORTH E-MAIL NOTICE AS THE PREFERRED DELIVERY METHOD; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE OF ORDINANCES; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Chapter 401, Florida Statutes, authorizes the Board of County Commissioners of Monroe County to provide for and enact Emergency Medical Services standards in order to promote the health, safety and welfare of the citizens of the County; and 1 WHEREAS, In order to effectively promote and protect the health, safety, and welfare of the residents and visitors of Monroe County in need of emergency medical services,it is necessary to establish reasonable standards for issuing Certificates of Public Convenience and Necessity for Primary Providers and Secondary Providers; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,FLORIDA: [Proposed Text Changes are presented in strikethrough to indicate deletions and underline to indicate additions.' SECTION 1: Section 11-173 Procedure for Obtaining shall be amended to read as follows: Sec. 11-173.-Authority and Purpose and Procedure for obtaining. This Ordinance is promulgated pursuant to Chapter 401, Florida Statutes. The purpose of this Ordinance is to promote the health, safety. and welfare of the residents of the County in need of emergency medical services by establishing standards for issuing certificates of public convenience and necessity for ALS and BLS Providers, and by providing for the adoption of rules and regulations governing Monroe County and the operation of services as described herein. (a) Primary Provider Class A certificate. Application for Primary Provider Class A certificate shall be made on forms provided by the administrator. Such applications shall include: (I) The name, business mailing address, e-mail address and telephone number of the service. Notice from the county required under subsection 11-173(d) shall be delivered to the e-mail address provided in the application unless the applicant specifically requests the notice be delivered to the business mailing address. It shall be the applicant's responsibility to ensure that the applicants e- mail address is kept current at all times during the pendency of the application and, if approved,during the term of the certificate for notice purposes. (2)The name, age, address and telephone number of each owner of the emergency medical service, or, if the service is a corporation, the directors of the corporation and of each stockholder of the corporation, or, if the service is a volunteer organization, the officers of the organization. (3)The date of incorporation or formation of the business association. (65)The applicant's present and proposed base station and all substations. (466) The names of all emergency medical technicians, paramedics and drivers qualified under Section 401.281, Florida Statutes and Chapter 64J-1.013 Florida Administrative Code to be utilized by the applicant; the roster will include the state certification number, date of certification expiration, and any other relevant training of said personnel. (87) The year, model, type, department of health ambulance permit number, mileage and state vehicle license number of every ambulance vehicle that will be used by the applicant. (98)A description of the applicant's communication systems,including its assigned frequency, call numbers, mobiles, portables, other frequencies in use, and a copy of all FCC licenses held by the applicant. (44)The names and addresses of three U.S. citizens who will act as references for the applicant. (4410) A schedule of rates which the company will charge during the certificate period. (44.211) Verification of adequate insurance coverage, during the certificate period. (4412) An affidavit signed by the applicant or an authorized representative stating that all the information contained in the application,to the best of the applicant's knowledge, is true and correct. (4413)A copy of the applicant's contract with a medical director. (4-514)A copy of all standing orders as issued by the medical director. (4615) Such other pertinent information as the administrator may request. (4416) An initial A non-refundable application fee of$30,00 $950.00 for new applications. (4.817) Reaewed- An audit to be provided to the county administrator by an independent certified public accountant of the annual operating statistics and accounts and records of the service involved, said audit to be done annually to coincide with the end of the business year of the service. (18) The Monroe County Fire Rescue Department shall perform a life safety inspection of the business location placed on the application prior to the beginning of operations within Monroe County. The COPCN applicant is required to maintain a business location in Monroe County throughout the term the COPCN remains active. The COPCN applicant/awardee is required to 3 notify the Administrator of any change to the business location or be subject to cancellation of the issued COPCN. (b) Secondary Provider Class B Certificate. Application for Secondary Provider Class B certificate shall be made on forms provided by the administrator. Each application shall include: (I) The name, business mailing address, e-mail address and telephone number of the service. Notice from the county required under subsection 11-173(d) shall be delivered to the e-mail address provided in the application unless the applicant specifically requests the notice be delivered to the business mailing address. It shall be the applicant's responsibility to ensure that the applicants e- mail address is kept current at all times during the pendency of the application and,if approved, during the term of the certificate for notice purposes. (2) The name, age, address and telephone number of each owner of the non- emergency medical transportation service,or,if the service is a corporation,the directors of the corporation and of each stockholder of the corporation,or,if the service is a volunteer organization, the names of its officers. Upon receipt of the application, the administrator shall review the application and conduct an investigation of the applicant. The administrator shall also make an investigation as to the public convenience and necessity for an 5 emergency medical service or nonemergency medical transportation service within the zone or area requested. (d)Requirements for board approval in granting class A or class B certificates. (1) The board shall schedule public hearings to consider all applications for certificates. The administrator shall notify the applicant and all current holders of certificates either by e-mail or postal mail of the date, time and place of the public hearings at least one week in advance. The preferred method for delivery of the notice shall be via the applicants e-mail address unless the applicant has requested postal mailing of the notice to a business address. For purposes of this sub-section, Monroe County shall contact all certificate holders holding Class A or Class B certificates in Monroe County as of November 1,2020 to request an e-mail address for notice purposes.Thereafter thepreferred method for delivery of notice shall be via the certificate holders e-mail address unless the certificate holder has requested postal mailing of the notice to a business address. (2)At the hearing,the board may receive the report of the administrator, testimony from the applicant or any other interested party and any other relevant information. The board will consider the public's convenience and the necessity for the service in the zone or area requested and whether the applicant has the ability to provide the necessary service. The board will consider recommendations from municipalities within the applicant's requested service zone or area.The board shall then authorize the issuance of the certificate, with such conditions as are in the public's interest, or deny the application, setting forth the reasons for denial. SECTION 2: SEVERABILITY. If any portion of this ordinance is for any reason held invalid or declared to be unconstitutional, inoperative or void, such holding shall not affect the remaining portions of this ordinance. If this ordinance or any provision thereof shall be held to be inapplicable to any person,property or circumstances,such holding shall not affect its applicability to any other person, property or circumstances. SECTION 3: CONFLICT WITH OTHER ORDINANCES. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. SECTION 4: INCLUSION IN CODE OF ORDINANCES. The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. 6 SECTION 5: TRANSMITTAL AND EFFECTIVE DATE.This Ordinance shall be filed with the Department of State and shall be effective as provided in section 125.66(2), Florida Statutes.
