ITEM BACKGROUND: The subject parcel is approximately 3,750 square feet and is located approximately at Mile Marker 30.5, Bayside. The subject parcel, which is currently used for outdoor storage, is leased to Skeeter's Marine Repair. The owner of Skeeter's Marine Repairs has inquired to FDOT about purchasing this portion of FDOT Right-of-Way along U.S. 1. FDOT has determined it prudent to sell the subject parcel to reduce their liability and maintenance exposure. PREVIOUSLY RELEVANT BOCC ACTION: November 10, 1999- Resolution 565-1999 recommending that the Florida Department of Transportation deny requests to surplus properties adjacent to U.S. 1 until board action is taken on the Overseas Heritage Trail and the Storrnwater Master Plans. CONTRACT/AGREEMENT CHANGES: N/A STAFF RECOMMENDATION: Approval TOTAL COST: o BUDGETED: Yes No X COST TO COUNTY: 0 SOURCE OF FUNDS: N/ A REVENUE PRODUCING: Yes-1L- No APPROVED BY: County Arty X AMOUNT PER MONTH Year Risk Management N/ A DIVISION DIRECTOR APPROVAL: arry, AICP DOCUMENTATION: Included X To Follow Not Required ~/ , DISPOSITION: AGENDA ITEM # RESOLUTION NO. - 2003 A RESOLUTION OF THE BOARD OF COMMISSIONERS OF MONROE COUNTY, FLORIDA TO CONCUR WITH THE DECISION OF FLORIDA DEPARTMENT OF TRANSPORTATION TO SURPLUS EXCESS PROPERTY ADJACENT TO U.S. 1 AT MILE MARKER 30.5, BA YSIDE WHEREAS, the Monroe County Board of Commissioners has passed Resolution 565- 1999 on November 10, 1999 establishing the policy of Monroe County to request that the Florida Department of Transportation (FDOT) deny any requests to surplus properties adjacent to U.S. 1 until the Board of Commissioners has taken action on the Overseas Heritage Trail and Stormwater Master Plan; and WHEREAS, the Florida Department of Transportation has determined that the sale or lease of excess lands is prudent in order to reduce the liability and maintenance costs for FDOT; and WHEREAS, a property owner has requested to purchase a portion of the FDOT Right-of- Way adjacent to U.S. 1 and the Florida Department of Transportation finds it prudent to sell the rectangular shaped approximately 3,750 square foot parcel at Mile Marker 30.5 Bayside; and WHEREAS, the sale of the subject property would not hinder the implementation of proposed safety improvements to the Florida Keys Overseas Heritage Trail; and WHEREAS, the sale of the subject property would not interfere with implementation of the Monroe County Stormwater Master Plan; NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the County concurs with the Florida Department of Transportation decision to surplus the subject property at Mile Marker 30.5, Bayside. Marlene conawa~or, Planning and Environmental Resources Department Surplus of Florida Department of Transportation (FOOT) Right-of-Way at Mile Marker 30.5, Bayside TO: RE: DATE: August 25, 2003 Issue: The owner of Skeeter's Marine Repair, Richard Beal, has inquired with FOOT about purchasing a portion of the right-of-way at approximately MM 30.5, Bayside. Previous action by the Board of County Commissioners (BOCC) requested FOOT to deny requests to surplus property along U.S. ] until the BOCC has taken action on the Overseas Heritage Trail (OHT) and the Stonnwater Master Plans. Background: Skeeter's Marine Repair is currently leasing the approximately 50' X 75' (3,750 square feet) subject property from the F]orida Department of Transportation for use as outdoor storage. Through this section ofUS-], the typical right-of-way width is ]00 feet. The subject parcel extends outside of the typical right-of-way line and is surrounded on three sides (north, west, and east) by Skeeter's Marine Repair (See attached aerial). Although the OHT is scheduled for the bays ide at this location, a review of the proposed safety improvements for the OHT on Big Pine Key shows that the sale of the subject parcel would not hinder the implementation of the proposed safety improvements. A review of the Stonnwater Master Plan also shows no projects that would be affected by the sale of the parcel. Conclusion Staff recommends approval of the resolution. .. ,~ fA '55. ,~
