ITEM BACKGROUND: Monroe County's existing parking regulations need to be updated to reflect
current conditions for automobile size, usage and commercial activities. The proposed Ordinance
addresses the following parking activities: Standards for aisle widths in parking areas, parallel parking
spaces, size and number of commercial loading spaces, a single set of requirements for all eating and
drinking establishments, parking related to marinas, commercial boating activities and live-aboard
uses, and calculations for shared parking between uses on different lots.
The Monroe County Development Review Committee, at a public meeting on September 15, 2003,
after a review of the staff report, voted to approve the new text as presented.
The Monroe County Planning Commission, at public hearings on October 8, 2003 and October 22,
2003, reviewed the staff report, sworn testimony of planning staff, and public comment, and
recommended approval of the proposed amendment to the Board of County Commissioners

WHEREAS, For a number of years, municipalities have found it necessary to
modify their parking and loading standards in order to accommodate changes resulting
from such factors as:
. the changing usage in automobile travel,
. new mixes of commercial activity,
. more modern truck delivery methods,
. the sub-tropical climate of communities encourages a proliferation of outdoor dining,
drinking, entertainment, and sales establishments; and
WHEREAS, Monroe County has exhibited all of these issues; and
WHEREAS, the present Division 9 provides lists of standards rather than easily
read tables; and
WHEREAS, the LOR's provide discrete numbers for handicapped vehicles even
though the numbers were established by the Florida Accessibility Code for Building
Construction; and
WHEREAS, the County has adopted the Code by reference as part of the
County's building code in Chapter 6, and there is no need to replicate those numbers in
this Division; and
WHEREAS, the Section Design of Spaces for the Handicapped is redundant and
should be eliminated from this Division; and
WHEREAS, due to the lack of available land for many uses, it is often not
possible to provide all of the required parking on the same lot as the principal use and It
has become necessary to provide better regulations for shared parking as well as off-site
parking; and
WHEREAS, the proposed text specifically addresses the following issues:

. An increase in parking area aisle widths.
. A standard for parallel parking spaces.
. An increase in the parking requirements for commercial retail including the parking
demand generated by outdoor sales areas.
. A single set of parking requirements for all eating and drinking uses.
. A reduction in the parking requirements relating to marinas, commercial boating
activities, and live-aboard uses.
. Additional space requirements for parked trailers and towing vehicles while boats are
being used at boat ramps.
. A more flexible shared parking option.
. An increase in the size of loading and unloading spaces and a decrease in the
number of total spaces required for commercial and industrial uses; and
WHEREAS, Staff finds that there is a need to revise the parking regulations to
more accurately reflect the changing needs of businesses, the changing customer
preferences, and the limited space available for parking opportunities in the Keys; and
WHEREAS, Staff finds that the proposed change is consistent with Section 9.5-
511 (d)(5) b. (iv) New Issues and M Recognition of a need for additional detail or
comprehensiveness; and
WHEREAS, this proposed amendment was reviewed at the Development
Review Committee public meeting of September 15, 2003.
WHEREAS, this proposed amendment was heard at regularly scheduled public
hearings of the planning commission on October 8, 2003 and on October 22, 2003; and
WHEREAS, the Monroe County Board of County Commissioners was presented
with the following evidence, which by reference is hereby incorporated as part of the
record of said hearing;
1. Staff report prepared on October 28, 2003 by Fred Gross, Island Planning Team
Director.
2. Proposed change to the Monroe County Land Development Regulations.
3. The sworn testimony of the Growth Management Staff.
4. The sworn testimony of residents of Monroe County; and

Section 9.5-351. Purpose and intent.
The purpose and intent of this division is to provide adeQuate off-street parkino
and loadino areas to serve the maiority of traffic oenerated by development. The
provision of parkino and loadino areas is to: avoid undueconoestion on the
streets: protect the capacity of the road system to move traffic: minimize
unnecessary conflicts between vehicles, pedestrians. and bicyclists: facilitate the
use of transportation manaoement systems: and avoid noise. olare. liohts. and
visual impacts of parkino and loadino operations on adiacent properties.
Section 9.5-354352. Required off-street parking.
(a) Generallv: Every use shall be provided with off-street parking in accordance
with the follov:ing standards contained in this division. Every parkino space. both
reQuired and unreQuired. shall meet the minimum standards of this division.

(e) Calculation of Number of Parkina Spaces: In calculatino the number of
parkino spaces reauired under this division. the followino special provisions
~:
(1) When units or measurements determinino the number of reQuired parking
spaces result in the reauirement of a fractional space. any fraction UP to
and includino one-half shall be disreoarded and fractions over one-half
shall reQuire one parkino space.
(2) In determinino the amount of land activity area for outdoor uses. areas
used for parkino and driveways shall not be counted.
(3) When two or more separate uses are on a site. the reQuired parkino for
the site is the sum of the total reQuired parkino for each of the individual
uses. except if the shared parkinQ calculation option is used. as provided
for in subsection (j).
(f)Design of SpaGB8 for the Handicapped Parkinq Reauirements: The number
and desion of handicapped parkino spaces shall be in accordance with the
provisions of Chapter 6. which incorporates by reference the Florida Accessibility
Code for Buildino Construction.
(g) Location of Required Parking: Required off-street parking spaces for single-
family and multi-family residential uses shall be located on the premises they are
intended to serve. Other Required off-street parking spaces for all other uses
shall be located on the same lot as the principal use they are intended to serve
whioh such facilities are intended to serve or upon a another lot 'Nithin three
hundred (300) feet. in accordance the provisions of subsection (h).
(h) Off-Site Parkina Reauirements: The followino reQuirements shall apply to off-
site parkino facilities:
(1) The location of anv off-site parkinQ lot shall be within three hundred (300)
feet walkino distance. as measured. by the shortest route of effective
pedestrian access. of a public entrance to the structure of land area
containino the use for which the spaces are reQuired:

(2) A parkino aoreement shall be reQuired in accordance with Section 9.5-
353; and.
(3) Any off-site parkino area located within a different land use district than
the principal use it is intended to serve shall meet the followino provisions
in addition to reQuirements (1) and (2) above:
a. The off-site parkino area and the use(s) it is intended to serve shall be
aooreoated for purposes of development review and shall be approved
only as a minor or major conditional use.
b. The principal use intended to be served by the off-site parkino area
shall be a permitted principal use within the zonino district in which the
off-site parkino area is located.
(h}(i) Shared Parking Option Requirements:
(1) Purpose: The purpose of this subsection the shared parking option is to
permit a reduction in the total number of parking spaces which would
otherwise be required in instances .....hen a lot is occupied by two (2) or
more uses which t}(pically do not experience peak parking demands at the
same time where two or more uses on the same lot or separate lots are to
share the same parkino spaces because their peak parkino demands do
not occur at the same time. Shared parkino is an option to the method for
calculation of reQuired parkino as provided for in subsection (e)(3).
(2) Condition on Development Approval: If the shared parkino option is used
to calculate the amount of reQuired parkino spaces. the approved
development permit shall have a condition that any chanoe in the
occupancy or use of any the principal uses intended to be served by the
shared parkino shall reQuire development approval by the Plannino
Director to ensure sufficient parkino is available.
~(3) Computation of shared parking requirements: Notwithstanding the
provisions of subsection (Gt-(e)(4) for individual land uses, when any land
or building is used for two (2) or more distinguishable purposes as listed
below, the shared parkino option may be used to determined the minimum
amount of parkino reQuired. Under the shared parkino option, the
minimum total number of required parking spaces for said land or building
shall be determined by the following procedure:
a. multiply the minimum parking requirement for each individual
use as set forth in subsection (c) by the appropriate
percentage as set forth in the table below for each faF-of the
five designated time periods.

b. add the resulting sums for each of the five (5) vertical
columns in the table.
c. the minimum parking requirement is the highest sum among
the five (5) columns resulting from the calculation in
subsection (b) above.

foot lono stall with a minimum aisle width of five (5) feet. The bicycle parkino
area shall be located within fifty (50) feet of a public entrance to the principal
structure and shall not interfere with pedestrian traffic.

(a) Puroose: The purpose of parkino aoreements is to ensure the continued
availability of off-site parkino facilities for the use(s) they are intended to serve.
(b )Reauirements: All off-site parkino facilities shall reQuire a parkino aoreement.
(c) Form and Approvals: The parkino aoreement shall drawn to the satisfaction of
the County Attorney and Plannino Director and executed by all parties. includino
the County. The aoreement shall provide the County with the rioht of
enforcement.

Spaces: Loading spaces shall be located entirely within on the same lot as the
principal use they serve and not.:. These spaces shall not be located on any
public right-of-way, or other lot, or on any parkino spaces or parkino aisle.
Section 9.5-353 355 Restriction on use of parking and loading areas
spaces.
The display or storage of merchandise, materials or motor vehicles and/or repair
of motor vehicles or any kind of equipment is prohibited in all off-street parking
and loading spaces and aisles, inoluding required and unrequired_spaoes.

Ingress and egress from parking and loading spaoes shall be provided as

Ingress and egress to and from parking and loading spaces shall be pro'tided by

Section 2. If any section, subsection, sentence, clause, item, change, or
provision of this ordinance is held invalid, the remainder of this
ordinance shall not be affected by such validity.
Section 3. All ordinances or parts of ordinances in conflict with this
ordinance are hereby repealed to the extent of said conflict.
Section 4. The provisions of this ordinance shall be included and
incorporated in the Code of Ordinances of the County of
Monroe, Florida, as an addition or amendment thereto, and
shall be appropriately renumbered to conform to the uniform
numbering system of the Code.
Section 5. This ordinance shall be filed in the Office of the Secretary of
State of Florida, but shall not become effective until a notice is

issued by the Department of Community Affairs or
Administrative Commission approving the ordinance.
Section 6. This ordinance shall be transmitted by the Planning Department
to the Department of Community Affairs to determine the
consistency of this ordinance with the Florida Statutes.

J. BACKGROUND

. the sub-tropical climate of communities encourages a proliferation of outdoor
dining, drinking, entertainment, and sales establishments.
Monroe County has exhibited all of these issues. Additionally, the present
Division 9 provides lists of standards rather than easily read tables. The LDR's
provide discrete numbers for handicapped vehicles even though the numbers
were established by the Florida Accessibility Code for Building Construction. If
the calculations in the Code are changed, we are required to formally amend our
LDR's. However, since the County has adopted the Code by reference as part of
the County's building code in Chapter 6, there is no need to replicate those
numbers in this Division. Similarly, the Section Design of Spaces for the
Handicapped is redundant and should be eliminated from this Division. Because
of the lack of available land for many uses, it is often not possible to provide all of
the required parking on the same lot as the principal use. It has become
necessary to provide better regulations for shared parking as well as off-site
parking.
The proposed draft text specifically addresses the following parking issues:
. The current standards for aisle widths. are too narrow and are creating
safety and traffic flow problems. Staff has proposed increased aisle widths.

II. ANALYSIS & FINDINGS OF FACT
1 . Staff finds that there is a need to revise the parking regulations to more
accurately reflect the changing needs of businesses, the changing customer
preferences, and the limited space available for parking opportunities in the
Keys.
2. Staff finds that the proposed change is consistent with Section 9.5-511 (d)(5)
b. (iv) New Issues and (V) Recognition of a need for additional detail or
comprehensiveness.

streets: protect the capacity of the road system to move traffic: minimize
unnecessary conflicts between vehicles. pedestrians. and bicyclists: facilitate the
use of transportation manaoement systems: and avoid noise. olare. liohts. and
visual impacts of parkina and loadina operations on adiacent properties.
Section 9.5-3M352. Required off-street parking.
(a) Generallv: Every use shall be provided with off-street parking in accordance
with the follov.'ing standards contained in this division. Every parkina space. both
reQuired and unreauired. shall meet the minimum standards of this division.

family and multi-family residential uses shall be located on the premises they are
intended to serve. Othor Required off-street parking spaces for all other uses
shall be located on the same lot as the principal use they are intended to serve

pedestrian access. of a public entrance to the structure of land area
containino the use for which the spaces are required;
(2) A parkinq aqreement shall be required in accordance with Section 9.5-
353; and.
(3) Any off-site parkinQ area located within a different land use district than
the principal use it is intended to serve shall meet the followino provisions
in addition to requirements (1) and (2) above:

a. The off-site parkina area and the use(s) it is intended to serve shall be
aOQreoated for purposes of development review and shall be approved
only as a minor or maior conditional use.
b. The principal use intended to be served by the off-site parkina area
shall be a permitted principal use within the zonino district in which the
off-site parkina area is located.
fR1(i) Shared Parking Option Requirements:
(1) Purpose: The purpose of this subsection the shared parking option is to
permit a reduction in the total number of parking spaces which would
otherwise be required in instances ,,":hen :1 lot is occupied by two (2) or
mora uses \.,hich typic:1l1y do not experienco peak parking demands at tho
S:1me time where two or more uses on the same lot or separate lots are to
share the same parkino spaces because their peak parkinQ demands do
not occur at the same time. Shared parkino is an option to the method for
calculation of reauired parkina as provided for in subsection (e)(3).
(2) Condition on Development Ap/Jroval: If the shared parkinQ option is used
to calculate the amount of reQuired parkino spaces. the approved
development permit shall have. a condition that any chanae in the
occupancy or use of any the principal uses intended to be served by the
shared parkina shall reQuire development approval by the Plan nino
Director to ensure sufficient parkino is available.
~(3) Computation of shared parking requirements; Notwithstanding the
provisions of subsection (6t-(e)(4) for individual land uses, when any land
or building is used for two (2) or more distinguishable purposes as listed
below, the shared parkino option may be used to determined the minimum
amount of parkino reauired. Under the shared parkinQ option. the
minimum total number of required parking spaces for said land or building
shall be determined by the following procedure:
a. multiply the minimum parking requirement for each individual
use as set forth in subsection (c) by the appropriate
percentage as set forth in the table below for each faH>f the
five designated time periods.
b. add the resulting sums for each of the five (5) vertical
columns in the table.
c. the minimum parking requirement is the highest sum among
the five (5) columns resulting from the calculation in
subsection (b) above.

foot lono stall with a minimum aisle width of five (5) feet. The bicycle parkinq
area shall be located within fifty (50) feet of a public entrance to the principal
structure and shall not interfere with pedestrian traffic.
Section 9.5-353. Parkino aareements.
(a) Purpose: The purpose of parkino aoreements is to ensure the continued
availability of off-site parkinq facilities for the use(s) they are intended to serve.
(b )Reauirements: All off-site parkinq facilities shall reQuire a parkino aoreement.
(c) Form and Approvals: The parkino aoreement shall drawn to the satisfaction of
the County Attorney and Plannino Director and executed by all parties, includino

WHEREAS, For a number of years, municipalities have found it necessary
to modify their parking and loading standards in order to accommodate changes
resulting from such factors as:
. the changing usage in automobile travel,
. new mixes of commercial activity,
. more modern truck delivery methods,
. the sub-tropical climate of communities encourages a proliferation of outdoor
dining, drinking, entertainment, and sales establishments; and
WHEREAS, Monroe County has exhibited all of these issues; and
WHEREAS, the present Division 9 provides lists of standards rather than
easily read tables; and
WHEREAS, the LDR's provide discrete numbers for handicapped vehicles
even though the numbers were established by the Florida Accessibility Code for
Building Construction; and
WHEREAS, the County has adopted the Code by reference as part of the
County's building code in Chapter 6, and there is no need to replicate those
numbers in this Division; and
WHEREAS, the Section Design of Spaces for the Handicapped is
redundant and should be eliminated from this Division; and
WHEREAS, due to the lack of available land for many uses, it is often not
possible to provide all of the required parking on the same lot as the principal use
and It has become necessary to provide better regulations for shared parking as

containinq the use for which the spaces are required;
(2) A parkino aQreement shall be required in accordance with Section 9.5-
353; and.
(3) Any off-site parkinq area located within a different land use district than
the principal use it is intended to serve shall meet the followino provisions
in addition to reQuirements (1) and (2) above:
a. The off-site parkino area and the use(s) it is intended to serve shall be
aooreoated for purposes of development review and shall be approved
only as a minor or maior conditional use.
b. The principal use intended to be served by the off-site parkinq area
shall be a permitted principal use within the zonino district in which the
off-site parkino area is located.
W(i) Shared Parking Option Requirements:
(1) Purpose: The purpose of this subsoction the shared parking option is to
permit a reduction in the total number of parking spaces which would
otherwise be required in instances when a lot is occupiod by tv/o (2) or
more uses ,,".'hich typically do not exporionce peak parking domands at the
same timo where two or more uses on the same lot or separate lots are to
share the same parkinQ spaces because their peak parkino demands do
not occur at the same time. Shared parkinQ is an option to the method for
calculation of required parkinq as provided for in subsection (e)(3).
(2) Condition on Development Approval: If the shared parkinQ option is used
to calculate the amount of required parkinq spaces. the approved
development permit shall have a condition that any chanQe in the
occupancy or use of any the principal uses intended to be served by the

shared parkina shall reQuire development approval by the Plannino
Director to ensure sufficient parkino is available.
f2j(3) Computation of shared parking requirements: Notwithstanding the
provisions of subsection tG)-(e)(4) for individual land uses, when any land
or building is used for two (2) or more distinguishable purposes as listed
below, the shared parkina option may be used to determined the minimum
amount of parkino reQuired. Under the shared parkino option, the
minimum total number of required parking spaces for said land or building
shall be determined by the following procedure:
a. multiply the minimum parking requirement for each individual
use as set forth in subsection (c) by the appropriate
percentage as set forth in the table below for each feF...of the
five designated time periods.
b. add the resulting sums for each of the five (5) vertical
columns in the table.
c. the minimum parking requirement is the highest sum among
the five (5) columns resulting from the calculation in
subsection (b) above.

Section 9.5-353. Parkino aareements.
(a) PUffJose: The purpose of parkino aoreements is to ensure the continued
availability of off-site parkino facilities for the use(s) they are intended to serve.
(b )ReQuirements: All off-site parkinQ facilities shall require a parkino aoreement.
(c) Form and Approvals: The parkinQ aQreement shall drawn to the satisfaction of
the County Attorney and Plannina Director and executed by all parties. includinq
the County, The aareement shall provide the County with the rioht of
enforcement.

A RESOLUTION BY THE MONROE COUNTY DEVELOPMENT
REVIEW COMMITTEE RECOMMENDING APPROVAL TO THE
MONROE COUNTY PLANNING COMMISSION OF THE
REQUEST FILED BY THE MONROE COUNTY PLANNING
DEPARTMENT TO AMEND DIVISION 9 OF THE MONROE
COUNTY CODE, (PARKING AND LOADING STANDARDS) IN
ORDER TO MODIFY CERTAIN STANDARDS THAT ARE NO
LONGER APPROPRIATE AND TO REFORMAT THE SECTIONS
IN ORDER TO PROVIDE GREATER CLARITY AND EASE OF
REFERENCE.
WHEREAS, For a number of years, municipalities have found it necessary
to modify their parking and loading standards in order to accommodate changes
resulting from such factors as:
. the changing usage in automobile travel,
. new mixes of commercial activity,
. more modern truck delivery methods,
. the sub-tropical climate of communities encourages a proliferation of outdoor
dining, drinking, entertainment, and sales establishments; and
WHEREAS, Monroe County has exhibited all of these issues; and
WHEREAS, the present Division 9 provides lists of standards rather than
easily read tables; and
WHEREAS, the LDR's provide discrete numbers for handicapped vehicles
even though the numbers were established by the Florida Accessibility Code for
BuHdingConslfuction;and
WHEREAS, the County has adopted the Code by reference as part of the
County's building code in Chapter 6, and there is no need to replicate those
numbers in this Division; and
WHEREAS, the Section Design of Spaces for the Handicapped is
redundant and should be eliminated from this Division; and
WHEREAS, due to the lack of available land for many uses, it is often not
possible to provide all of the required parking on the same lot as the principal use
and It has become necessary to provide better regulations for shared parking as
well as off-site parking; and

WHEREAS, the proposed text specifically addresses the following issues:
. An increase in parking area increased aisle widths.
. A standard for parallel parking spaces.
. An increase in the parking requirements for commercial retail including the
parking demand generated by outdoor sales areas.
. A single set of parking requirements for all eating and drinking uses.
. A reduction in the parking requirements relating to marinas, commercial
boating activities, and live-aboard uses.
. Additional space requirements for parked trailers and towing vehicles while
boats are being used at boat ramps.
. A more flexible shared parking option.
. An increase in the size of loading and unloading spaces and a decrease in
the number of total spaces required for commercial and industrial uses; and
WHEREAS, Staff finds that there is a need to revise the parking
regulations to more accurately reflect the changing needs of businesses, the
changing customer preferences, and the limited space available for parking
opportunities in the Keys; and
WHEREAS, Staff finds that the proposed change is consistent with
Section 9.5-511 (d)(5) b. (iv) New Issues and (V) Recognition of a need for
additional detail or comprehensiveness; and
WHEREAS, this proposed amendment was reviewed at the Development
Review Committee public meeting of September 15, 2003.
NOW THEREFORE, BE IT RESOLVED BY THE DEVELOPMENT REVIEW
COMMITTEE OF MONROE COUNTY, FLORIDA, that the preceding findings of
fact support their decision to recommend APPROVAL to the Monroe County
Planning Commission of the following amendments to the text of the Monroe
County Land Development Regulations as requested by the Monroe County
Planning Department:

Section 9.5-351. Purpose and intent.
The purpose and intent of this division is to provide adeauate off-street parkino
and loadino areas to serve the maiority of traffic oenerated by development. The
provision of parkino and loadina areas is to: avoid undue conaestion on the
streets: protect the capacity of the road system to move traffic: minimize
unnecessary conflicts between vehicles. pedestrians. and bicyclists: facilitate the
use of transportation manaqement systems: and avoid noise. alare. liohts. and
visual impacts of parkino and loadino operations on adiacent properties.
Section 9.5-35-1-352. Required off-street parking.
(a) Generallv: Every use shall be provided with off-street parking in accordance
with the follo'Ning standards contained in this division. Every parkina space. both
required and unrequired. shall meet the minimum standards of this division.

(e) Calculation of Number of Parkina Soaces: In calculatino the number of
parkinq spaces required under this division. the followino special provisions
mmJy:
(1) When units or measurements determinina the number of required parkino
spaces result in the requirement of a fractional space. any fraction UP to
and includino one-half shall be disreQarded and fractions over one-half
shall reauire one parkino space.
(2) In determininQ the amount of land activity area for outdoor uses. areas
used for parkina and driveways shall not be counted.
(3) When two or more separate uses are on a site. the reauired parkinQ for
the site is the sum of the total reauired parkinq for each of the individual
uses. except if the shared parkino calculation option is used. as provided
for in subsection (j).
(f)Desjgn of Spacos for the Handicapped Parkinq Requirements: The number
and desion of handicapped parkino spaces shall be in accordance with the
provisions of Chapter 6. which incorporates by reference the Florida Accessibility
Code for Buildina Construction.
(g) Location of Required Parking: Required off-street parking spaces for single-
family and multi-family residential uses shall be located on the premises they are
intended to serve. Other Required off-street parking spaces for all other uses
shall be located on the same lot as the principal use they are intended to serve
'Nhich such bcilities 3m intended to Berve or upon a another lot within three
hundred (300) foot. in accordance the provisions of subsection (h).
(h) Off-Site Parkinq Requirements: The followino reauirements shall apply to off-
site parkinQ facilities:
(1) The location of any off-site parkinq lot shall be within three hundred (300)
feet walkino distance. as measured by the shortest route of effective
pedestrian access. of a public entrance to the structure of land area
containinq the use for which the spaces are reauired:

(b) Loading Spaces on Sarno Lot: Location of Reauired Loadina and Unloadina
Spaces: Loading spaces shall be located entirely within on the same lot as the
principal use they serve and not.:. These SDaces shall not be located on any
public right-of-way, or other lot, or on any parkina spaces or parkina aisle.
Section 9.5-353 355 Restriction on use of parking and loading areas
spaces.
The display or storage of merchandise, materials or motor vehicles and/or repair
of motor vehicles or any kind of equipment is prohibited in all off-street parking
and loading spaces and aisles, including required and unrequiredJ>paces.
Section 9.5 354 Configuration of parking and loading ingress and egress.
Ingress and egress from parking and loading spaces shall be provided as
follows:
Ingress and egress to and from parking and loading spaces shall be provided by
means of clearly limited and defined entrance and exist drives 'Nhich lead from
the public rights of way to clearly limited and defined manouvering lanes which in
turn provide access to indi'.'idual parking or loading spaces. Layout
configurations which require backing directly onto U.S. 1, arterial and collector
streets from a parking or loading space are prohibited. There shall be a
minimum of ten (10) feet separation between access drives.
