RESOLUTION NO. -2003
A RESOLUTION DIRECTING THE SUPERVISOR OF ELECTIONS OF MONROE
COUNTY, FLORIDA TO PLACE ON THE MARCH 9. 2004 PRESIDENTIAL
PREFERENCE PRIMARY ELECTION BALLOT A REFERENDUM QUESTION
CONCERNING WHETHER THE SUPERINTENDENT OF SCHOOLS FOR MONROE
COUNTY SHOULD BE CHANGED FROM AN ELECTED OFFICIAL TO ONE
APPOINTED BY THE SCHOOL BOARD
WHEREAS, the School Board in Resolution No. 591 has requested, pursuant to
Section 1001.461, FS, that the Board of County Commissioners direct the Supervisor of
Elections to place on the March 9, 2004 presidential preference primary election ballot
a referendum question concerning changing the Superintendent of Schools from an
elected officer to an appointed officer by the School Board; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA:
Section 1. Pursuant to Sec. 1001.461, FS, the Supervisor of Elections of Monroe
County, Florida, is hereby directed to place on the ballot of the presidential primary
election to be held on March 9, 2004, the following proposition, in both English and
SpaniSh, to be voted upon by the voters of Monroe County, Florida:
SPECIAL ELECTION, MONROE COUNTY APPOINTIVE SCHOOL SUPERINTENDENT
Article IX, 'SecUon 5 of the ConstltuUon of the State of Florida provides for
the appointment of the Superintendent of Schools of Monroe County,
Florida, by the School Board of Monroe County, Florida, provided the
proposlUon Is affirmed by 'amaJortty vote of the qualified electors voUng In
the same election making the office of Superintendent appointive. At the
present time, the Superintendent of Schoofs.4f Monroe County, Florida, Is
an elected officer.
SHALL THE SUPERINTENDENT OF SCHOOLS OF MONROE COUNTY BE
APPOINTED BY THE SCHOOL BOARD UPON EXPIRATION OF THE CURRENT
SUPERINTENDENT'S TERM?

Section 2.
The Supervisor is further directed to require the School Board to
obtain preclearance form the US Department of Justice before placing the referendum
on the March 9, 2004 ballot.
Section 3. The Clerk is hereby directed to send a certified copy of this
Resolution to Harry Sawyer, Supervisor of Elections, 530 Whitehead Street, # 1 01, Key
West, FL 33040.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe
County, Florida, at a regular meeting of said Board held on the 19th day of November,
2003.
