ITEM BACKGROUND: Section 4 of Ordinance 37-2003, adopted by the Board of County Commissioners on October 15, 2003, amending the County's floodplain regulations, established January 1, 2004, sets the effective date for the new inspection requirements of Section 9.5-319, Monroe County Code. Unfortunately, this date is prior to the effective date of the ordinance, which go through DCA approval process under Chapter 380, Florida Statutes. The new effective date of April 4, 2004, for the inspection requirements of Section 9.5-319, will provide the opportunity for the Growth Management Division to prepare administrative and education materials and the program to implement this inspection requirement. It will provide the Division with more time to train inspectors and educate the public and real estate community about the inspection requirements of the program. CONTRACT/AGREEMENT CHANGES: N/A STAFF RECOMMENDATION: Approval TOTAL COST: N/A BUDGETED: Yes No N/A COST TO COUNTY: N/A SOURCE OF FUNDS: N/A REVENUE PRODUCING:Yes No X -- AMOUNT PER MONTH N/A YEAR APPROVED BY: County Attorney X OMBlPurchasing N/A Risk Management DIVISION DIRECTOR APPROVAL: DOCUMENTATION: Included X To follow Not Required __ DISPOSITION: AGENDA ITEM #: v~~ RESOLUTION ~OO3 A RESOLUTION OF THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS REVISING THE EFFECTIVE DATE FOR INSPECTIONS REQUIRED UNDER SECTION 9.5-319, MONROE COUNTY CODE, FROM JANUARY 1, 2004, TO APRIL 1,2004 WHEREAS, the Monroe County Board of County Commissioners adopted Ordinance 37-2003 creating Section 9.5-319, Monroe County Code on October 15,2003; and, WHEREAS, Section 9.5-319 requires that prior to transfer of any property occupied by an elevated residential structure with a below base flood enclosed areas constructed on or after January I, 1975, a County approved inspection of the downstairs enclosure; and, WHEREAS, the results of these inspections are intended to provide the County for record keeping purposes information on non-conformities with the floodplain regulations and to disclose these non-conformities to new property owners; and, WHEREAS, section 4 of Ordinance 37-2003, establishes January 1,2004, as the effective date for the inspection requirements of Section 9.5-319; and, WHEREAS, the effective date of Ordinance 37-2003 will be no sooner than mid-January in order to comply with the requirements of Chapter 380, Florida Statutes; and, WHEREAS, this effective date for Ordinance 37-2003 renders moot the January 1, 2004, date for meeting inspection requirements of Section 9.5-319; and, WHEREAS, additional time is needed by the County staff to prepare necessary administrative and educational materials and the program to implement this inspection requirement; and, WHEREAS, the extension of the effective date for the required inspections will provide the Growth Management Division further opportunities to adequately train inspectors and educate the public and real estate community about the inspection requirements; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA that the January 1, 2004, effective date for the inspection requirements of Section 9.5-319 adopted in Ordinance 37-2003, be delayed until April 1, 2004; PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida, at a regular meeting of said Board held on the 19th day of November, A.D., 2003.
