AGENDA ITEM WORDING: Approval to direct staff to prepare appropriate draft
amendments to the LDR's that would help clarify the uses under Sec. 9.5-250 Maritime
Industries District. As of Right permitted uses in the Maritime Industries District: (1) Boat
building, repair and storage: (WET AND DRY); ALSO, DOCKAGE OF STATE REGISTERED
OR FEDERALLY-DOCUMENTE D SAIL OR MOTOR VESSELS HAVING A MINIMUM
LENGTH OF THIRTY (30) FEET, BUT EXCLUDING FLOATING STRUCTURES LACKING
MEANS OF SELF-PROPULSION AND USED SOLELY AS A RESIDENCE.
ITEM BACKGROUND: This change helps to clarify the types of boats that are historically
docked, stored and repaired in the Maritime Industries District of Stock Island. County has
been confusing these uses with Iive-aboards, which has caused needless code violations and
expense.
PREVIOUS RELEVANT BOCC ACTION: January 21, 2004 this item was tabled. Item has
been rewritten.

Proposed LDR Text Amendment
This proposed Text Change will clarify the uses under Sec.9.5-250 Maritime Industries
District, (a) The following uses are permitted as of right in the Maritime Industries
District: (1) Boat building, repair and storage; by adding the following text after the word
storage:
(wet and dry); also, dockage of State registered or Federally-documented
sail or motor vessels having a minimum length of thirty (30) feet, but
excluding floating structures lacking means of self-pro puIs ion and used
sole~v as a residence.
This change will reflect the historic and current uses in the Maritime Industries District
and eliminate any confusion as to what is and has been traditional uses in the Safe Harbor
Area of Stock Island.

Sec. 9.5-250. Maritime Industries District (MI).
(a) The following uses are permitted as of right in the Mari-
time Industries District:
(1) Boat building, repair and storage; X
(2) Commercial retail uses of less than five thousand (5,000)
square feet of floor area;
(3) Office uses of less than five thousand (5,000) square feet
of floor area;
(4) Light and heavy industrial uses;
(5) Commercial apartments involving less than six (6) dwell-
ing units, but tourist housing uses, vacation rental use, of
commercial apartments is prohibited;
(6) Commercial fishing;
(7) Manufacture, assembly, repair, maintenance and storage
of traps, nets and other fishing equipment;
(8) Institutional uses;
(9) Public buildings and uses;
(10) Accessory uses; and
(11) Vacation rental use of any nonconforming dwelling units
if a special vacation rental permit is obtained under the
regulations established in Code section 9.5-534.
(12) Replacement of an existing antenna-supporting structure
pursuant to article VII, division 16, section 9.5-434.5(b)
"Replacement of an existing antenna-supporting struc-
ture."
