ITEM BACKGROUND Adjacent property owner's agent has requested a road abandonment, but the property in question is platted as a lot and has, for all intents and purposes, been used as a driveway to a larger paved parking area for the seafood company on the adjacent lot. Property was originally deeded to the County for purposes of use as a road, and, except for the fact that it is not platted as a road, a road abandonment would be an appropriate mechanism for divesting the County of its interest therein. It appears to be part of a driveway leading to a larger paved area. I also reviewed proposed sewer plans and this parcel is not required for that project. Therefore, I would recommend that we surplus the property. Please call if you have any questions. We are enclosing a copy of the "Letter of Understanding" for this property dated July 19, 2003 that discusses the possibility of the sale of parcel 69 under paragraph eight. The Planner who wrote the "Letter of Understanding" reviewed the request once more this morning and he found that our department would have no objection to the sale of this parcel. Hutton ~ Assistant County Attorney FROM: DATE: March 4, 2004 SUBJECT: Parcel 69 I have received the enclosed correspondence from Karel Foti regarding the intended request to purchase parcel 69. It is my recollection from telephone conversations and research of the property appraiser's records that the County owns a lot that is currently used as a parking area for Nichols Seafood on Conch Key. Ms. Foti has referred to it numerous times as a road, but it is in fact platted as a lot. It does not appear that the County has utilized the lot and probably obtained it through the failure of a tax certificate to be sold. Should there be a request or action to place the lot for sale, it would be beneficial to have a preliminary report from each of your departments as to whether such a proposed sale would negatively impact any of the public concerns with which your department deals. Accordingly, please advise as to whether you have any objection to a proposed sale of parcel 69.
