Dear Dr. Szurek:
As may remember, the 2002 Florida Legislature established a local match formula for the Healthy Kids
program in order to support the continued enrollment of children who do not meet federal Title XXI
funding guidelines. Currently, more than 13,000 children are enrolled statewide utilizing state, local and
family funds under this formula. Participation in this program by counties is voluntary; however, should
a county elect not to provide any necessary funds then currently enrolled non-Title XXI eligible children
in your county would be disenrolled.
The formula prescribed in statute calculates your county's local match based on the proportion of non-
Title XXI expenditures from the Corporation's most recently audited financial statement attributable to
your county. The percentage is then applied to the total amount of match necessary to continue coverage
for currently enrolled non-Title XXI participants. The formula also allows Healthy Kids to award
"credits" to counties in order to recognize your county's in-kind contributions to the Healthy Kids
program as well as other efforts in your county that are child health related.
While not yet approved by the Florida Legislature, the General Appropriations Act (Conference Report
on HB 1835) for the 2004-2005 state fiscal year has been fmalized and published. A final vote is expected
later today, This year's legislation directs Healthy Kids to collect a minimum. of $7 million in local funds
to support the continued enrollment of non-Title XXI eligible children. A preliminary calculation has
been conducted in order to provide each county with notice of the approximate amount of their local
match contribution.
Based on this formula and the preliminary calculation, your county's required contribution for the
2004-2005 fiscal year would be $64,734. This amount can be reduced to $39,734 if your county files
for and receives its full local match credit of $25,000.
As soon as the calculations have been finalized, I will confirm your county's final local match amount.
Included with this correspondence is a copy of our standard request form for local match credit as well as
our standard Financial Agreement for those counties with a local match commitment. If you should have

AGREEMENT
BETWEEN
FLORIDA HEAL THY KIDS CORPORATION "FHKC"
AND
MONROE COUNTY, FLORIDA
BOARD OF COUNTY COMMISSIONERS
This Agreement is made and entered into this _ day of , 2004 by and
between MONROE COUNTY, and the Florida Healthy Kids Corporation, hereinafter called
'FHKC', a Florida not-for-profit corporation under the provisions of Chapter 617, Florida
Statutes.
WHEREAS, the Florida Legislature enacted Chapter 624.91, Florida Statutes, creating
the Florida Healthy Kids Corporation, a Florida not-for-profit corporation organized to facilitate
a program to provide comprehensive health insurance coverage and preventative health care
services to Florida children;
WHEREAS, the 2004-2005 General Appropriations Act and section 624.91 (4)(b)(2),
Florida Statutes requires the FHKC to develop and implement a local match policy for the
continuation of enrollment of non-Title XXI eligible enrollees in the FHKC program;
WHEREAS, FHKC's implementing statute and the 2004-2005 General Appropriations
Act provides for the provision of local matching funds from the participating county through a
specified formula and that said local match must be secured to cover the costs of enrollees who
do not qualify for Title XXI federal matching funds in the participating county by a Financial
Agreement with local contributors to provide the required local match on an agreed periodic
basis;
WHEREAS, NAME has agreed to participate in the FHKC program for MONROE
COUNTY by providing funds to be applied to the local match for MONROE COUNTY for the
continuation of coverage for non-Title XXI eligible enrollees;
NOW THEREFORE, in consideration of the premises and as an inducement to FHKC to
continue a FHKC program for non-Title XXI eligible enrollees in MONROE COUNTY:
I. MONROE COUNTY agrees to provide matching funds for the provision of the FHKC
program in MONROE COUNTY County as follows:
A. MONROE COUNTY agrees to provide local matching funds in the amount of
thirty-nine thousand, seven hundred, thirty-four and no/lOO dollars ($39,734.00)
for the period of July 1, 2004 through June 30,2005.
B. MONROE COUNTY understands that FHKC will continue the enrollment of

non-Title XXI eligible enrollees only in those counties that meet their local match
requirement as specified by the FHKC Board of Directors.
C. MONROE COUNTY agrees to be invoiced on a monthly basis for one-twelfth of
the local match amount listed in paragraph I. A.
D. MONROE COUNTY agrees to remit payment within thirty (30) days of receipt of
an invoice from FHKC.
II. FHKC, in consideration ofthe funds paid by MONROE COUNTY under this Financial
Agreement for the FHKC program, FHKC agrees as follows:
A. To provide comprehensive health insurance coverage to each participant who has
paid the required premium and has met the other eligibility standards for
enrollment established by FHKC.
B. To invoice MONROE COUNTY on a scheduled basis in accordance with
paragraphs I.C. and I.B. Invoice shall be sent to:

III. The Parties agree that the non-payment of local matching funds may result in the
termination of coverage for non-Title XXI eligible enrollees in MONROE COUNTY or
other actions deemed appropriate by the FHKC Board of Directors at the sole discretion
ofthe FHKC.
IV. MONROE COUNTY understands that FHKC will commence the expenditure of state
funds to continue a FHKC program in MONROE COUNTY based upon the assurances
by MONROE COUNTY to provide local matching funds, to assume the responsibilities
and duties set forth herein and to provide the local matching funds in accordance with the
terms hereof. In the event the local matching funds provided herein are not forthcoming
in the amounts and upon the dates scheduled, FHKC is entitled to enforce the obligations
ofthis agreement in accordance with the laws ofthe state of Florida and in such event
shall be entitled to additional reimbursement for its costs and attorneys fees necessarily
incurred in order to enforce the completion of the obligations herein. It is understood that
the intent of this provision is to protect the children who will receive health insurance
benefits through the FHKC program in MONROE COUNTY and who will thereafter rely
upon the continuation ofthe program.
V. The parties agree that the provisions ofthis agreement are not subject to assignment
without the express written consent of the other party.
VI. Any amendments to this Agreement shall be in writing and approved by both parties.

VII. This Agreement shall be in effect from the date of its execution by both parties, and shall
remain in effect until all obligations under this Agreement have been satisfied.
