Turner Construction submitted a proposal for Construction Manager at Risk services
for the Key West International Airport Concourse A and Terminal Improvements

made to Turner, and an injunction, barring the County from re-issuing the competitive
solicitation or awarding the contract to another vendor. On 7/1/21 Turner filed a
Motion for Temporary Injunction and Expedited Hearing. On 7/16/21, the County
filed a Response in Opposition to Turner's Motion. The County filed a Motion
to Dismiss on 7/19/21 which was heard and denied on 7/21/21. County filed its E
answer and affirmative defense to the complaint on 7/23/21. A hearing will be

3. Monroe County v. Atlantic Trash / Magnolia 101, LLC, CA-P 13-945. This case
began as the County's complaint for an injunction and foreclosure of a code
compliance lien. The Court entered a judgment in favor of the County on 5/2/17,
which the Third District Court of Appeal affirmed. The BOCC approved a
settlement agreement proposed by the Defendant(s) on 6/16/21. The
settlement agreement requires the Defendant(s) to convey two of their Key
Largo properties to Monroe County no later than 8/16/21, to pay the County
$400,000 no later than 9/15/21, and to pay the County $344,900 no later than

The trailer park amended their claim again on 7/31/20, arguing that park residents
are at fault and that the County is preempted by state law from enforcing against it.
On 11/11/20, the County filed its motion to amend the counterclaim to add
declaratory relief counts to determine whether the owner or tenants are responsible
for the code violations. On 7/15/21, the County filed a motion asking the Court

property owner is under contract to sell the property and wishes to discharge the
lien. The property owner filed an amended complaint on 6/6/21. The County filed a
Motion to Dismiss on 6/8/21. A hearing was held on 7/26/21 on the County's
