ITEM BACKGROUND:
Monroe County has existing regulations regarding the issuance of contractor certificates of
competency (COC). As of July 1, 2021, the Laws of Florida Chapter 2021-214 prohibits Monroe
County from requiring a person to obtain a license for a scope of work that does not substantially
correspond with a job scope of one of the contractor categories defined in Fla. Stat. § 489.105(3)(a)-
(o) and (q).
Monroe County Code 6-101 requires that one must be licensed to obtain a permit for work on
another person's property. Chapter 2021-214 does not expressly preempt the County's authority to
set conditions for obtaining a permit.
At a regular meeting held on July 21, 2021, the Monroe County Board of County Commissioners
(BOCC) directed the County Attorney to work with the Building and Planning Departments, and the
Contractors' Examining Board (CEB) to develop a solution for the impacts of this new law. The
goal was that these departments and stakeholders would create a process that would allow holders of
certificates of competency impacted by Chapter 2021-214 to continue to work.
Monroe County Code Section 6-240 sets the expiration dates of certificates of competency.
Pursuant to this section, all specialty contractor licenses, affected by Chapter 2021-214, expire
November 1, 2021. By amending this provision of Monroe County Code, the expiration date of
licenses that were active as of June 30, 2021 may be extended to June 30, 2023.
At the July 23, 2021 meeting, the CEB, after hearing from the County Attorney and members of the
industry, adopted a Resolution supporting the extension of the expiration date of specialty licenses,
which were active as of June 30, 2021 and affected by the Laws of Florida Chapter 2021-214 until
June 30, 2023.

CONTRACTORS EXAMINING BOARD
RECOMMENDING THE EXTENSION OF CERTAIN
SPECIALTY CONTRACTORS LICENSES ISSUED BY
MONROE COUNTY, FLORIDA, UNTIL JUNE 30,
2023.
WHEREAS,the Monroe County Contractors Examining Board met on July 23, 2021; and
WHEREAS, at the said meeting there was a discussion of Chapter 2021-214, Laws of
Florida(also referred to as House Bill 735),which became effective on July 1,2021; and
WHEREAS, the new law prohibits local governments, including Monroe County,to require
a person to obtain (emphasis added) a license for a scope of work that does not substantially
correspond with a job scope of one of the contractor categories defined in Fla. Stat. §
489.105(3)(a)-(o)and (q); and
WHEREAS, the expiration date of current licenses are set by Monroe County Code Section
6-240; and
WHEREAS, there is no prohibition for the County to amend its Code to extend existing
licenses,impacted by the new law,to June 30,2023; and
WHEREAS, in order to allow the construction industry time to transition to the new
statutory requirements,a motion was made,seconded, and passed unanimously,for the following
resolution to be promulgated by the Board.
NOW THEREFORE, BE IT RESOLVED BY THE CONTRACTORS EXAMINING
BOARD OF MONROE COUNTY,FLORIDA,AS FOLLOWS:
1. It is recommended that the Monroe County Commission amend Monroe County Code
Section 6-240 to extend the expiration date of active Specialty Contractors Licenses,
issued by Monroe County and affected by the new law,until June 30,2023.
2. It is further recommended that this action be taken at the earliest possible time.
3. The Chair of the Contractors Examining Board is authorized to sign this Resolution.

another person's property. Chapter 2021-214 does not expressly preempt the County's authority to
set conditions for obtaining a permit.

to any other person,property or circumstances.
Section 3: CONFLICT WITH OTHER ORDINANCES. All ordinances or parts of
ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict.
Section 4: TRANSMITTAL AND EFFECTIVE DATE. This Ordinance shall be
filed with the Department of State and shall be effective as provided in Section 125.66(2), Florida
