10 A RESOLUTION OF THE MONROE COUNTY BOARD OF COUNTY
11 COMMISSIONERS EXTENDING THE TIMEFRAME TO JANUARY 9,
12 2022 FOR PERMIT ISSUANCE RELATED TO THE WAIVER OF
13 APPROXIMATELY $18,749 IN BUILDING PERMIT FEES FOR A
14 MULTIFAMILY BUILDING COMPRISED OF FOUR (4) AFFORDABLE
15 EMPLOYEE HOUSING DWELLING UNITS, OF MODERATE INCOME
16 CATEGORY, OR BELOW, PERMIT NUMBER 20101242, TO BE
17 CONSTRUCTED ON A PARCEL LOCATED AT 22936 OVERSEAS
18 HIGHWAY, ON CUDJOE KEY HAVING REAL ESTATE (RE)NUMBERS
19 00186920-000000 AND 00186930-000000.

21 WHEREAS, on November 18,2009 the Monroe County Board of County Commissioners
22 ("Board") passed and adopted Ordinance 036-2009, allowing building permit fee waivers for
23 entities building low income housing leveraging state or federal funds, or affordable housing as
24 defined by state statutes; and
25 WHEREAS, on February 10, 2010, the Board passed and adopted Ordinance 004-2010,
26 allowing waivers for housing for households up to 120% of median income in Monroe County.
27 Housing exceeding 120% may also apply for a waiver if the specific project for development is
28 being subsidized with or is leveraging state or federal funding; and
29 WHEREAS, on March 14, 2020 Christina Weinhofer, Agent for the Applicant Tom Ryan
30 Inc. submitted the Application for Building Permit Fee Waiver. The legislative intent of this
31 Resolution is that the instant waiver shall apply to the building permit applicant of record; and
32 WHEREAS, Monroe County Code Section 6-108(e) allows the Board approval for
33 waivers of building permit fees for affordable housing which have a Development Order in effect;
34 and
35 WHEREAS, on May 20, 2020, the Board passed and adopted Resolution No. 145-2020,
36 approving a building permit fee waiver of approximately $18,749 to construct a multifamily
37 building comprised of four (4) affordable two bedroom, one and one-half bathroom moderate
38 income housing units at 22936 Overseas Highway on Cudjoe Key, with the condition that

39 evidence of an Affordable Housing Deed Restriction accepted and/or approved by both the Senior
40 Director of Planning & Environmental Services and the Office of the County Attorney and
41 recorded in the Public Records of Monroe County, Florida shall be provided to the Building
42 Department and said permit is issued no later than June 1, 2021; and
43 WHEREAS, on November 17, 2020 the Board passed Resolution 398-2020 which
44 provided an additional 180 days for certain ROGO allocation awards due to the impacts of
45 COVID-19, which provided additional time for associated building permit 20101242 to be issued
46 until January 9, 2022;

48 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
49 COMMISSIONERS OF MONROE COUNTY, FLORIDA,THAT:
50 The foregoing recitals are true and correct and are hereby incorporated as if fully stated
51 herein; and
52 Building permit fees are waived pursuant to Monroe County Code Section 6-108(e) for the
53 multi-family building comprised of the four(4)affordable housing units described herein with the
54 condition that evidence of an Affordable Housing Deed Restriction accepted and/or approved by
55 both the Senior Director of Planning & Environmental Services and the Office of the County
56 Attorney and recorded in the Public Records of Monroe County, Florida shall be provided to the
57 Building Department and said permit(s) is/are issued no later than January 9, 2022.
58 PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
59 Florida, at a regular meeting held on the 18l" day of August, 2021.
