FOR MARATHON TAX COLLECTOR BUILDING SEAWALL REPAIRS In accordance with the Consultant Agreement for Professional Architectural and Engineering Services, made and entered into on December 19, 2018 between MONROE COUNTY, ("County") and CPH, INC., ("Consultant"), where professional services are allowed if construction costs do not exceed $4,000,000.00, or for study activity if the fee for professional services for each individual study under the contract does not exceed$500,000.00 ("Agreement"), as provided in Subsection 287.055(2)(g),Florida Statutes, as amended by Section 2, Chapter 2020- 127, Laws of Florida, pursuant to which Attachment A, Subsection 1.01 of the Agreement is hereby modified, the parties enter into this Task Order. All terms and conditions of the Agreement apply to this Task Order, unless this Task Order amends, adds, or modifies a provision or an Article of the Agreement of which will be specifically referenced in this Task Order and the amendment, addition, or modification shall be precisely described. This Task Order is effective on the 18fh day of August 2021. WHEREAS, the Marathon Tax Collector Building was severely damaged during Hurricane Irma resulting in extensive repairs needing to be performed including repairs to the seawall located behind the building; and WHEREAS, the County desires to contract with the Consultant to provide design through construction administration services for the repairs to the seawall. NOW, THEREFORE, in consideration of the mutual promises and covenants set forth below, the parties agree as follows: 1. In accordance with Article II, SCOPE OF BASIC SERVICES of the Agreement, the Consultant will provide design and support through construction for the repair of the seawall. The scope of work shall include but not be limited to the following: • Task A—Preliminary Design Services o A.1 Topographical Survey - Perform a Topographic Survey per Chapter 5J-17, Florida Administrative Code in compliance with the Standards of Practice of Surveying and Mapping of the State of Florida. ■ Data will be collected from the building wall to approximately 20 feet out from building along the 120 linear foot line. ■ Location of existing visible above ground improvements & visible utilities within scope. No underground utility designation will be provided as part of this scope. ■ Provide Mean High Water (MHW) elevation contour per Florida Department of Environmental Protection (FDEP) correspondence. ■ Provide one (1) cross-section in the canal within topographic area. Page 1 of 4 ■ Locate edge of mangroves as marked by CPH Environmental Department. ■ Signed and sealed Topographic Survey. ■ The project coordinate system will be based horizontally on the North American Datum 83 (NAD 83). The project will be referenced to state plane coordinates by field locating published control points. The National Geodetic Survey control points will be researched and verified in the field. This base of reference will be used to establish the coordinate system for the project. ■ The project will be based on the North American Vertical Datum 88 (NAVD 88). The project will be referenced to these published elevations by field locating published benchmarks. The National Geodetic Survey benchmarks will be researched and verified in the field. o A.2 Environmental Report - Consultant shall conduct an environmental survey and document the resources within, and adjacent to, the project area. Consultant will schedule and attend one (1) pre-application meeting with the Florida Department of Environmental Protection (FDEP) and the United States Army Corps of Engineers (USAGE). CPH Environmental staff will coordinate with the Project Engineer to produce Dredge & Fill permit sketches (4 plan views and cross sections)to accommodate the Civil design. o A.3 Geotechnical Report - Consultant will utilize a sub-consultant for geotechnical services. The geotechnical field work will include two (2) standard penetration tests down to a depth of 30 feet to determine the local soil parameters. The report will include an analysis of the soils, seasonal high groundwater elevation, and summary of classification of soils. The report will be delivered to Monroe County for its records. Additional scope and quote of services from Universal Engineering Sciences will be attached for reference. • Task B —Design Development - Consultant will schedule and attend pre-application meeting with FDEP, USAGE, and City of Marathon to determine permitting requirements for the project. Based on this preliminary meeting, Consultant shall commence on the design- incorporating recommendations from the permitting agencies. The schematic design will include Site Plan, Grading Plan, structural details and typical sections. The schematic design will be presented to the Monroe County Project Manager for review. Scope includes one revision to schematic design prior to submittal to permitting agencies for general layout modifications. Consultant shall prepare schematic design plans for the seawall and canal improvements per the approved FEMA Hazard Mitigation Proposal (HMP), as outlined below. 0 120 LF of(15') Sheet Piles o Concrete Caps o Tie Rods 0 6' Timber Blocks o Rip Rap Stabilization • Task C — Permitting and Construction Documents - Consultant shall submit schematic design plans to all permitting agencies, including but not limited to: Florida Department of Environmental Protection (FDEP), United States Army Corp of Page 2 of 4 Engineers (USAGE), City of Marathon, Monroe County, South Florida Water Management District(SFWMD), etc. o Scope of work includes up to two plan revisions per agency and response to all requests for information (RFI). Consultant shall obtain and keep records of all associated permits for the project. o After all permits are obtained, Consultant shall prepare Construction Documents including project specifications and permit conditions. Consultant will incorporate Monroe County and City of Marathon specifications into plan set and bid package. Construction Documents will include full electronically Signed and Sealed plans for bid,all permits and documentation for construction activities,bid specifications, bid tabulation, and an Opinion of Construction Costs. • Task D—Bidding Services and Construction Observation o Consultant will attend one pre-bid meeting and one on-site pre-bid meeting at the Client's request to answer any immediate questions from potential bidders. Consultant will respond to all Requests for Information (RFI) from bidders and issue up to one bid addendum at the request of the Client. o Consultant shall review shop drawings, respond to RFIs, issue field change exhibits, and produce plan addendums to address major RFIs. Consultant will coordinate with Contractor on progress of project and perform site visits as needed to verify field conditions. o Consultant shall review, evaluate, and issue responses to all change order requests. o Consultant shall perform substantial walk, generate punch list, and perform final walk of site to certify completion of construction. o Consultant will review as-builts,prepare close-out documents, and coordinate with permitting agencies to finalize construction activities. 2. In accordance with Article VII paragraph 7.1.1 of the Agreement,the County shall pay the Consultant a not-to-exceed total of Seventy-Seven Thousand Three Hundred Five and 00/100 dollars ($77,305.00)paid on a percent complete basis for the following phases: a.
