County by Warranty Deed.
ITEM BACKGROUND: On January 26, 2005 the Planning Commission approved an allocation award for the
applicants listed below provided the applicants' Warranty Deed is approved by the BOCC. Gary & Rita Swain
submitted the Warranty Deed to donate two lots to Monroe County. The applicants are receiving a dwelling unit
allocation award for the year ending July 13, 2005, have filed the document in accordance with Ordinance No. 47-
1999.
PREVIOUS RELEVANT BOARD ACTION: On November 11, 1999, the BOCC adopted Ordinance No. 047-
1999.

WARRANTY DEED
THIS INDENTURE made this day of , 200 ~ between Gary Swain and Rita Swain,
a married couple, ("GRANTOR(S)") whose post office address is 162 Galleon Lane, Cudjoe,
Key, Florida. 33042, and Monroe County, a political subdivision of the State of Florida
("GRANrEE"), whose address is 500 Vlhitehead Street, Key West, Florida, 33040.
WITNESSETH
That said Grantors, for and in consideration of the sum ofTEN and OOIlOOths ($10,00) Dollars
and other good and valuable consideration to said Grantors in hand paid by said Grantee, the
receipt whereof is hereby acknowledged, have granted, bargained and sold to the Grantee and
Grantee's heirs and assigns forever the following described land located in the County of

TOGETHER, with all tenements, hereditaments, and appurtenances thereto belonging or in
otherwise appertaining, and TO HAVE AND TO HOLD the same in simple fee forever. The
Grantors hereby covenant with said Grantee that the Grantors are lawfully seized of said land in
fee simple, that the Grantors have good right and lawful authority to sell and COllVey said land,
and hereby warrant the title to said land and will defend the same against the lawful claims of all
persons whomsoever; and that said land is free of all encumbrances, except taxes accruing
subsequent to the date of transfer.
