Florida 33050 November 14,2005 Dear Mayor Spehar and Commissioner Rice: This letter will address the issue concerning the Board of County Commissioners desire to fund approximately $100,000 for a main extension to be located in public rights of way and connected to the utility system operated by KW Resort Utilities, Inc. (.'KW Resort") or Stock Island. After reviewing the agreements previously entered by the COWlty and KW Resorts, and based on my knowledge of Florida public utility law as well as ex.periences representing both public and private attitudes, it is my recommendation that I be authorized to approach the KW Resort owners with a proposal that an agreement be entered (possibly as an amendment to the existing agreement between the panies) which provides the following: 1. That the County will provide the funds necessary to construct the main extension; 2. That the County will acknowledge ownership by KW Resort of the main extension; 3. That KW Resort will refund to the County a portion of the service availability charges collected from the immediate customers to be served via the main extension. with the amount of such refund per connection to be negotiated; 4. That KW Resort pay additional refunds to the County for every connection in the future made to the main constructed with County tUnds. S.
