Resolution No. 320-2005 for propt;ny owners wmin~ to provide at least 30% of tbe total redeveloped units
for affNdablt; housing by placing a 99 year Iegl:ric~ive CDvenant Oll each unit; and
""HEREAS, Sectioll 2 of Resolution No. 320-2005 provirles lhat the ordinanc~ shall stand repealed
until new land developmeFll regulations arc adopted or the passage of 180 days after the adoption of

WHEREAS, the initial l(;xt amendmeut was presented to the Planning Commis.sion ill August 10

affocdable housing for the County workforce at its meeting ofJanwuy 19. 2005; and
WHJ:.RJ:AS, the eximing supply of employee and affordabJe housing is insufficient to
meet the oorrenJ demand for affordable workforce b.ousjn~ and
WHERI'..AS~ the Rate of Growth Ordinance (ROGO) limits the permEts for new
houstng allocations in the County to maintai n hurricane evacuation times; and
WHEREAS, the loss of existing affordable housing throogh redevelopment is reducing
the available wpply of!iollCh housing for the County workfott.e: and
WHEREAS,. Objective 601.3 of the 2010 Comprehensive Plan directs the County to
implement efforts to eliminate .'lUb5~ hoo.sing and to presene. conserw and enhance the
eristing hmlsing stoc!r.. and
W Ul:REAS, affordable/employee housing bas been identified by the Board of County
Commjssioners as one of three major commitments in lhe Partnersmp Agreement with the
State approved by the Board on January 21> 2004 ~ and
WHEREAS. multi-family rental housing and mobile home pMks in the County serve 3
vitaa role in providing affordable wOTkforce housing for- tbo5e peIWll5 who live lUld work in the
County; and
WHEREAS, economic pressure Ii increa5in~ to convert the existing multi~f!lmily
rental housing and mobile home parks to differem bousing types that are no longer affordable
for County workforce; and
WHEREAS, a number of owners of this bousing are e;J(ploring the possible change of
U5C of their propen)', which will furtller decrease the existing supply of affordable and

DEVRLOPMENT requires the Cowrty to conduct programs and regulatory activities to

WHEREA~ in order to makt effective the prnservatlon of existing affordable housing
whilt the County pTepares regulations to implement the Objective and Guiding PrillCipJe of
Florida Statute See 3800S52(7)(j), it is necessary to temporarily hah COfIvmions and
redevelopment of existing multi-filmiJy l10using and/or mobile h.ome parks of ten (10) or more
units and cl:langc!l of Land Use District Zoning Map De5ignatJOns ftom lJ RM and URM- L~ and
WHEREAS, the Board of Coumy Comm i ssioners recogruzes the need to develop land
development reguJations and programs to preserve the exi Sling stock of affo.rdabJe housing and
increase the a\'ailability ofaffordable housing for those who live and work: In the Florida Keys;
and
WHEREAS" the "Pending Ordinance Doclrine" notice WL'l advertised in the Key West
Citizen (21 l6!2005). the Keynoter (2) 19/200:5), and the Reporter (2I! 8/2005), and several
public hearings were held concerning its application retroactive to March I. 2005;
NOW, THEREFO~ BE IT RESOLVED BY TIlE MONROE COUNTY
BOARD OF COUNTY COMMISSIONERS.:
