Roy's Trailer Park v. Monroe County
Cases of Interest at Trial Court Level

1. Turner Construction Co. v. Monroe County BOCC, 21-CA-414-K (filed 6/14/21). E
Turner Construction submitted a proposal for Construction Manager at Risk services
for the Key West International Airport Concourse A and Terminal Improvements
Program. Turner filed a bid protest in connection with the BOCC's decision at the
5/19/21 meeting to reject all bids and re-advertise the Request for Proposals, and
then filed this action. Turner seeks a declaration, that the award should have been
made to Turner, and an injunction, barring the County from re-issuing the competitive E
solicitation or awarding the contract to another vendor. On 8/31/21, Judge Koenig
took the matter under advisement after a bench trial.
2. Monroe County v. Estate of Jerome Pfahning, 15CA214K. This is a foreclosure
action arising from several code compliance liens on two adjoining parcels on Stock
Island. The parties have reached a tentative settlement. Staff will bring the
settlement agreement to the BOCC at its October 2021 meeting.
3. Monroe County v. Atlantic Trash / Magnolia 101, LLC, CA-P 13-945. This is a code
compliance lien foreclosure action. The County prevailed at trial and on appeal. The
BOCC approved a settlement agreement proposed by the Defendant(s) on 6/16/21.
Per the settlement agreement, Magnolia conveyed two of their Key Largo
properties to Monroe County by 8/16/21. Magnolia must pay the County
$400,000 no later than 9/15/21 and pay the County $344,900 no later than 120
days after payment of the $400,000.00. The trial court will retain jurisdiction of the
case until the terms of the settlement are satisfied.

4. Sunset Garden Estate Land Trust v. Monroe County, CAP 19-460. Property owner
filed a two-count complaint alleging that various state laws including the Right to
Farm Act, F.S. 823.14, preempt the County's land development regulations from
applying to its parcel and seeking judicial declarations that its alleged agricultural
activities are immune from the County's land development regulations. On 2/27/20,
the Plaintiffs filed a second amended Complaint. The County filed an answer on
6/29/21.
5. Roy's Trailer Park v. Noel & Monroe County, 19-CA-175-K(lower tribunal: CC-K-18-
112). Declaratory Judgment suit filed by Roy's against County as part of its eviction
suit against its tenant. On 10/4/18, the County countersued the trailer park and the
park residents, seeking an injunction prohibiting occupancy at the park until serious
fire and life safety issues have been addressed, and for appointment of a receiver.
The trailer park amended their claim again on 7/31/20, arguing that park residents
are at fault and that the County is preempted by state law from enforcing against it.
On 11/11/20, the County filed its motion to amend the counterclaim to add
declaratory relief counts to determine whether the owner or tenants are responsible
for the code violations. On 7/15/21, the County filed a motion asking the Court to
refer this case to mediation. On 8/5/21, the County took the deposition of the
park owner's principal, Michael Browning.
6. KITK, LLC v. Monroe County, CAP 19-351. Property owner filed a Complaint
seeking a judicial declaration that F.S. 419.001(12) preempts Monroe County's land
development regulations from prohibiting, on its allegedly residentially zoned �?
property, its alleged community residential home of six or fewer residents. On
10/6/20, the County filed its answer. The plaintiff and the County have engaged in
settlement discussions and anticipate reaching a settlement.
7. Maschal et al. v. Monroe County and FKAA, CA K 19-186 — Suit against Monroe
County and FKAA by Banks Prevatt and 11 other individuals seeking similar relief to )
the Delaney lawsuit, which the County won. The Court has dismissed Counts I and
II (declaratory relief and mandamus) with prejudice, but gave the Plaintiffs' leave to
amend as to Count III, equitable estoppel. On 1/4/21, Plaintiffs filed a Second
Amended Complaint. The County's motion to dismiss will be heard on 9/30/21.

8. Burke Construction Group, Inc. v. Monroe County, CA-M 19-80 - On 7/11/19, Burke
Construction Group sued to challenge the County's bid protest procedure and
decisions to award contracts for the Marathon Library and Cudjoe Fire Station
projects to other contractors. On 8/31/21, the Court took the County's motion to
dismiss under advisement.
9. Howard McClurd v. Ulises Rojas, Monroe County et al., 20-CA-352-P. Plaintiff
alleges that he bought a property located at 241 Hispanola Rd., Tavernier, FL, from
Ulises Rojas in 2019, but that the seller did not disclose to McClurd a 2018 letter
from the County Building Official that the property had suffered substantial damage
during Hurricane Irma and would need to be brought up to the County's floodplain
ordinances and the Florida Building Code. In his Amended Complaint, Plaintiff
added a declaratory relief claim against the County. The County's motion to
dismiss was heard and granted on 8/11/21. The plaintiff filed an amended
complaint. The parties have a mediation on 10/26/21 and a trial date in March 2021.

10.Monroe County v. Purdue Pharma L.P. et al., No. 4:19-cv-10049. This case was
filed by Monroe County against opioid manufacturers/marketers and distributors on
4/3/19. The complaint seeks damages including punitive damages, attorneys' fees,
costs, and injunctive relief. The case is part of multi-district litigation under a judge
in Cleveland, Ohio. On 7/15/19, the County filed its initial statement describing
damages. The case is at the early discovery stages. The parties are in settlement
discussions with the distributor defendants and Johnson & Johnson. Three of the
other manufacturer defendants (Purdue Pharma, Insys and Mallinckrodt) have filed
bankruptcy. The County has filed claims in the bankruptcy cases. Counsel
representing local governments and the Attorneys General for states in the national
litigation have come to a preliminary point of view regarding a potential formula for
distribution of settlement proceeds. Staff will be bringing forward an item on the
9/15 agenda to approve a resolution laying out the settlement formula and also
to update the BOCC on the status of the bankruptcy cases. The overall
settlement amount and final settlement documents will be brought back to the )
BOCC at a later date.

11.Monroe County v. Sugarloaf VFD, Inc. & Sugarloaf Wi-Fi, Inc. , CAK 17-631. The
County sued both SVFD and Wi-Fi to invalidate a lease between SVFD and Wi-Fi
on the grounds that SVFD had not approved the lease in an open meeting. The trial
court ruled in favor of the County and voided the lease. Wi-Fi appealed and lost.
On 1/31/21, the County filed a motion for attorneys' fees to recover attorneys' fees
and costs from SVFD as the prevailing party. Mediation between Wi-Fi, the SVFD,
and the County was held on 7/27/21 during which WiFi and the County agreed to
meet directly to discuss settlement options. The Court has retained jurisdiction to
hear the County's motion for fees and costs.
Appellate Cases of Interest
12.AshBritt, Inc. v. Monroe County & FDOT Third DCA Case 3D20-553 (lower tribunal: )
16t" Jud. Cir. 17-CA-802-K). AshBritt sued the County for breach of contract and
for breach of implied covenant of good faith and fair dealing. The County answered
and moved for summary judgment (MSJ). On 2/24/20, Judge Koenig denied the
County's MSJ. On 3/23/20, the County filed an appeal from that order in the Third
DCA. The case has been fully briefed. Oral argument was held on 3/10/21. Awaiting
a decision.
13.Monroe County & State of Florida v. Donald Davis (Collins), Third DCA Case Nos.
3D20-1762 and 3D21-1078. The County and State were found liable for the inverse
condemnation of Davis' property. The County satisfied the $347,475 judgment on
11/22/19, leaving only the issue of attorneys' fees and costs to be litigated. On
4/6/21, the trial court entered an order approving a settlement agreement between
Davis, the County, and the State on the issue of fees and costs, denying Tobin and
Mattson's motion to be added as parties to pursue an additional award of fees
against the County and State, and closing the case. On 5/5/21, Tobin and Mattson
filed an appeal of that order. Their brief is due on 9/13/21.

14.KRZ, LLC v. Monroe County, 20-AP-41-K. On 12/18/20, the property owners filed a
notice of appeal of the 11/19/20 Final Order of the Special Magistrate that found it in
violation of land clearing and filling standards in the Land Development Code.
Appellant filed its initial brief on 2/16/21. The County filed its answer brief on 5/24/21.
On 5/26/21, the County also filed a motion to strike Appellant's notice of
supplemental authority. KRZ filed its reply brief on 6/23/21. Oral argument is
scheduled for 9/10/21.
15.Galleon Bay Corp. v. Monroe County and State of Florida — CA K 02-595/ 3D19- N
1783 / SC21-409. This takings case resulted in a final judgment in the amount of
$480,511. A Satisfaction of Judgment was issued. Galleon Bay's motion to
invalidate the final judgment was denied by the Circuit Court on 8/16/19. On 9/13/19,
Galleon Bay appealed that order to the Third DCA. On 10/18/19, Monroe County
and the State moved to dismiss the appeal, which the Court agreed to carry with the
case. On 12/2/20, the Third DCA issued an Opinion affirming the order of the trial
court. The court also denied Galleon Bay's motion for attorneys' fees. Galleon Bay
filed an appeal of the Third DCA's decision to the Florida Supreme Court on 3/17/21.
On 3/29/21, Galleon Bay filed a motion for a 60-day extension of time to file its
jurisdictional brief; the motion was granted on 4/14/21. Galleon Bay filed its
amended jurisdictional brief on 6/3/21. The County and State filed their jurisdictional
brief on 6/30/21. On 8/9/21, the Florida Supreme Court issued an order
declining to exercise jurisdiction. On 8/12/21, the County served discovery on �?
the remaining issue of attorneys' fees.

16.Haim v. Monroe County et al., 4:20-cv-10058-KMM (S.D. Florida) (11t" Circuit Appeal
20-13271-AA). This is a challenge to the emergency directives establishing the US1
COVID checkpoint in the Spring of 2020. The County removed the case to Federal
Court on 6/5/20 and moved to dismiss. On 8/17/20, the Court dismissed the case )
and the Plaintiffs appealed to the 11 t" Circuit. All parties filed their briefs as of 2/5/21.
On 5/27/21, County filed Governor's E.O.s 21-101/21-102 as supplemental
authority, notifying the Court that the COVID checkpoint was not capable of
repetition. On 8/19/21, the Court directed the parties to file supplemental briefs
on a narrow issue. The Haims' filed their brief on 8/30/21; the County
supplemental brief is due 9/8/21. Oral argument is set for 9/24/21 in Miami.
17.William Guy v. Monroe County, 19-AP-3-P. On 1/31/19, property owners found in
violation of the land clearing standards in the Land Development Code by the
Special Magistrate filed this appeal to the Circuit Court. Appellant filed his initial brief
on 3/15/21. County's answer brief was filed on 6/28/21. The reply brief was filed
on 7/27/21. On 7/27/21, Appellant also filed a motion to file a complaint to further
adjudicate constitutional issues. On 7/29/21, the County filed a response in
opposition to that motion; no ruling on that motion has been issued. Oral argument
is scheduled for 9/3/21. Appellant has filed a motion to continue the oral
argument.

18.Atlantic Circle, LLC v. Monroe County Planning Commission, 2020-CA-48-P. The,
Petitioner is seeking to quash a Planning Commission Resolution that approved with
conditions the request by Randolph Wall for a variance of 5 feet from the required
25-foot primary front yard setback and a variance of 10 feet from the required 20-
foot rear yard setback. Briefing was completed on 8/7/20. Awaiting a decision.
19. Jill Patterson et al. v. Monroe County, 21-CA-139-R On 4/2/21, a group nearby
property owners filed a Petition for Writ of Certiorari seeking to reverse the decision
of the Planning Commission approving Resolution PO4-21, which granted a Major
Conditional Use permit to applicant Southcliff Estate Employee Housing, filed by
Frank Pla on behalf of the property owners. The County will defend on various N
grounds.
20.Edwin and Janice Handte v. Monroe County, 20-AP-6-K. On 9/25/19, Planning
Director denied property owners' application to be considered exempt from the
Land Development Code's vacation rental special permit and manager license
requirements. On 7/31/19, the Planning Commission denied property owners'
appeal of the Planning Director's decision. On 7/6/20, a DOAH hearing officer
denied the owners' appeal. Property owners appealed to the Circuit Court on
7/23/20. Oral argument was held on 4/14/21. The Circuit Court issued an appellate
opinion affirming in favor of the County on 6/29/21. On 7/27/21, the property
owners filed an appeal to the Third DCA (Case No. 21-1527).

21.Ricky Hill & Jayne Hill v. Monroe County, 20-AP-0004-P. On 9/22/20, property �?
owners found in violation of the land clearing standards in the Land Development
Code by the Special Magistrate filed this appeal to the Circuit Court. Appellants'
initial brief is due 9/13/21.
22.Jacquelyn Bello v. Monroe County, 21-AP-0003-P. On 5/5/21, the property owner
filed a notice of appeal of the 4/6/21 Final Order of the Special Magistrate that found )
her in violation of LDC Section 110-140(c) for converting a utility shed into a guest
house without a permit. Appellant was granted an extension of time until0.
10/12/21 to file her initial brief.

Administrative Cases of Interest
23.FKAA v. FDEP & Florida Power & Light, — DOAH Case Nos. 20-2967 (consolidated ca
with 20-2968, Florida Fishing Guides Ass'n v. FPL). The FKAA filed an
administrative petition challenging DEP's intent to issue a National Pollution E
Discharge Elimination System (NPDES) permit to FPL to operate treatment and
disposal facilities at Turkey Point Power Plant. The County intervened in support of
the FKAA. The final hearing was held in January 2021. Both sides filed proposed
recommended orders on 5/17/21; awaiting decision of the administrative law
judge.

24. Lower Density for Lower Sugarloaf, LLC, et al. v. Monroe County Planning
Commission, DOAH 21-494. On 2/5/21 a group of property owners neighboring the
proposed affordable-employee housing development filed an appeal to DOAH,
seeking to quash or reverse the Planning Commission's granting of a Major
Conditional Use permit to applicant Lower Keys Community Center Corp., and also
on 2/5/21 filed a parallel appeal of Resolution No. P36-20 to the BOCC sitting as an
appellate body under Chapter 139 of the Land Development Code. On 3/22/21, the
DOAH ALJ granted the developer's motion to intervene. The appellants on 4/6/21
filed a motion for the DOAH ALJ to stay the DOAH proceeding, which the DOAH ALJ
denied on 4/26/21. After argument on 7/13/21, the ALJ issued a final order onCD
7/22/21, upholding the Planning Commission's decision to approve the
project's major conditional use permit.
25.Diane Beruldsen, et al v. Monroe County, DOAH 21-1657GM. Administrative petition
challenging Ordinance 05-2021, amending Comp Plan to authorize 300 early
evacuation ROGOs that are to be used as exchange for existing affordable ROGOs
was filed on 5/21/21. The reclaimed ROGOs would be used for administrative relief.
The challenge is being held in abeyance until the related Cities' challenge is resolved
by the Third District in Case No. 3D20-1921.
26.Sergio Velikopoliski v. Monroe County Planning Department. On 4/9/21, the property
owner filed an appeal to the Planning Commission of the Department's denial of its
building permit application (#17305163)for the completion of a single-family dwelling �?
unit at 180 Pompano Drive, Key Largo, FL(Parcel ID 00552670-000000). The denial
was based on setback and shoreline open space requirements under the current N
land development code. Appellant is asserting that he only needs to comply with the
requirements that existed at the time construction was permitted (but never
completed) in the 1990's. The appeal is tentatively scheduled for hearing at the
Planning Commission's meeting in September. )

27.Elk Investments of Miami v. Monroe County Planning Department. On 7/6/21, the
property owner filed an appeal to the Planning Commission of the Department's
6/14/21 letter of understanding regarding the proposed development of a residential
dwelling unit at its vacant property in the URM Land Use District in Key Largo, FL
(Parcel ID 00489136-018717). The Department determined that the property does
not meet the definition of"lot" and does not meet the requirements of the URM Land
Use District in order to allow the development of a residential dwelling unit. The
owner is arguing that the decision is confiscatory. The appeal is tentatively
scheduled for hearing at the Planning Commission's meeting in September.

Vacation Rental Cases
28. Thurmond Street Partners, LLC v. Monroe County, Florida, 18AP10-K & 18AP11 K;
Third DCA Case 3D19-2367. Appeal of 2018 finding by Code Compliance Special
Magistrate that Thurmond Street Partners vacation wedding use violated Section
130-94 of the Code. The property owner appealed to the Circuit Court, which
reversed the Special Magistrate's decision on 11/6/19; which the County appealed
to the Third DCA on 12/6/19. The Third DCA stayed the case until 1/17/22 at the
request of the parties. On 12/15/20, the property owner and County staff held pre-
application conferences. Letters of Understanding resulting from the parties' pre-
application conferences were issued on 2/18/21. The property owner filed its tier
amendment application on 3/15/21. The property owner has until 9/17/21 to file
rezoning and future land use map change applications.
29.Buttonwood Key Largo v. Monroe County, 21-CA-0068-P. On 2/16/21, Buttonwood
filed a complaint seeking declaratory and injunctive relief, including a declaration of
whether the six-room former hotel is entitled to vacation rental permit exemptions
pursuant to LDC Section 134-1(b)(1) (despite the fact that Buttonwood's applications
for such exemptions were denied on 12/18/20, and the denials were not appealed),
and an injunction against code enforcement. The County filed its answer on
4/23/21, and has since served discovery requests. A deposition of the
corporate agent is scheduled for 9/27/21. Also pending in the Circuit Court is a
consolidated appeal of the Final Orders rendered by the Code Enforcement Special
Magistrate on 10/31/20, Buttonwood Key Largo v. Monroe County, 20-AP-0009-R
In that case, on 3/24/21, the court entered an Agreed Order Abating Appeal pending
the outcome of the circuit court action on the complaint seeking declaratory and
injunctive relief.
30.Sirena Key, LLC v. Monroe County, CAP 18-704. On 9/21/18, Sirena Key sued
seeking to declare that the vacation rental ordinance is preempted by state law due )
to alleged changes in the County's enforcement practices. On 6/26/20, the Court
granted the County's motion for summary judgment on Counts I and II. The parties
are proceeding with discovery on the amended count III. The County filed a motion
for summary judgment on amended count III on 8/20/21 and is setting that
motion for hearing. Also pending in the Circuit Court is an appeal from the Special
Magistrate's decision finding Sirena Key in violation of the vacation rental ordinance,
Sirena Key, LLC v. Monroe County, 18-AP-3-K. In this case, the Appellant Sirena
Key filed a motion to stay the appeal pending resolution of the 16t" Judicial Circuit
Case. Over objection from the County, the Court granted the motion and stayed the
appeal until further order of the Court. There will be no movement on the appeal
until the Circuit Court case is concluded.
31.Coral Hammock Rental, et al. v. Monroe County, 20-AP-11-K. On 10/29/20, the
Special Magistrate heard 47 vacation rental violation cases arising from Coral
Hammock, found 45 properties in violation, and assessed fines of $224,329 plus
costs. Twenty-Six of the 45 property owners found in violation appealed the final
order to the Circuit Court. Following a 2/18/21 hearing on appellants' motion to
consolidate, the appeals were consolidated for purposes of briefing common issues
of law. Appellants filed their initial brief on 6/4/21. The County's answer brief is
due 9/20/21.

Constitutional Officer Cases
32. Heather Carruthers v. Eddie Martinez, Joyce Griffin, and MC Canvassing Board, 20-
CA-000749-K. On 11/23/20, former commissioner Carruthers filed an election
contest suit challenging the results of the District 3 BOCC seat race. The County
Attorney's Office filed an answer on behalf of the SOE and the Canvassing Board
on 12/07/20. On 6/2/21, Carruthers filed a Motion for Summary Judgment, which is
scheduled to be heard on 9/27/21, before Judge Jones.

33. League of Women Voters of FL v. Sec'y of State Lee, Joyce Griffin, et al, 4:21-cv-
00186, USDC/NDFL. Claims for injunctive and declaratory relief against Secretary
of State, the FLAG, and the Supervisors of Election for all 67 counties, challenging
SB 90, the recently enacted elections legislation. Griffin and other SOEs retained
outside counsel. The County Attorney's Office is assisting in the defense. Plaintiffs
filed a Corrected First Amended Complaint and Griffin's answer was filed on
8/13/21. Discovery is ongoing. The three Federal Court cases shown below filed
also challenging the newly enacted SB 90 on various points. Supervisor Griffin has
also now been specifically named as a defendant in those cases. All four cases
have been consolidated and discovery is to conclude by 10/22/21 and a bench trial
is scheduled for 1/31/22.

34. NAACP of FL v. Sec'y of State Lee, Joyce Griffin, et al, 4:21-cv-00187,USDC/NDFL. �?
Claims for injunctive and declaratory relief against the Secretary of State and the
Supervisor of Elections for all 67 counties, challenging SB90, the recently enacted N
elections legislation and raising some additional constitutional claims. This case has
been consolidated with the above League of Women Voters case and is being
handled by the same outside counsel. The County Attorney's Office continues to
provide assistance in the defense. Griffin's Answer was filed on 8/13/21. )
Discovery is ongoing.
35.Florida Rising Together, v. Sec'y of State Lee, Joyce Griffin, et al, 4:21-cv-201,
USDC/NDFL. Claim for injunctive and declaratory relief against Secretary Lee and
the Supervisor of Elections for all 67 counties, also challenging SB90 and asking to
impose a "pre-clearance" requirement on defendants which would require all
changes in election laws and procedures to be submitted to the U.S. Dept. of Justice
for pre-approval. This case was also consolidated with the above League of Women
Voters case and is being handled by the same outside counsel, with the County

36.Harriet Tubman Freedom Fighters v. Secy of State Lee, FLAG Moody, Joyce Griffin,
et al, 4:21-cv-242, USDC/NDFL. Plaintiffs filed an Amended Complaint on 7/15/21,
which named Joyce Griffin and only a limited number of other Supervisors of
Elections in the counties where Plaintiffs vote by mail. This case challenges only
the new requirements of SB90 applicable to third-party voter registration
organizations. This case was also consolidated with the above three cases and the
same outside counsel retained, with the County Attorney's office assisting. Griffin's
Answer is due 9/14/21. Discovery is ongoing.
