A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA
APPROVING THE TRANSFER OF $269,684.83 IN FUNDS
RECEIVED FROM THE STATE OF FLORIDA IN THE
MATTER OF GALLEON BAY V. MONROE COUNTY &
STATE OF FLORIDA,CASE NO. CAK-02-595.
WHEREAS, On May 26, 2016, a Final Judgment was entered in favor of Galleon Bay, finding
Monroe County and the State of Florida liable for the inverse condemnation of Galleon Bay's
property on Big Pine Key, FL, in the amount of$480,511.60, inclusive of prejudgment interest
through June 1, 2016, plus statutory interest thereafter; and
WHEREAS, The Final Judgment was affirmed by the Third District Court of Appeal; and
WHEREAS, On September 19, 2019, the Monroe County Land Authority deposited $539,369.67
into the Court Registry to satisfy the Final Judgment on behalf of the County and the State; and
WHEREAS, the State subsequently reimbursed the County $269,684.83 for its 50% share of the
Final Judgment that the Monroe County Land Authority paid; and
WHEREAS,that $269,684.83 is currently being held by the Clerk; and
WHEREAS, the Board desires to reimburse the Monroe County Land Authority the $269,684.83
it received as reimbursement from the State, which represents fifty percent of the sum the Land
Authority advanced on behalf of the County and the State when satisfying the Judgment;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY,FLORIDA:
1. The clerk is directed to transfer$269,684.83 from the Monroe County Board of
County Commissioners to the Monroe County Land Authority.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida,
at a regular meeting held on the I5°i day of September 2021.
