ITEM BACKGROUND: Sunset Point Park is located at 20 Sunset Road in Key Largo, Florida. The proposed Ordinance would amend Chapter 18, Parks and Recreation, Monroe County Code, Sections 18-3(b)(8), 18-27(a), 18-27(1(1), and 18-27(m(5)n. by removing the name of"Sunset Point Park" and replacing it with"Mike Forster Memorial Park" in each of those sections. All other Code sections remain the same. The proposed new name is intended to solve a recurring traffic problem in the Sunset Point neighborhood and honors the memory of the late District V Commissioner Mike Forster. The proposed new park name will help eliminate the aforementioned recurring traffic problem in the Sunset Point community. The current name misleads tourists into driving through the neighborhood in the belief that they can view the sunset from the Park. In fact, the park faces east and offers no view of the sunset. Mike Forster was elected as the Monroe County Commissioner for District 5 on November 3, 2021. Commissioner Forster has been a long-time Keys resident since 1990 and Upper Keys businessman. He served on the Islamorada Village Council for five terms, including two terms as Mayor, prior to being elected to the County Commission. Commissioner Forster will be remembered by the community for always stepping up and doing whatever it took to get something accomplished as shown by his wonderful, charitable spirit. Tragically, Commissioner Forster succumbed to Covid-19 on September 6, 2021. During his short time on the Board, Commissioner Forster took the lead on addressing the many traffic issues and safety concerns affecting the surrounding neighborhoods of the Sunset Point Park and boat ramp. PREVIOUS RELEVANT BOCC ACTION: September 15, 2021 BOCC gave direction to staff to prepare an Ordinance to rename Sunset Point Park to honor Commissioner Mike Forster. November 20, 2002 BOCC passed Ordinance 028-2002, amending Section 13.5 of the Monroe Packet Pg.4022 X.4 County Code deleting provisions regarding parking at Sunset Point Park. WHEREAS, under Florida Statutes, Section 125.01(1)(f) the Board of County 0 Commissioners (BOCC) of Monroe County, Florida, is granted the authority, among others, to provide parks,playgrounds, and recreation areas; and E WHEREAS, Mike Forster, was a long-time resident and business owner of the Upper Florida Keys after having relocated to Monroe County, Florida, in 1990; and WHEREAS, Mike Forster served five terms on the Islamorada Village Council, with two N of those terms serving as the Mayor; and N WHEREAS, Mike Forster served as a County Commissioner on the BOCC after having been elected for an initial term on November 3, 2020, until his untimely death on September 6, CL 2021; and c. WHEREAS, Commissioner Forster was well-known for his charitable efforts and fundraising not only in the local Florida Keys community, but also for those in need in foreign U) countries; and E WHEREAS, Commissioner Forster was instrumental in providing aid to the Florida Keys 2 community during Hurricane Irma, and other such disasters; and z �t WHEREAS, Commissioner Forster was always available to help all constituents,not only those in District 5, but anyone Keys-wide; and WHEREAS, the BOCC desires to recognize Commissioner Forster's true leadership, the Packet Pg.4024 X.4.a positive impact he had on the Florida Keys community, and his giving spirit with the difference he continually made in the Florida Keys; and "- WHEREAS, one issue that Commissioner Forster showed particularly notable leadership during his brief tenure on the Commission was addressing the traffic concerns of the neighbors of Sunset Point Park; and CL 0 CL WHEREAS, due to the current name of the park, travelers often drive to the park in the evening hours in hopes of seeing a sunset, when in fact the sunset cannot be seen from the park; and v) WHEREAS, by changing the name from Sunset Point Park to Mike Forster Memorial Park shall not only honor Commissioner Forster, it shall also serve as a lasting legacy of service 0 to that community by helping to alleviate unnecessary traffic flow caused by the park's current name. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: SECTION 1. The Monroe County park known as "Sunset Point Park" located at 20 E Sunset Road, Key Largo, Florida, is hereby renamed as the "Mike Forster Memorial Park" to honor the life and public service of the late Monroe County Commissioner Mike Forster. SECTION 2. The references to "Sunset Point Park" in Section 18-3(b)(8), Section 18- 27(a), Section 18-27(1)(1),and Section 18-27(m)(5)n of the Monroe County Code shall be changed to "Mike Forster Memorial Park." All remaining portions of the Code shall remain unchanged. N N U SECTION 3. SEVERABILITY. Should any provision of this Ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of this Ordinance as a whole, or any part thereof, other than the part declared to be invalid. If this ordinance or any provision thereof shall be held to be inapplicable to any person, property, or 0 circumstances, such holding shall not affect its applicability to any other person, property, or circumstances. SECTION 4. CONFLICT WITH OTHER ORDINANCES. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. SECTION 5. INCLUSION IN THE CODE OF ORDINANCES. The provisions of this 2 Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, U Florida, as an addition or amendment thereto, and shall be appropriately renumbered to confirm to z the uniform numbering system of the Code. SECTION 6. EFFECTIVE DATE.
