C> l> ...., ;:0 ... 0 , , ' WHEREAS, by County Resolution 105-1995 approved the local housing assistance plan for fiscal years 1995-1996, 1996-1997, and 1997-1998; and WHEREAS, in support of County Ordinance 03-1997 in coordination with ,the State of Florida the County applied for CDBG funds and allocated local SH;IP'for leveraging in support of required septic tank replacement and correcting Housing Quality Standards for very-low and low income homeowners; and . - WHEREAS, the 1997 legislative changes to Florida Statue 420 directly affect the SHIP program implementation requirements for FY 1997-1998 requiring a minimum of 30% of allocated funds to benefit very-low income persons with an additional 30% of allocated funds to benefit low income persons; and WHEREAS, the State of Florida through the Florida Housing Finance Agency has financially supported an affordable housing ownership project known as SaItPonds providing 29 units for very-low income persons with additional 79 units for low income persons; and WHEREAS, affordable housing ownership opportunities remain limited for very- low, low and moderate income persons with minimum funding assistance sources. NOW, THEREFORE, BE IT RESOLVED, that the Monroe County Board of County Commissioners hereby approves and adopts Amendment One to Local Housing Assistance Plan: Amendment One 1. Funding for Strategy 4 ( Loan Guarantee and Repurchase Fund) shall be allocated . to the Homeownership strategies, specifically FY 1996-97 in the approved budgeted amount of $98,124 from Loan GuaranteelRepurchase Account #700400-554-497, Fund 153 to HomeownershiplRehabilitation Existing Account # 700200-554-492, Fund 153 and ior FY 1997-98 authorized the proposed budget amount of $49,062 under Loan Guarantee and Repurchase to be transferred to Homeownership Accounts #700200-554- 492 Do\m Payment Assistance Account and #700200-554-493 Emergency Homeowner Repair, Fund 153 in the proportionate amounts deemed by SHIP Administrator for submittal to the BOCC in FY 1998 budget (October 1, 1997-September 30, 1998) for consideration and approval. 2. Set-aside $350,000 under Account # 700200-554-492 (homeowner down payment assistance) for project-specific participation of eligible very-low and low income personslhouseholds who qualify to participate in the affordable housing homeownership opportunities at SaltPonds Condominium in accordance' with the written agreement between the owner Greater Miami Neighborhoods, Inc. and the Special Programs Office, Monroe County Housing Authority or its designee. For any reason should this project be delayed beyond SHIP budget authority time requirements and/or not materialize then,.~e $350,000 shall remain in the Homeowner Down paymentJExisting Rehabilitation Assistance account and not be project-specific unless otherwise authorized by the BOCC. 3. In direct support of the County's CDBG Housing application's priority of septic tank replacement for very-low and low income homeowners the SHIP program administrator is directed to rollover $31,000 from ACCOlUlt #700200-554-493, Homeowner Emergency Repair from the Fiscal Year 1996-1997 to the same Account in the Fiscal Year 1997- 1998 SHIP budget. The revised budget amount of $80,062 for Account #700200-554- 493 shall be in direct support of septic replacement for very-low and low income participants under the CDBG program unless otherwise not required. 4. The original average SHIP cost per unit projected are hereby revised for the following strategies' implementation under FY 96-97 and FY 97-98 budgets based on the current changes to SHIP expenditure allocation requirements under F.S. 420; current SHIP State Rule requirements; implementation of County Ordinance 03-1997; and current real estate conditions for existing and new homes that meet SHIP sales price regulations; Homeownership Down Payment & Closing Costs !Rehabilitation Assistance up to $25,000. (To meet U.S. Department of Housing and Urban Development's Housing Quality Standards and any known county code violations.) Additional $5,000 based on the need to install state-mandated septic system. Homeownership Emergency Repairs Assistance up to $20,000. Includes eligibility of installation of state-mandated septic system. Homeownership Counseling Services up to $25,000 for FY 97-98. Rental Strategies (Rental Rehabilitation and/or emergency repairs) up to $15,000 per unit based on owner's matching funds. All SHIP funds in excess of $5,000 per unit under all strategies shall be secured by a mortgage and note and subject to recapture covenants. The SHIP administrator shall formulate any necessary changes to SHIP program procedures to meet the requirements of Florida Statue and SHIP Administrative Rule. .' Any recaptured SHIP funds or Program Income shall be subject to 5% administrative fee in accordance with Florida Statue 420 effective July 1, 1997.
