ITEM BACKGROUND: CE18010025: This property has been the subject of a code compliance case for not having the necessary building permits required for new wood stairs/deck, dock extension and a new tankless water heater that included electric and plumbing. The fines total $56,500.00 as of October 14, 2021 and will continue to accrue at$100.00 per day, until compliance is achieved. A hearing was scheduled for July 25, 2019. On or about July 23, 2019, property owners entered into a Stipulation for Agreement with time to comply for first time offenses with the County. On July 25, 2019, the Special Magistrate approved the stipulated agreement with a compliance date of October 25, 2019. On December 5, 2019, property owners signed a Stipulation for an Extension of Time to Comply with a new compliance date of January 27, 2020. This was followed by a Stipulation for Additional Extension of Time to Comply with a new compliance date of March 27, 2020. The County's lien was recorded on June 5, 2020. A subsequent hearing was held on April 1, 2021 and one of the property owners, Mr. Sprague, was present via Zoom. The Special Magistrate found the property remained in violation and granted the County's motion to proceed with collections. The code case remains open for non-compliance and failure to pay outstanding fines and costs. The property is homesteaded. There is a $417,000 mortgage on the property. Additionally, there is an $80,000 judgment lien, against one of the owners, that is superior to the County's interest. There are no pending foreclosure actions at this time. The Monroe County Property Appraiser lists the Fair Market Value for this property as $587,303. Under the policy adopted in Resolution 057-2014 the available legal options in regard to the County's lien on this property are: 1. Initiate litigation against the property owner for injunction and/or money judgment. Packet Pg. 1649 R.2 2. Allow the liens to remain against the property owner, the subject property and any other property owned by the property owner; and/or 3. Release the lien. County staff recommends initiating litigation (option 1) against the property owner for injunction and/or money judgment.
