Voluntarily Choose to Participate and Receive Additional Points (Maximum of 2 for $71,317.52)
within the Rate of Growth Ordinance/Non-Residential Rate of Growth Ordinance (ROGO/NROGO)
Allocation Systems.
ITEM BACKGROUND:
On April 13, 2016, the BOCC (Monroe County) adopted the 2030 Comprehensive Plan which
updated the Tier System. The effective date of the Plan was June 20, 2016. Monroe County 2030
Comprehensive Plan Policies 101.6.4 [ROGO] and 101.6.5 [NROGO] establish an optional criteria
for an applicant to make a monetary payment for additional points (to a maximum of two (2)points).
The 2030 Comprehensive Plan requires the monetary values to be set as follows:
1. The monetary value of each point shall be established annually by resolution of the BOCC.
2. The monetary value of each point shall be based upon the average fair market value of privately-
owned, buildable, vacant, Improved Subdivision (IS)/Urban Residential Mobile Home (URM),
platted lots.
The method for calculating the fair market value of a ROGO/NROGO monetary point is determined
by using Monroe County Geographic Information System (GIS) and Monroe County Property
Appraiser (MCPA) records. Using the average fair market value of a vacant, legally platted,
privately owned, buildable lot located in an IS/URM Land Use District, is $142,635.05. This value
($142,635.05) divided by four(4)which equals $35,658.76 as the monetary payment for each point.
Prior to the adoption of the 2030 Comp. Plan, the previous methodology established the monetary
value of each point based upon the estimated average fair market value of vacant, privately-owned,
buildable IS/URM zoned,platted lots that were designated as Tier I.
An applicant in ROGO/NROGO has an option to purchase a maximum of two (2) points for
$35,658.76 per point or $71,317.52 to increase their points when competing for a ROGO allocation.

These funds are then used to purchase land to retire potential development rights on other property
throughout the county.
PREVIOUS RELEVANT BOCC ACTION:
On November 17, 2020,the BOCC adopted the fair monetary value $31,562 per point pursuant to Resolution
394-2020.
On November 20, 2019,the BOCC adopted the fair monetary value $34,123.91 per point pursuant to
Resolution 410-2019.
On October 17, 2018, the BOCC adopted the fair monetary value $30,218 per point pursuant to Resolution
342-2018.
On November 22, 2016, the BOCC adopted the fair monetary value $22,418.84 per point pursuant to
Resolution 315-2016.
On April 13, 2016, the BOCC adopted the 2030 Comprehensive Plan, which amended the method for
calculating the monetary value to ROGO/NROGO points.
On November 17, 2015, the BOCC adopted the fair monetary value $6,098.04 per point pursuant to
Resolution 391-2015.
On November 18, 2014, the BOCC adopted the fair monetary value $7,966.57 per point pursuant to
Resolution 366-2014.
On October 16, 2013, the BOCC adopted the fair monetary value $3,174.32 per point pursuant to Resolution
337-2013.
On June 18, 2011, the BOCC adopted the fair monetary value $3,543.87 per point pursuant to Resolution
166-2011.
On May 19, 2010, the BOCC adopted the fair monetary value $6,637.85 per point pursuant to Resolution
134-2010.
On July 16, 2008, the BOCC adopted the fair monetary value $11,750.00 per point pursuant to Resolution
218-2008.
On March 15,2006, the BOCC adopted Ordinances 009-2006 and 011-2006, establishing the Tier System.

11 WHEREAS,the Board of County Commissioners (`BOCC") approved Ordinance No. 009-2006 at a
12 regularly scheduled duly noticed public meeting on March 15,2006,establishing the potential for an applicant E
13 to receive up to a maximum of two (2) additional points toward an application in the ROGO competition in
14 return for a contribution to the County's land acquisition fund in the amount of the value of a ROGO dedication 0

38 NOW THEREFORE,BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
18 OF MONROE COUNTY,FLORIDA:
41 Section 1. The foregoing recitals, findings of fact, and conclusions of law, are true and correct,
and are hereby incorporated as if fully set forth herein.
Section 2. The BOCC has duly considered the entirety of the record.
46 Section 3. The Monroe County Board of County Commissioners hereby makes, enters, and
4� adopts the following findings, conclusions, and determinations:
49 A. The BOCC accepts the Monroe County Planning and Environmental Resources Department's
50 ("Planning Department" or "Department") methodology for establishing the average fair market
51 value of all vacant, legally platted, privately owned, buildable, lots located in an Improved

1 Subdivision (IS) or Urban Residential Mobile Home (URM) land use district and utilizing the
current official records of the Monroe County Property Appraiser as shown in Attachment A.
4 B. The average fair market value for all vacant, legally platted, privately owned, buildable, lots
5 located in an Improved Subdivision (IS) or Urban Residential Mobile Home (URM) land use
6 district is $142,635.05. The average was calculated by using the individual values of 1943
properties within Monroe County.
9 C. The BOCC accepts the Planning and Environmental Resources Department's calculation of the
10 monetary value of one point based on the average fair market value of parcels referred to in Sec.
1� 2, divided by four equals $35,658.76 per point.
13 D. The BOCC establishes the fair monetary value per point of$35,658.76 for the time period between
14 November 17, 2021 to November 17, 2022. This shall be considered the fair compensation per
155 point awarded to an applicant with a maximum award available of two (2)points.
17 E. If the time period designated for the per point cost expires, the cost in Section 4 shall remain in
full force and effect until otherwise changed by the BOCC.
20 Section 4. Construction and Interpretation. This Resolution and its interpretation, including but c
21 not limited to in event of any alleged,found,or legally held ambiguity,shall be liberally construed and enforced
22 in favor of Monroe County to effectuate its/the public purpose(s) and policy(ies) of the County. The
23 construction and interpretation of this Resolution and all Monroe County Comprehensive Plan provision(s),
24 Florida Building Code, Florida Statutes, and Monroe County Code(s) provisions whose interpretation arises
25 out of, relates to, or is/are interpreted in connection with this Resolution shall be liberally construed and
26 enforced in favor of Monroe County to effectuate its/the public purpose(s) and policy(ies) of the County, and
27 shall be construed in favor of Monroe County and such construction and interpretation shall be entitled to great o

34 weight in adversarial administrative proceedings, at trial, in bankruptcy, and on appeal.
30 Section 5. Severability.If any provision of this Resolution, or any part or portion thereof, is held to
31 be invalid or unenforceable by any administrative hearing officer or court of competent jurisdiction, the
32 invalidity or unenforce ability of such provision, or any part or portion thereof, shall neither limit or impair the 2
33 operation, enforceability, or validity of any other provision of this Resolution, or any remaining part(s) or >
34 portion(s) thereof. All other provisions of this Resolution and remaining part(s) or portion(s) thereof, shall
36 continue unimpaired in full force and effect. CL

5 COMMISSIONERS ESTABLISHING THE MONETARY VALUE OF A
6 SINGLE ROGO/NROGO ALLOCATION SYSTEM COMPETITION POINT >
7 FOR PURPOSES OF PAYMENT BY APPLICANTS IN THE ROGO/NROGO
8 SYSTEM FOR A MAXIMUM OF 2 POINTS AVAIABLE PER ROGO/NROGO

11 WHEREAS,the Board of County Commissioners (`BOCC") approved Ordinance No. 009-2006 at a 0
12 regularly scheduled duly noticed public meeting on March 15,2006, establishing the potential for an applicant
13 to receive up to a maximum of two (2) additional points toward an application in the ROGO competition in
14 return for a contribution to the County's land acquisition fund in the amount of the value of a ROGO dedication e�
}56 point; and
17 WHEREAS, the BOCC approved Ordinance No. 011-2006 at a regularly scheduled duly noticed
18 public meeting on March 15, 2006, establishing the potential for an applicant to receive up to a maximum of
19 two (2) additional points toward an application in the NROGO competition in return for a contribution to the -�
County's land acquisition fund in the amount of the value of a NROGO dedication point; and 0
22 WHEREAS, the BOCC on April 13, 2016 approved the Monroe County 2030 Comprehensive Plan
23 which updated the ROGO/NROGO evaluation criteria which includes up to a maximum of two (2) additional
24 points toward an application in the ROGO/NROGO competition in return for a contribution to the County's
355 land acquisition fund in the amount of the value of a ROGO dedication point
27 WHEREAS,Monroe County 2030 Comprehensive Plan requires that the monetary value of each point
be established annually by resolution of the BOCC; and
30 WHEREAS, Monroe County 2030 Comprehensive Plan Policies 101.6.4 (ROGO) and 101.6.5 C
31 (NROGO) establish that the monetary value shall be based on the average fair market value of all vacant, 0
32 legally platted, privately owned, buildable, lots located in an improved subdivision (IS) or urban residential
134 mobile home (URM) land use district; and
35 WHEREAS,the BOCC previously adopted the monetary point value pursuant to Resolution No.394- c
2020;
38 NOW THEREFORE,BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS 03
18 OF MONROE COUNTY,FLORIDA:
41 Section 1. The foregoing recitals, findings of fact, and conclusions of law, are true and correct,
and are hereby incorporated as if fully set forth herein.
Section 2. The BOCC has duly considered the entirety of the record.
46 Section 3. The Monroe County Board of County Commissioners hereby makes, enters, and
4� adopts the following findings, conclusions, and determinations:
49 A. The BOCC accepts the Monroe County Planning and Environmental Resources Department's
50 ("Planning Department" or "Department") methodology for establishing the average fair market
51 value of all vacant, legally platted, privately owned, buildable, lots located in an Improved

1 Subdivision (IS) or Urban Residential Mobile Home (URM) land use district and utilizing the
current official records of the Monroe County Property Appraiser as shown in Attachment A.
4 B. The average fair market value for all vacant, legally platted, privately owned, buildable, lots
5 located in an Improved Subdivision (IS) or Urban Residential Mobile Home (URM) land use
6 district is $142,635.05. The average was calculated by using the individual values of 1943
properties within Monroe County.
9 C. The BOCC accepts the Planning and Environmental Resources Department's calculation of the
10 monetary value of one point based on the average fair market value of parcels referred to in Sec.
2, divided by four equals $35,658.76 per point.
13 D. The BOCC establishes the fair monetary value per point of$35,658.76 for the time period between >

14 November 17, 2021 to November 17, 2022. This shall be considered the fair compensation per
}56 point awarded to an applicant with a maximum award available of two (2)points.

17 E. If the time period designated for the per point cost expires, the cost in Section 4 shall remain in
14 full force and effect until otherwise changed by the BOCC. S

20 Section 4. Construction and Interpretation. This Resolution and its interpretation, including but 0'
21 not limited to in event of any alleged,found,or legally held ambiguity,shall be liberally construed and enforced 0
22 in favor of Monroe County to effectuate its/the public purpose(s) and policy(ies) of the County. The
23 construction and interpretation of this Resolution and all Monroe County Comprehensive Plan provision(s), `✓
24 Florida Building Code, Florida Statutes, and Monroe County Code(s) provisions whose interpretation arises 0
25 out of, relates to, or is/are interpreted in connection with this Resolution shall be liberally construed and
26 enforced in favor of Monroe County to effectuate its/the public purpose(s) and policy(ies) of the County, and
27 shall be construed in favor of Monroe County and such construction and interpretation shall be entitled to great
34 weight in adversarial administrative proceedings, at trial,in bankruptcy, and on appeal. c
30 Section 5. Severability.If any provision of this Resolution, or any part or portion thereof, is held to
31 be invalid or unenforceable by any administrative hearing officer or court of competent jurisdiction, the
32 invalidity or unenforceability of such provision, or any part or portion thereof, shall neither limit or impair the 6
33 operation, enforceability, or validity of any other provision of this Resolution, or any remaining part(s) or
34 portion(s) thereof. All other provisions of this Resolution and remaining part(s) or portion(s) thereof, shall o,
36 continue unimpaired in full force and effect. 2
37 PASSED AND ADOPTED at a regular meeting of the Board of County Commissioners of Monroe
39 County, Florida,held on the 17'day of November 2021. .0
