FOR PUBLIC DEFENDER'S OFFICE—316 SIMONTON STREET In accordance with the Consultant Agreement for Professional Architectural and Engineering Services, made and entered into on December 19, 2018 between MONROE COUNTY, ("County") and BENDER & ASSOCIATES ARCHITECTS, P.A. , ("Consultant"), where professional services are allowed if construction costs do not exceed $4,000,000.00, or for study activity if the fee for professional services for each individual study under the contract does not exceed $500,000.00 ("Agreement"), as provided in Subsection 287.055(2)(g), Florida Statutes, as amended by Section 2, Chapter 2020-127, Laws of Florida,pursuant to which Recital No. 3 of the Agreement is hereby modified,the parties enter into this First Amendment to the Task Order with an effective date of July 15, 2020 ("Task Order"). All terms and conditions of the Agreement apply to this First Amendment, unless this First Amendment amends, adds, or modifies a provision or an Article of the Agreement of which will be specifically referenced in this First Amendment and the amendment, addition, or modification shall be precisely described. This First Amendment to the Task Order is effective on the 17th day of November, 2021. WHEREAS,the parties entered into a Task Order on July 15, 2020 for professional architectural and engineering services to plan, program and design tenant improvements for the renovation of the building located at 316 Simonton Street, Key West which is to become the new location of the Public Defender's Office of the 16th Judicial Circuit of Florida; and WHEREAS, the need for additional design services has been identified to provide drawings for telephone, data, and security systems. NOW, THEREFORE, the Task Order shall be amended to include the additional required scope of services and in consideration of the mutual promises and covenants set forth below, the parties agree as follows: 1. In accordance with Article II, SCOPE OF BASIC SERVICES of the Agreement,the Consultant will provide design and support for these additional services. The additional scope of work will include the following tasks: • Provide Detailed Technology and Security Design Documentation for new Public Defender Facility • Includes Site Conduit and Fiber/Copper Ductbank Routing for facility connectivity • Includes the following disciplines: o Network Data, Voice Outlet Locations o Wireless Outlet Locations o IDF/MDF Room Design and requirements o Security System and Video surveillance for Public Areas o AN systems for Public Areas Page 1 of 2 o Network systems Coordination for Data and other IP Applications o IP backbone services,LAN and WLAN services connecting to other facilities 2. In accordance with Article VII paragraph 7.1.1 of the Agreement,the County shall pay the Consultant a lump sum total of Ten Thousand Nine Hundred Thirty and 001100 dollars (S10,930.00)paid upon completion of the drawings and services and approval by the Director of Project Management. The total project cost including the original Task Order and this First Amendment shall be a lump sum total of One Hundred Eighty Thousand Nine Hundred Ninety-Four and 00/100 Dollars ($180,994.00). All other Terms and Conditions of the Agreement remain unchanged and in full forces and effect.
