AGENDA ITEM WORDING: An Attorney-Client Closed Session in the Matter of Roy's Trailer
Park, Inc., dba Island Life Village v. Eric Noel, Marie Noel, and Monroe County, Case No. 19-CA-
175-K.
ITEM BACKGROUND: A closed attorney-client session pursuant to Section 286.011(8), Florida
Statutes will be held at the 12-8-2021 Regular Meeting of the Monroe County Board of County
Commissioners. The persons attending the meeting will be the County Commissioners, County
Administrator, Roman Gastesi; County Attorney, Bob Shillinger; Assistant County Attorneys, Derek
Howard and Cynthia Hall, and a certified Court Reporter.
Pursuant to F.S. 286.011(8), the subject matter of the meeting shall be confined to settlement
negotiations or strategy sessions related to litigation expenditures.
PREVIOUS RELEVANT BOCC ACTION:
At the July 21, 2021 BOCC Meeting, the closed session was continued to the August 18, 2021
BOCC Meeting; at the 08/18/2021 Meeting, the closed session was continued to the September 15,
2021 BOCC Meeting; at the 09/15/2021 Meeting, the closed session was continued to the October
20, 2021 BOCC Meeting; at the 10/20/21 Meeting, the closed session was continued to the
November 17, 2021 Meeting; at the 11/17/2021 meeting, the closed session was continued to the
December 8, 2021 Meeting.

1. Prior to going into closed session:
A closed attorney-client session pursuant to Section 286.011(8), Florida
Statutes, will now be held. It is estimated that this meeting will take
approximately thirty (30) minutes. The persons attending the meeting will be
the County Commissioners; County Administrator, Roman Gastesi; County
Attorney, Bob Shillinger; Assistant County Attorneys Derek Howard and Cynthia
Hall, and a certified court reporter.
Since the law prohibits any other person from being present at the closed y
session, the Commissioners, the County Administrator, the attorneys for the o
County, and the Court Reporter will now remain in this meeting room, and all
other persons are required to leave the room. When the closed session is over, N
the public meeting will be re-opened and re-convened. This public meeting is o
now closed.

I now call this closed session to order. For the record, this meeting is being held
upon the request of County Attorney, Bob Shillinger, who announced at a prior y
BOCC Meeting held on June 16, 2021, that he needed advice in the matter of
Roy's Trailer Park, Inc., d/b/a Island Life Village v. Eric Noel, Marie C. Noel, and
Monroe County, Case No. 19-CA-000175-K. At that meeting the Board approved
holding a closed session and public notice was given through public
announcement of the meeting at the June 16, 2021, BOCC meeting, and also
through publication of the December 8, 2021 BOCC meeting on the County's
website. For the record, and the benefit of the Court Reporter, each of us will
state our name and position, starting with the Commission:

Just as a reminder, we will only be discussing settlement negotiations and
strategy relating to litigation expenditures. We cannot take any decisive action
at this meeting. We can only provide information and direction to the attorneys.
Any decisions this Board makes concerning this case must be done in a meeting N
