ITEM BACKGROUND: Residents of Sunset Point and Bay Harbor Subdivisions have repeatedly
and vociferously complained about what can be summarized as the misuse and overuse of a platted
strip of right-of-way known as Bay Drive, and the associated impacts on their neighborhood. Bay
Drive is a strip of unpaved right of way that is approximately 60' wide and 240' long that overlaps
the plats of both subdivisions and terminates in Florida Bay by way of a sandy beach. Both plats
dedicate the strip of land to the County as right-of-way to the"perpetual use of the public for proper
purposes." In that context, the County doesn't own the land outright, but instead holds in trust for
the benefit of the public what amounts to an easement over the land for right-of-way purposes.
Pedestrian access to the end of the right-of-way is one such purpose. Over the years, the unpaved
strip of right-of-way has been used to access the bay and the beach at the end of the right-of-way.
That beach and the grassy upland portion of the unpaved right-of-way has attracted unruly crowds,
many of whom have disrupted the ability of residents to enjoy their homes. The number of cars
traversing the neighborhood to reach the beach far exceed the spaces allotted for parking at the edge
of the right-of-way. Consequently, many visitors have parked throughout the neighborhood
including, at times, on private property.
The Board has discussed issues associated with this strip of land several times over the past 25 years.
In 2011, the Board adopted rules of conduct for using the right-of-way. The issue is complicated by
the fact that Section 19-1(b) of the County Code prohibits the Board from abandoning any dedicated
and accepted right-of-way that terminates on or provides access to open water. The discussions have
occurred with more frequency since 2020, when the overuse issues boiled over.
Last summer, the Board temporarily closed down the right-of-way at the request of the
neighborhood to prevent what was expected to be very contentious situations during the Fourth of
July and Labor Day holidays, as well as lobster mini-season. In September of 2021, the Board voted
to reopen access to the right-of-way on Tuesdays, Wednesdays, and Thursdays from 7 am until 7
pm. While the partial closure has addressed some issues, it is not viewed as a long-term solution.
At the December 2021, BOCC meeting, the Board discussed a preliminary proposal (not a formal
application)to re-plat both subdivisions to dedicate this strip of land for some use other than as a
platted right-of-way. Members of the public spoke on both sides of the issue, with neighborhood
residents mostly advocating for a re-plat which would have the effect of closing off public access.
Other area residents advocated against such a re-plat so they could continue to access the beach and
water via the right-of-way. The Board's discussion recognized the need to address the concerns of
neighborhood residents while also preserving the ability of local residents who don't live in the
neighborhood to access the beach and water through the strip of land over which the Bay Drive
right-of-way extends.
At the conclusion of the discussion, the Board the directed staff to bring back more information at
the January meeting for further discussion with the hopes of addressing both competing interests.
During the intervening month, staff has worked collaboratively, including discussions with residents
and their attorney. As of agenda deadline, staff is still drilling down on the details for some options.
Staff expects to update this item with additional information prior to that meeting.
