ITEM BACKGROUND: This Task Order Amendment authorizes Cardno, Inc. to continue a site assessment for perfluorooctanoic acid (PFOA) and perfluorooctane sulfonate (PFOS) at the Monroe County Joe London Fire Training Academy. This work is being performed by Cardno, one of the County's on-call contractors. After reviewing the earlier site assessments, FDEP required additional sampling wells and analyses. Cardno's proposal to do the additional work is $155,960. Since Cardno has performed the prior work, it is appropriate to continue with them to ensure consistency of the data. Staff seeks Board approval of this additional Amendment to the Task Order with the proposal attached. PREVIOUS RELEVANT BOCC ACTION: BOCC approved the initial Task Order on February 19, 2020 for $79,900.00. BOCC approved the Pt Amendment on October 21, 2020 in the amount of $25,800. FOR JOE LONDON FIRE TRAINING ACADEMY In accordance with the Agreement for Professional Architectural and Engineering Services, made and entered into on December 19, 2018 between MONROE COUNTY, hereinafter referred to as the "County," and CARDNO, INC. hereinafter referred to as "Consultant," where professional services are allowed if construction costs do not exceed $4,000,000.00, or for study activity if the fee for professional services for each individual study under the contract does not exceed $500,000.00 ("Agreement"), as provided in Subsection 287.055(2)(g), Florida Statutes, as amended by Section 2, Chapter 2020-127, Laws of Florida, pursuant to which Attachment A, Subsection 1.01 of the Agreement is hereby modified, the parties enter into this Second Amendment to the Task Order. All terms and conditions of the Agreement apply to this Second Amendment, unless this Second Amendment amends, adds, or modifies a provision or an Article of the Agreement in which case the Article will be specifically referenced in this Second Amendment and the amendment,addition, or modification shall be precisely described. These additions apply only to the project referenced in this Second Amendment to the Task Order. This Second Amendment is effective on the 21st day of January, 2022. WHEREAS, Florida Department of Environmental Protection Site Investigation Section collected samples of ground water, surface water, sediment and soil to test for perfluorooctanoic acid (PFOA) and perfluorooctane sulfonate (PFOS) at the Monroe County-Joe London Fire Training Academy (Facility) on September 26, 2019; and WHEREAS, the Florida Department of Environmental Protection ("FDEP") notified Monroe County Fire Rescue of high concentrations of said contaminants in a letter dated November 8, 2019; and WHEREAS, the County is required under Rule 62-780.600, Florida Administrative Code, to conduct a site assessment at the Facility; and WHEREAS, the parties entered into a Task Order on January 22, 2020, whereby the Consultant prepared a draft assessment plan for FDEP review, conducted soil and groundwater assessments and prepared a Site Assessment Report(SAR) for the County; and WHEREAS, upon request by FDEP dated September 18, 2020 for a further study, the parties entered into a First Amendment to the Task Order on October 21, 2020 whereby the Consultant was to conduct additional soil and groundwater assessments and prepare a second Site Assessment Report (SAR); and Page 1 of 4 WHEREAS, on or about October 16, 2020, Cardno performed the additiobal requested by FDEP, and on February 22, 2021, Cardno sent Site Assessment Report 4 2 to FDEP for review; and WHEREAS, on May 26, 2021, FDEP responded by requesting two additional monitoring wells and additional monitoring; and WHEREAS, due to recent changes in hazardous waste designation by the federal government and limited disposal facilities resulting in increased transportation and disposal costs necessitating additional funding, disposal of the excavated soils must be shipped to an appropriately approved hazardous material waste disposal facility; and WHEREAS, on December 2, 2021, Cardno submitted a proposal for the additional work(Exhibit A to this Task Order). NOW THEREFORE, IN CONSIDERATION of the mutual promises and covenants set forth below, the parties hereby agree as follows: 1. In accordance with Article II, SCOPE OF BASIC SERVICES of the Agreement and Exhibit A, the Consultant will conduct: Task 1 - Installation of six (6) new monitoring wells. Task 2—Provide Groundwater Sampling Event with Report. Task 3 — Soil Excavation and Removal. Task 4— Three Additional Quarterly Groundwater Sampling Events with Reports 2.
