ITEM BACKGROUND: The South Florida Water Management District("District") under Florida Statutes Chapter 373 has the responsibility and exclusive authority for regulating the consumptive use of water. The District has promulgated Chapter 40E-2, Florida Administrative Code ("F.A.C."), for the consumptive use of water, which includes Rule 40E-2.061, F.A.C., General Consumptive Use Permits by Rule, regulating landscape irrigation at a single-family dwelling or duplex, and Rule 40E- 2.071, F.A.C., Noticed General and Individual Permits, regulating larger landscape irrigation users. Chapter 40E-24, F.A.C., comprises the Mandatory Year-Round Landscape Irrigation Conservation Measures within the District's boundaries. The intent of these mandatory conservation measures is to provide a framework for consistent implementation, geared towards ensuring the long-term sustainability of the region's water resources, to increase water use efficiency, and to prevent and/or curtail wasteful water use practices, through regulatory mechanisms applicable to landscape irrigation by all users. The proposed amendment to Chapter 12, Article IV, of the Monroe County Code of Ordinances, is in accordance with the requirements of Rules 40E-24.201 and 40E-24.301, F.A.C., respectively. PREVIOUS RELEVANT BOCC ACTION: November 20, 2002 — The Board of County Commissioners ("Board") adopted the Monroe County Water and Irrigation Conservation Ordinance (Ordinance No. 030-2002).
